Dear Mr. Rumpf:
On behalf of Wal*Mart Stores East, Inc. (Wal*Mart), we are requesting an appeal ofa
Land Development regulation provision related to the above referenced project. A check
in the amount of $400,00 will be provided to you as soon as we receive it from
Wal * Mart. At a meeting on May 13, 1999, you met with Kevin M. Roberson of
Kimley-Hom and Associates, Inc. and Ms. Susan P. Motley of Ruden, McClosky, Smith,
Schuster & Russell, P.A. You brought to their attention that Chapter 9, Section 11,
Paragraph J of the City's Land Development Regulations states that no overhead doors
shall face Winchester Park Boulevard (among other rights-of-way in the City).
In order to comply with this requirement, the docking bay would have to be relocated to
the rear of the building. This relocation cannot occur without reducing the size of the
parking area and undergoing a complete redesign at this late stage in the site plan
approval process. Therefore, Wal * Mart proposes to appeal this requirement and to
construct a six-foot high masonry stucco wall between the landscape buffer and dry
detention area along Winchester Park Boulevard in order to screen the overhead doors
from the roadway. The screen wall will have architectural features and look similar to
the wall behind the Sports Authority. Included with this letter is a revised site plan
showing the proposed wall.
We believe it is noteworthy that the overhead doors are over 380 feet from the
westernmost right-of-way for Winchester Park Boulevard. Additionally, directly east of
these doors across Winchester Boulevard is the rear of the Sports Authority and an
undeveloped commercial parcel. When one considers the distance of the bay doors from
Winchester Boulevard, and the visual screening the wall and landscaping will provide,
the proposed site plan will still promote comprehensible cohesiveness among
developments along Winchester Boulevard and is in keeping with the City's Community
Design Plan.
We appreciate your understanding with this issue and continue to look forward to
working with the City of Boynton Beach on a successful completion of this process.
