Resolution Please place the above-referenced item on the February 18, 1997 City Commission agenda under Legal - Resolution. DESCRIPTION: John and Tammy Rango, property owners of 1 Kepner Drive requested abandonment of the eastern portion of the cul-de-sac located at the northern terminus of Kepner Drive (also known as S.E. 7th Street) for the purpose of acquiring additional land to add to lot 1 of Kepner Drive to build a house meeting setbacks. For further details pertaining this request, please refer to attached Planning and Zoning Department memorandum number 96-405. The Planning and Development Board, with a 6-0 vote, recommended approval subject to all staff comments in Exhibit "G" - Conditions of Approval (see attached). RECOMMENDATION: The City Commission at their August 20, 1996 meeting unanimously recommended approval subject to the staff comments in Exhibit "G" - Conditions of Approval. Staff recommends this resolution be approved as the staff comments have been addressed. Haag Current Planning Coordinator DATE: August 7, 1996 SUBJECT: Kepner Drive (S.E, 7th Street) ABAN 96-001 - Abandonment NATURE OF REQUEST John and Tammy Rango, property owners of 1 Kepner Drive, are requesting abandonment of a portion of the east side of the cul-de- sac located at the north end of Kepner Drive, a city right-of-way, also known as S.E. 7th Street. The purpose of the request is to acquire additional land to add to lot 1 of Kepner Drive to build a house meeting setbacks, on the vacant lot. The attached Exhibit "A" is a location map that shows the parcel requested to be abandoned and its relationship to the surrounding street system and residences, The attached Exhibit "B" contains a legal description and survey of the proposed abandonment. A change in the abandonment procedure which requires Commission action only on requests for abandonment became effective with the 1995 adoption of the unified land development regulations, Although Planning and Development Board action is not required, in cases where review by the Board will not lengthen the approval process (such as this request), the Commission is desirous of receiving the Board IS recommendation. BACKGROUND City files and the supporting documentation submitted by the agent indicate that in April of 1957 the subject plat of Boynton Isles was recorded which included the dedication to the city of S.E. 7th Street; the subject right-of-way (see exhibit "C" copy of a portion of Boynton Isles plat illustrating the subject cul-de-sac) . Attached exhibit "D" is a copy of a portion of Boynton Isles, Plat No, 2, which is a replat of tract "A" of the Boynton Isles plat that was recorded in March of 1983. The replat of tract "A" created a seven lot subdivision in the R-1AA, Single-family, zoning district. The seven lot subdivision abuts the east side of the subject cul-de-sac. Each lot has access via a 30 foot wide ingress/egress easement which is a private road also referred to as Kepner Drive, as it is an eastern extension of S.E. 7th Street. The easement/private road which terminates as a cul-de-sac at lots six (6) and seven (7) is considered the lot frontage for lots 2-7. The private road abuts the east side of S.E. 7th Street. The area where the private road abuts the city right-of-way is the subject of the abandonment request. Within the private right-of-way there is a 10 foot wide drainage easement and adjacent to the south side of the private road there is a 10 foot wide utility easement. / Page 2 Memorandum No, 96-405 Kepner Drive - ABAN 96-001 ANALYSIS The application indicates that the reason for the abandonment request, is to gain land to build a house on lot one (1) of the private street referred to as Kepner Drive (see Exhibit "E" survey of lot one (1) and conceptual site plan), As previously stated, Kepner Drive (private street) has a cul-de-sac that allows service and fire vehicles the ability to maneuver and turn around which the applicant believes justifies abandoning the east portion of the S,E, 7th Street cul-de-sac, The applicant.s reasons for filing this abandonment and the grounds that support the requests are included in the attached Exhibit "F" - Application. The city departments involved in review of the request for abandonment and the utility companies notified of the request are identified below, Public notice was given to the property owners that abut the right-of-way to be abandoned and the request has been advertised in the newspaper. Although not required by city codes, the seven lot owners on Kepner Drive (private road) have been notified of the abandonment request.
