Dear Mr. Gibson:
As discussed during our meeting earlier this day I have amended the City's
proposed annexation ordinance for the above referenced property which is scheduled for
Second Reading this Tuesday, October 18, 1994. Section 3 of the ordinance has been
amended to specifically provide that following the adoption of the annexation ordinance
the City will immediately proceed to process a land use plan amendment and rezoning for
the property to low density residential and R1 AAB.
If this proposed change is agreeable there will not be a need for your client to
execute any documents in connection with this annexation. The City will proceed to
process the aforementioned land use plan amendment and rezoning.

THE CITY OF BOYNTON BEACH, FLORIDA,
REGARDING THE PALM BEACH GROVES PROPERTY
(WEST SIDE OF LAWRENCE ROAD, BEGINNING
APPROXIMATELY 1,300 FEET SOUTH OF
HYPOLUXO ROAD) ANNEXING A CERTAIN
UNINCORPORATED TRACT OF LAND THAT IS
CONTIGUOUS TO THE CITY LIMITS WITHIN PALM
BEACH COUNTY AND THAT WILL, UPON ITS
ANNEXATION, CONSTITUTE A REASONABLY
COMPACT ADDITION TO THE CITY TERRITORY,
PURSUANT TO A PETITION OF THE OWNER OF
SAID TRACT OF LAND, REQUESTING ANNEXATION

WHEREAS, the Comprehensive Plan for the City of Boynton
Beach requires the development of an Annexation Programi
WHEREAS, the City of Boynton Beach, through the
Annexation Program, has identified adjacent properties that
are the subj ects of agreements for water service with the
CitYi
WHEREAS, said agreements for water service are also
considered VOluntary petitions for annexation pursuant to
Florida Statutes, which can be executed by the City of Boynton
Beach at any time such properties are eligible for annexation
according to Florida Statutes;
WHEREAS, the City of Boynton Beach hereby exercises its
option to annex the following tract of land as hereinafter
described, in accordance with Article I, Section 7 (32) of the
Charter of the City and Section 171. 044, and 171. 062 (2)
Florida Statutes: and
WHEREAS, said tract of land lying and being within Palm
Beach County is contiguous to the existing City limits of the
City of Boynton Beach, Florida and will, upon its annexation,
constitute a reasonably compact addition to the City
territory.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1: Pursuant to Article I, Section 7 (32) of the
Charter of the City of Boynton Beach, Florida and Section
171.044, Florida Statutes, the following described
unincorporated and contiguous tract of land situated and lying
and being in the County of Palm Beach, Florida, to wit:
The East 643.18 feet, as measured at
right angles to the East line thereof, of
Tracts 9 and 16, Northeast 1/4 of Section
12, Township 45 South, Range 42 East,
Mary A. Lyman et aI, as recorded in Plat
Book 9, at page 74 according to the
Public Records of Palm Beach County,
Florida. Except any and all legal
rights-of-way, Easements or Reservations
of Record.
Containing 19.77 acres more or less.
Together with L.W.D.D. L-19 Canal R/W
adjacent South of property.
lS hereby annexed to the City of Boynton Beach, Florida, and
such land so annexed shall be and become part of the City with
the same force and effect as though the same had been
originally incorporated in the territorial boundaries thereof.
Section 2: That Section 6 and 6(a) of the Charter of the
City of Boynton Beach, Florida, is hereby amended to reflect
the annexation of said tract of land more particularly
described in Section 1 of this Ordinance.
Section 3: That by Ordinances adopted simultaneously
herewith, a certain City zoning designation and Land Use
category is being adopted, provided, however, the City has
determined that it is in the best interest of the public, and
will immediately proceed to process, a land use plan amendment
for low density residential and a rezoning to R1AAB all as
contemplated in Section 171.062(2) Florida Statutes.
Section 4:
All ordinances or parts of ordinances ln
conflict herewith are hereby repealed.
Section 5:
Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall not
affect the remainder of this Ordinance.
Section 6: This Ordinance shall not be passed until the
same has been advertised for two (2) consecutive weeks in a
newspaper of general circulation in the City of Boynton Beach,
Florida, as required by the City Charter and Section 171.044,
Florida Statutes.
Section 7: The effective date of this Ordinance shall be

the date a final order is issued by the Department of
Community Affairs finding the corresponding amendment to the
Comprehensive Plan to be in compliance in accordance with
Chapter 163.3184, F.S.,; or the date a final order is issued
by the Administration Commission finding the corresponding
amendment to be in compliance in accordance with Chapter
163.3184, F.S. The notice of compliance becomes a final order
21 days following the issuance of the notice of compliance if
during the 21-day period no petitions are filed challenging
the corresponding Plan amendment. Once issued, the Notice of
Intent shall be attached hereto as Exhibit -A" and made a part
of this ordinance by reference.
Section 8: Specific authority is hereby given to codify
this Ordinance.
Section 9: This Ordinance, after adoption, shall be
filed with the Clerk of the Circuit Court of Palm Beach
County, Florida.

This letter is in response to your request for information on
Knollwood Groves, located on the southwest corner of Lawrence Road
and Knollwood Road, adjacent to the municipal boundaries of the City
of Boynton Beach.
Knollwood Groves is zoned Agricultural Residential (AR) and received
special exception approval to allow a "commercial citrus products
sales and service enterprise" in 1983 (Resolution R-83-1422
attached). In 1983 the property owner wanted to remove an existing
building and construct a new building on-site. Although the
agricultural sales and service uses had been on-site since 1930, a
special exception approval was required in order to obtain the
building permit.
The PBC Tax Collector's office has verified that the retail store on
site has been licensed for the sale of produce, plants, and giftware
since at least 1982. Aola Walden, Senior Compliance Office, stated
that there are no violations on the subject property and all
activities on-site are either permitted by special exception
(citrus, produce, giftware retail sales) or grandfathered in as
accessory uses (tours and educational activities for tourists).
staff research on Knollwood Groves has indicated the following:
1) The principal use has been there since 1930 and is a valid
agricultural use 'which is encouraged in the Comprehensive
Plan. The operation is only seasonal and attracts tourism
to the area. All uses are contained within the 30 acre
orange grove and do not adversely affect adjacent
properties.

3) The special exception conditions of approval do not
specifically restrict any related accessory uses for the
business operation. Minutes of the public hearing for the
special exception address the tours through the groves as
if they are a permitted accessory, and grandfathered use.

In connection with the City's Annexation Program, we are considering the annexation of
Knollwood Groves which is located on the southwest corner of Lawrence Road and
Knol1wood Road. In response to complaints by adjacent property owners regarding
whether certain aspects of this business are permitted, staff has been researching this
use,
In addition to the typical function of a grove business. Knollwood Groves sells
gifts/souvenirs, baked goods. fl~its and vegetables not grown on the premises. and
offers wagon tours of the groves (for a fee) and educational activities on Native
Americans and the environment featuring exhibits and native animals such as the
alligator (several small alligators are kept consistent with State regulations), We
have also been informed that alligator wrestling no longer occurs and that alligators.
and possibly other animals such as iguanas kept on site are only used for educational
purposes,
To date, we only know that several signs have been removed pursuant to Code Enforcement
activities. and it is the opinion of several County employees that all activities are
either permitted by special exception, or grandfathered. We have examined this special
exception document (Resolution No. R-83-1422, Petition 83-99); however. it only
describes the allowed use as a Commercial Citrus Products Sales and Service Enterprise
(see attachment). I am therefore requesting in writing confirmation that all aspects
of this enterprise are conforming or legally nonconforming/grandfathered by Palm Beach
County. or a list of those activities which are not allowed.

WHEREAS, the Board of County Commissioners, as the
governing body, pursuant to the authority vested in Chapter 163
and Chapter 125, Florida statutes, is authorized and empowered
to consider petitions relating to zoning; and
WHEREAS, the notice and hearing requirements as provided

14,1994, I feh that it was important that I address the Commission regarding the
annexation of our property on Lawrence Rd.
As I stated at the meeting, Knollwood Groves is willing to accept the City's
request for annexation. However, we are concerned that the City recognizes us as an
ongoing establishment and is prepared and willing to accept us as such. At the meeting
a member of the City's Planning staffsuggested that the city simply annex the
property, then decide what they were and were not going to accept. This raises
question whether the city is sensitive to our business concerns.
Knollwood Groves is an established business which has been in continuous
operation since 1930. It is a charter member of the Florida Gift Fruit Shippers Assoc
organized in 1946. Knollwood Groves has been known for its quality citrus and juice
products, gifts, tours and attractions throughout the years. Weare proud to be able to
offer the area a view of native Florida and conduct eduational tours for visitors and
school groups.
Weare what is known as the small agricultural enterprise. We grow and retail
our products. In order to operate the business, we must be allowed to grow and care
for our crops. We need to be able to purchase when supply exceeds demand and repair
and maintain our premises so that our business can continue. The fact that Knollwood
Groves has been a known business for so many years and is continuing to grow signifies
