Federal Highway in Boynton Beach. As you know the conditional use application usually is accompanied by a full site plan review. In the case of Mr. Paoletti however the site had previously received a site plan approval and has been maintained in compliance with that site plan approval for some. time. (See attached) Our question is can Mr. Paoletti submit for conditional use without applying for site plan review? He has no intentions to build a permanent addition to the building or alter' the parking or facade so as to require site plan review. Mr Paoletti does intent to construct an awing on the east side of the structure but this will not be a permanent structure. The use proposed by Mr. Paoletti is the same as the previous use and if the landscaping and parking needs to be upgraded or other minor improvements need to be done we will be happy to undertake them as a condition to the conditional use. Please be advised that it has previously been determined by city legal staff that the 1983 conditional use approval for Bayflite Marine for boat sales at 1406 North Federal Highway has expired. Therefore, a new conditional use application needs to be submitted to the Planning and Zoning Department to reestablish boat sales on the subject property. The conditional use process requires site plan review, however if no improvements are proposed, a detailed survey showing all elements required of a site plan (see attached list), can be submitted. This survey will require review by staff and the Technical Review Committee (TRC) to ascertain whether the existing site improvements meet code and whether the use, in conjunction with the existing conditions on the site, meets the attached twelve (12) standards for evaluating conditional uses, listed in Appendix A- Zoning, Section 11.2.d. of the Boynton Beach Code of ordinance. After their review, the TRC will make a recommendation to the Planning and Development Board and City Commission for approval of the conditional use. I , CITY COUNCIL MEETING BEACH, FLORIDA AUGUST 16, 1983 Mr. Annunziato referred to the initial presentation by a resi- dent of Yachtman's Cove calling attention to the two zoning classifications of this lot. It was felt that if this lot were ever developed for any purposes, it would be an unacceptable intrusion of commercial activity into the residential zone. At the instruction of the City Council, the Planning Department prepared notices for public hearing and recommendations for Planning & Zoning. Doing so, this item was prepared for public hearing with the Planning & Zoning Board sharing proper applica- tion for public review. Mr. Annunziato enumerated the reasons for the recommendation to the Planning & Zoning Board to then recommend to the City Council that the Land Use Element of the Comprehensive Plan be modified to reflect the single family residential category of the western one half of Lot 18 and that the zoning be changed to R-1AA. The Planning & Zoning Board did conduct a public hearing on these issues and recommends to the City Council that the land use element of the Comprehensive Plan be modified as such. As this was a Public Hearing, Mayor Warnke asked if anyone in the audience wished to speak IN FAVOR. There was no response. When asked if anyone wished to speak IN OPPOSITION to the requ- est, no one responded. THE PUBLIC HEARING WAS CLOSED. He explained the location of the property and said at one time the derelict building was a car wash. The proposal is to provide for new boat sales of Bayflite Marine, Inc. The site is being approved consistent with our current requirements for landscaping, drainage and parking. It was reviewed and approved by the Community Appearance Board for landscape and design purposes. Mr. Annunziato explained the access to the site. He referred to the landscaping being provided and noted that this application has, in fact, exceeded our Code requirements in numbers of trees to be provided. Bridges, Architect, 124 N. E. 5th Avenue, Delray Beach, Florida, came forward. He was repreSenting his client and has prepared the plans which are improving the site that is now not very acceptable to the eye. He referred to everything being done in a first class manner including landscaping and bUilding, neYhave eVen kept the old seagrape. Vice Mayor Zimmerman' questioned the Possible widening of North Road which is 20 ft. City Planner AnnunZiato advised that this Was not discuSsed at the T.R.B. meeting but he believed it Was felt that because of the nature of the use which is not high OCCupancy, traffic Was not an issue for this use at this location. Mr. Zimmerman referred to the trailers backing up, etc. in order to get into this location. Mr. Bridges thought they would get in pretty easily now that the gate Was being widened. Mr. deLong questioned the posSibility of widening within the 69 ft. of the property line. Mr. Annunziato advised that the possibility is there and the site can be rearranged but this was the proposal presented by the applicant. It would require that he modify his site. Mr. deLong referred to the right-of_way. Mr. Annunziato did not believe that the applicant would have the ability to dedicate the right-of_way as this is a lease arrangement. Mayor Warnke referred to the landscape plan. Although a copy was not available, Mr. Annunziato believed that it called for one tree every 25 feet and thei~lation of a hedge between the trees on all four sides with the hedge adjacent to the public rights-Of_way being 36" at time of planting. Additionally, Mr. Annunziato believed there was a hedge adjacent to the south property line. Mr. Bridges added details of the additional landscaping being provided. Mayor Warnke complimented the plans presented by the applicant last night at the COmmUnity Appearance Board which protected the people to the east. It has been a detriment to the entire area of U.S. Highway #1 for the past 4 years. He spoke in favor of this proposed development. Councilman deLong moved to approve the request for conditional use by Digby C. Bridges to allow retail, new boat sales on the north 150 feet of Lot A, Harbor Estates subdivision at 1406 N. Federal Highway in a C-4 zone. Vice Mayor Zimmerman seconded the motion. No discussion. Motion carried 4-0. At this time, Councilman de Long moved to revert to the regular order of business. DEVELOPMENT PLANS (Continued) To approve request for modification of the approved site development plans for Gould Plastics submitted by Richard C. Ahrens Mr. Annunziato informed the Council that this is a request to construct a 9,600 sq.ft. addition to an existing warehouse located at 1580 High Ridge Road. Mr. Annunziato further clarified the location and the access to the site. The new facility will be constructed on the eastern one half of the site. One additional truck parking bay will be con- structed consistent with the Zoning Code. Mr. Annunziato further referred to the improvement of the parking lot and the enhanced landscaping consistent with our Codes. This plan went to the Planning & Zoning Board with a positive recommendation from the Technical Review Board subject to staff comments. Mr. Annunziato continued that there were several technical comments. There is one from the Fire Department concerning. fire protection at this location. The problem in this area is that there are no municipal water lines constructed at this time. The applicant met with Fire Inspector Cavanaugh and Chief Rhoden and it was determined that the applicant would either install a fire alarm system or a well to accommodate fire means in this location. As no approximate date of installation has been determined, Mr. Annunziato suggested that if Council determines that this should be approved, that a stipulation be included that no Certificate of Occupancy be granted until such time as the fire system is approved by the Fire Inspector. By moving the zoning line Eastward, Mr. Annunziato thought it would negatively impact on the remainder of the single family lots in Yachtman's Cove. Chairman Ryder recalled that the retail development just to the west that fronts on U. S. 1 put a wall up when that was constructed. Mr. Annunziato believed the wall that was constructed is somewhere in the middle of Lot 18. Mr. Mauti was informed Hovis Westberry owns Lot 18. Mr. Cannon showed the location of the wall. In the event this is approved for residential, Chairman Ryder felt the wall would be needed as a buffer. In this instance, Mr. Annunziato thought the commercial property was developed. It would be up to him whether he wanted a wall. Mr. Linkous commented that he thought they were just trying to correct an error. Chairman Ryder asked if anyone wished to speak in favor proposed rezoning. There was no response. He informed the Members it is an application to utilize the .65 acre parcel of land for boat sales. The site is on the east side of Federal Highway and lies immediately south of the Boynton Canal. The Boynton Canal runs along the north side of North Road. - 3 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 9, 1983 Presently, there is a derelict car wash on the site and some broken up paving. The applicant proposes to fence in the entire property, add to existing-paving, and renovate the building. Parking provided at the location conforms to the current Code. Mr. Cannon advised that the concrete aprons on Federal Highway would be removed and the sidewalk rebuilt. Entrance to the site will be on North Road. There will be a 6 foot high CBS concrete wall built along the east side of the property that will block off the existing asphalt drive. The asphalt drive will be broken up and removed. Mr. Cannon indicated an area that will be filled with gravel and said it will be used for boat storage. He read the staff comments as follows: Engineering Dept.: (Tan Clark) "Drainage calculations should be revised to soow that 2. 70 inches of rainfall in one hour (not I" of runoff) will be contained on site. In other words, all tre water from a I three year I storm must be contained on site." Public Works Dept: "Notify Department before pouring d'l.1ITpster pad." Chairman Ryder noted the existing curb cuts on Federal Highway are to be removed. He asked if that meant there will not be any access from Federal Highway. Mr. Cannon replied that the only access will be through a gate that leads out of North Road. Mr. Annunziato told the Members that the applicant has petitioned to be relieved from the requirement for sidewalks. The Technical Review 8~ard is amenable to this request. because there is not enough right-of-way on North Road or West Road to provide for sidewalks. There is something like 20 feet of right-of-way in each of these streets, and it is practically all occupied by pavement. Chairman Ryder ascertained that the applicant was asking to eliminate all of the sidewalk on North Road and all of the sidewalk on West Road. Mr. Linkous pointed out that it is practically all black topped to the street anyway, so it is a built-in sidewalk. Digby C. Bridges, AIA,ARIBA, NCARB, Digby Bridges & Associates, P.A., Architects and Planners, 124 N. E. 5th Avenue, Delray Beach, Florida 33444 referred to the sidewalk issue and advised that the full width was to be asphalted completely today. Right next to the roadway, they have put in plantings with a hedge to hide the chain link fence. They are putting in a brand new chain link fence. There is a six foot high concrete stucco wall to the east to match the colors of the building. Mr. Bridges was aware of the comments by the Technical Review Board and accepted them. He remarked that they have to do a little bit more drainage design. Mr. Bridges felt that his client was upgrading the site, as it is an eyesore now. He thought it would be much nicer for the people in that neighborhood to have this there. It is a "bit more luxury than a car sales", and the traffic generated around there will be minimal. Chairman Ryder thought eliminating the curb cuts on Federal Highway - 4 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 9, 1983 was a distinct improvement. Robert Constant, 1407 Dale Lane, Delray Beach, represented the owners that bought the fronts to Coquina Cove and Yachtman's Cove several years ago. Mr. Constant has sold real estate in this area for ten years and when he sold their properties, they were very concerned about this location. As Mr. Bridges pointed out, it has been derelict, abandoned, and a nuisance. It has been an eyesore. When Mr. Constant sold the properties across the canal, they were concerned about that site, as it was a detriment, but they developed and bought. Mr. Constant spoke to Harry Kirsner, who owns the vacant section to Coquina Cove, about this proposition. Mr. Kirsner of Miami is in favor of it. Mr. Tony Velardo, in New York City on business,was also very much in favor of the property being turned around. As no one else wished to speak in favor of this request for rezoning, Chairman Ryder asked if anyone wished to speak in opposition. Mr. Salvatore Trantolo, 815 South Road, a Member of the Board of the North and South Road Homeowners Association, was speaking for them and said they do not object to the boat sales being located there. They are in favor of it except for ,a few things that border North Road. Mr. Trantolo said they object to the entrance being on North Road. They feel the entrance should be on Federal like every- one else because this is a business, and they are residential. With reference to the chain link fence, Mr. Trantolo said it would have to be enhanced by nice shrubbery. They were concerned about what kind of hedges would be put there. Mr. Trantolo further informed the Members that they want the wall to conform with the same wall that is in back of the car wash. Mr. Annunziato explained that this wall is to be constructed consistent with current requirements, beautified on both sides, stuccoed, painted, and landscaped. The wall to the south is concrete slab. Mr. Cannon indicated the location of another car wash and a wall which extends along the eastern property line. Elizabeth Hermanson, 622 South Road, lives in back of the new car wash. She has lived there for 12 years and wanted to be sure what they put there will enhance the area. She felt North Road was very narrow for an entrance and could not see why it cannot be along Federal Highway. Mrs. Hermanson was here to protect their interests. She said it is commercial, and the entrance would be going into waterfront property. They are very concerned about it. Mrs. Hermanson added that she went along with the fact that it is a bless- ing they are coming in. Chairman Ryder recognized the presence of Councilman Samuel Lamar Wright in the audience. - 5 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 9, 1983 Mr. Wandelt was advised that South Road comes behind the property. There is a road to the north of the property and to the east of this property. Mr. Fred A. Lenz, 620 North Road, Boyntqn Beach, lives on the property directly east of the project. He did not care what kind of walls there were as long as there was a wall. Mr. Lenz objected to the entrance being on North Road. He agreed with Mrs. Hermanson that there could be traffic congestion in the front, causing accidents, and that would cause a problem. Mr. Trantolo inquired how much footage there is on North Road between that fence and North Road ,because the canal is on the other side of the road. Mr. Annunziato answered that the public width of North Road (dedicated right-of-way) is 20 feet. The capal right- of-waYJis beyond the road. Mr. Annunziato said there is probably 40 feet of earth between to the canal. Concerning the entrance on North Road, the site is designed consistent with our Codes, Mr. Annunziato told the Members. At an intersection with Federal Highway, you have to have 180 feet minimum between a curb cut and an intersection of right-of-way. The applicant does not have 180 feet and, therefore, would be precluded from having his curb cuts on Federal Highway. Secondly, access to applicant of that. that this do that. access on under any circumstances, Mr. Annunziato did not think North Road could be denied. It is a corner property. Mr. Annunziato did not think they could If he had no access on North Road, he would have to have the Federal Highway. Mr. Mauti suggested that perhaps the entrance could be widened. Mr. Bridges told the Members that they are not large boats and they can be manuevered easily with 25 feet. These are travel boats to go behind cars, up driveways, in garages, etc. Mr. Mauti would much rather see the entrance on North Road providing they could make the entranceway 30 feet. Chairman Ryder referred to the wall. Mr. Annunziato explained that the wall to the south does not meet current Code requirements. Current Code requirements call for a solid, decorative, masonry wall to set back somewhat from the property line. They defined decorative by stucco and painted. Mr. Annunziato thought this wall would be much more attractive. The maintenance redevelopment has to meet current Codes for land- scaping and other things adjacent to all of the publicly dedicated right-of-ways. Mr. Annunziato said this has access on three sides. The applicant will have a 36 inch hedge with one tree about every 40 feet. On the south side, the hedge will be 18 inches with a tree every 40 feet. Mr. Annunziato added that there will be interior landscaping adjacent to the parking lot. - 6 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 9, 1983 As no one else wished to speak in opposition, THE PUBLIC HEARING WAS CLOSED. Congress Avenue, south of First American Bank Boynton Beach Mall Parcel #3, being a tract of land located in Sec. 19, Twp. 45 South, Rge. 43 East, County of Palm Beach, Florida Construction of a shopping center on a 6.45+ acre site Chairman Ryder commented that this location is directly on the west side of Congress Avenue and immediately south of the present small bank building that is there below the canal. The DeBartolo Mall is several hundred feet west of Congress Avenue. This involves frontage on the west side of Congress Avenue. Mr. Cannon, Assistant City Planner, said the site plan came with a positive recommendation from the Technical Review Board, subject to staff comments. The proposal is to construct a 76,940 square foot shopping center W0ic~ would be located on a 6.45 acre site abutting the Boynton Beach Mall. Mr. Cannon showed the location on the overlay and said immediately to the west is a retention pond for the Mall and this parcel. Mr. Cannon showed the entrance roads, ,secondary roads, and the parking both in back and in front of the shopping center. A 5,000 square foot will be in the northeastern part of the parcel. Mr. Cannon indicated the three sections of the main building which will be used for retail, restaurants, offices, and a health club. Water will come from a 16 foot water main on Congress Avenue and loop around to the rear. The sewer would also loop around to the rear and connect to a ten inch sewer main.
