THE APPLICATION OF BETHESDA MEMORIAL
HOSPITAL, LOCATED ON SOUTHEAST 24TH
AVENUE, + 100 FEET EAST OF ITS INTERSECTION
WITH SEACREST BOULEVARD; AMENDING
ORDINANCE 89-38 OF SAID CITY BY AMENDING
THE FUTURE LAND USE ELEMENT OF THE
COMPREHENSIVE PLAN OF THE CITY BY ADOPTING
THE PROPER LAND USE OF CERTAIN PROPERTY,
MORE PARTICULARLY DESCRIBED HEREINAFTER;
SAID LAND USE DESIGNATION IS BEING CHANGED

WHEREAS, the City Commission of the City of Boynton Beach, Florida has
adopted a Comprehensive Future Land Use Plan and as part of said Plan a
Future Land Use Element by Ordinance No. 89-38 in accordance with the Local
Government Comprehensive Planning Act; and
WHEREAS, the procedure for amendment of a Future Land Use Element
of a Comprehensive Plan as set forth in Chapter 163, Florida Statutes, has been
followed; and
WHEREAS, after public hearing and study, the City Commission deems
It in the best Interest of the Inhabitants of said City to amend the aforesaid
Element of the Comprehensive Plan as adopted by the City herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: Ordinance No. 89-38 of the City Is hereby amended to reflect the
following:
That the Future Land Use of the following described land shall be
designated as Office Commercial. Said land is more particularly described as
follows:
I
Lots 29 and 30 of HIGH POINT, Section 33, Township 45 South, Range
43 East, Boynton Beach, Palm Beach County, Florida.
Section 2: That any maps adopted In accordance with the Future Land Use
Element shall be amended accordingly.
Section 3: All ordinances or parts of ordinances in conflict herewith are hereby
repealed.
Section 4: Should any section or provision of this Ordinance or any portion
thereof be declared by a court of competent jurisdiction to be invalid, such decision
shall not affect the remainder of this Ordinance.
Section 5: This Ordinance shall become effective 31 days after adoption,
unless challenged. If challenged, it becomes effective upon the issuance of a final
order finding it in compliance.

5. The plans should indicate which of the Slash Pines (14), Sabal Palms (3), Banyan X
(I) and Camphor (2) trees will be preserved, relocated or removed/replaced on the
site. There are a total of twenty (20) existing trees, which should be indicated on the
plans.
PLANNING AND ZONING

6. On the site plan. Provide a dimension for a typical parking stall width. (City X
drawing #B-900 12).
7. Locate and label the site triangles on the landscape plan. (Ch. 7.5, Art. n, Sec. 5.H) X
8. Provide a note on the Landscape Plan stating that a minimum of 50% of required X
planting material is native species. (Comp. Plan, Policy 4.45)
9. Provide a note on the Landscape Plan indicating the type of irrigation and source of X

18. Include measures to mitigate any adverse impacts of the site lighting on the adjacent X
residential property such as timers and light shields.

appeared that Mr. Souza was not present. He stated that due to some wording in the
back-up he had some concerns that the City Manager was not able to answer. Mr. Dale
Sugerman was on vacation. Since his concerns couid not be addressed at this time he
asked that it be tabied until the June 6 meeting pending clarification.
Commissioner Rsher asked if it were tabled until the next meeting would the applicant
lose it? Mr. Bressner stated that as long as Mr. Sugerman was able to file on the day
following the Commission meeting, they would still meet the deadline.
Commissioner Rsher seconded the motion to table this item until the June 6 meeting.
Motion carried 5.0.

April 25, 2000
Mr. Myott asked if the hospital had a Master Plan to which Mr. Rumpf replied yes. Their
Master Plan has to do with the buildout of the building itself and that there is an ultimate
phase which will probably put a parking structure on the hospital's site in the future. Mr.
Myott thought that would probably be on the north backside of the property which Mr.
Rumpf confirmed as most likely.
At this point Chairman Wische closed the pUblic hearing as no further comments were
made.
Mr. Ensler was concemed about queuing and the effect on traffic with only one
entrance/exit and the effect of traffic at peak times. Mr. Friedland couldn't believe that all
employees would come in at one time and even if they did he could not see a prOblem
with it.
Mr. Friedland expressed a desire to vote in favor of the project to support the hospital.
He knew it wasn't a perfect plan but it was very much needed by the hospital. Mr. Hay
agreed with him and said it would relieve an existing situation to have an altemate
parking site.
Mr. Finkelstein asked if it would be appropriate to do a variance for the two lots in
question as opposed to changing the zoning. Mr. Rumpf replied that the variance
process does not apply to uses.
Motion
Vice Chair Dube moved to approve the request to amend the Comprehensive Plan
FuturB Land Use Map from Low Density Residential to Office Commercial and rezone
from Single-family Residential District (R-1AA) to Office/Professional Commercial District
(C-1) for Bethesda Memorial Hospital Parking Lot Addition, subject to all staff comments.
Mr. Friedland seconded the motion.
Motion passed 7-0.
