III. SITE PLAN REQUIREMENTS
The following materials are to be submitted in seven (7) copies.
Each set of plans must be stapled together in a single package to
submit 7 sets or packages of plans. Scale of drawings must be
200 ft. to the inch. For requests which require review by the
planning and Zoning Board, nine (9) sets or partial sets,
comprised of only a site plan, landscape plan, typical floor
plans and building elevations are required in addition to the
seven (7) full sets mentioned above. For requests which do not
require review by the planning and Zoning Board, three (3)
partial sets are required in addition to the seven (7) full sets.

A sealed survey, by a surveyor registered in the State
of Florida, and not older than six (6) months, showing
property lines, including bearings and dimensions;
north arrow, date, scale, existing structures and
paving, existing elevations on site, rights-of-way and
easements on or adjacent to the site, utilities on or
adjacent to the site, legal description, acreage to the
nearest one-hundredth (1/100) of an acre, location
sketch, and surveyor's certification. Also, sizes and
locations of existing trees and shrubs, including
common and botanical names, and indication as to which
are to be retained, removed, relocated, or replaced.
Location of existing utility lines on or adjacent
to the property to be indicated on the site plan, in
addition to being shown on the survey. Also, location
of existing fire hydrants on or adjacent to the site.
Location of additional fire hydrants, to meet standards
set forth in Article X, Section 16 of the Subdivision
and Platting Regulations.
Fire flow calculations justifying line size for both
on/off site water lines.
Sealed engineering drawings for proposed utilities, as
per City specifications.
Information regarding form of ownership (condominium,
fee simple, lease, etc.).
Location and orientation of garbage cans or dumpster
facilities. All garbage dumpsters must be so located
to provide direct access for the City front-end
loaders, and the dumpster area must be provided with
adequate width and height clearance. The site must be
so designed to eliminate the necessity for the
front-end loader to back into any street. If any use
requires the disposal of wet garbage, a ten foot by ten
foot (10' x 10') concrete slab shall be provided. All
dumpsters must be screened and landscaped in accordance
with the City Landscape Code (see Sec. 7.5-35(i)). A
minimum 10 foot wide opening is required for dumpster
enclosures.
A parking lot design and construction plan showing
conformance to the City Parking Lot Regulations, and
including the following information. Any exceptions to
the Parking Lot Regulations that are proposed or that
are to continue will require an application for
variance to the Parking Lot Regulations.

For projects that generate more than five hundred (500)
net trips per day, a traffic impact analysis must be
submittd which complies with the Municipal
Implementation Ordinance of the Palm Beach County
Traffic Performance standards Ordinance.
a. For projects that generate two thousand (2,000) 0]
more net trips per day, the traffic impact
analysis must be submitted to the city at least 6l
days prior to the deadline for site plan approval
in order to allow for timely processing of the
site plan application and review by the City's
traffic consultant and Palm Beach County. The
applicant shall be billed for the cost of review
by the city'S traffic consultant.
b. For projects that generate between five hundred
(500) and two thousand (2,000) net trips per day,
the traffic impact analysis must be submitted at
least 30 days prior to the deadline for site plar
approval, in order to allow for timely processin~
of the site plan application and review by Palm
Beach County. However, if it is the desire of tl
applicant to utilize the City'S traffic consultal
for review of the traffic impact analysis prior
review by Palm Beach County, then the procedure
and requirements outlined under item "a" above
shall be followed.
NOTE: Failure to submit traffic impact analysis in the manner
described above may delay approval of the site plan application.

In addition to the above requirements, the
following items shall be submitted to the planning
Department no later than the site plan deadline:
a. One copy of colored elevations for all buildings
and signage to be constructed on site. These
elevations must be of all sides of each type of
building and signage proposed and the colors
proposed must be accompanied by a numerical code
from an established chart of colors. Elevations
must also include information related to building
materials. All elevations must be submitted on
24" x 36" drawings. Buildings constructed will be
inspected on the basis of the elevations submitted
to the city and approved by the city commission.
Failure to construct buildings consistent with
elevations submitted will result in the
certificate of Occupancy being withheld.
b. A transparency of the site plan (maximum size of
8-1/2" x 11"). At the discretion of the
applicant, the planning Department will prepare
transparencies from the site plan document.
However, the planning Department will not be
responsible for poor quality transparencies which
result from the submission of poor quality site
plan blueprints, and poor quality transparencies
will not be presented to the planning and Zoning
Board or city commission.
c. Colored photographs of surrounding buildings

Dear Chris,
I am in receipt of your August 15, 1994 letter regarding the above
referenced use and property. Please be advised that it has previously
been determined by city legal staff that the 1983 conditional use
approval for Bayflite Marine for boat sales at 1406 North Federal
Highway has expired. Therefore, a new conditional use application needs
to be submitted to the planning and Zoning Department to reestablish
boat sales on the subject property.
The conditional use process requires site plan review, however if no
improvements are proposed, a detailed survey showing all elements
required of a site plan (see attached list), can be submitted. This
survey will require review by staff and the Technical Review Committee
(TRC) to ascertain whether the existing site improvements meet code and
whether the use, in conjunction with the existing conditions on the
site, meets the attached twelve (12) standards for evaluating
conditional uses, listed in Appendix A- Zoning, Section 11.2.d. of the
Boynton Beach Code of ordinance. After their review, the TRC will ma}t;.e
a recommendation to the planning and Development Board and city
Commission for approval of the conditional use.

It is further AGREED AS FOLLOWS:
1. Each party represents and warrants to the other that neither
they nor any of their agents have directly or indirectly dealt
with, been shown or otherwise consulted any broker or agent thereof
in connection with this transaction. Each party hereto shall save
and hold the other harmless against any claim or loss (including
reasonable attorney's fees incurred at trial or appellate levels)
which may be asserted against the other by reason of any claims or
determinations in contravention with representations and warranties
contained in paragraph.
2. Radon is a naturally occurring radioactive gas that, when it
has accumulated in a building in sufficient quantities, may present
health risks to persons who are exposed to it over time. Levels of
radon that exceed federal and state guidelines have been found in
buildings in Florida. Additional information regarding radon and
radon testing may be obtained from your county health unit.
Pursuant to section 404.056(8), Florida Statutes.
3. Seller agrees to repair roof leaks at least ten (10) days prior
to closing and Seller agrees to install two new air-conditioner
units where two old units were previously located at the premises
and have the same installed and working properly and any
surrounding areas damaged where previous air-conditioner units were
located shall be repaired also. Seller agrees to repair indoor
roof tiles due to water damage and remove the three existing
barrels from south side of property (to off the premises) and clean
up any spillage in the vicinity of said barrels that may exist.
4. Seller's Environmental Representations and Warranties:
(a) Seller expressly acknowledges and agrees that it will pay
for all contamination, assessment, remediation, and clean-up costs,
as well as reimburse, defend, indemnify and hold harmless Buyer,
its officers, shareholders, and employees from and against any and
all liabilities, claims, damages, penalties, expenditures, losses
or charges (including, but not limited to, all costs of
investigation, monitoring, legal fees, remedial respo.~se--;'-Yemov..a.1)-,
restoration or permit acquisition), which may now or ~ the futur~/
be undertaken, suffered, paid, awarded, assessed, '-or.--other\o1ise
incurred as a result of:
(i) any soil or ground water contamination existing on,
above or under the Property at the time of Closing. It is
expressly understood that Seller's duty to pay, reimburse, defend,
indemnify, and hold harmless includes the petroleum contamination
described in the April 20, 1994 contamination Assessment Report
("CAR") prepared by Tower Engineering.
(ii) any investigation, monitoring, cleanup, removal,
restoration, remedial response or remedial work undertaken on the
Property subsequent to the sale to Buyer.
(b) The foregoing indemnity shall survive the Closing and
shall be for the benefit of Buyer and shall be assignable by Buyer
to any subsequent purchaser of the property or any part thereof.
(c) Seller acknowledges and agrees that its transfer of the
property to Buyer shall not and does not relieve or release Seller
of any legal liability and responsibility Seller would otherwise
have as the owner of the Property whether by way of damages,
penalties, remedial actions or otherwise for any adverse effects or
consequences resulting at any time from any contamination existing
on, above or under the property at-the time of Closing.
(d) Ten Thousand ($10,000.00) Dollars of net sales proceeds
shall be placed in Seller's attorney's trust account at closing and
shall be held in escrow for the purpose of paying the contamination
assessment, monitoring and cleanup costs, described in paragraph
4(a), supra, for which Seller is responsible and which Buyer may
incur subsequent to closing, including, but not limited to, costs
for preparing the CAR and for soil and ground water monitoring and
air stripper, if needed.
(i) Remaining escrowed funds shall be returned to seller
upon Buyers receipt of written confirmation from appropriate
government agencies that no further remedial action, monitoring, or
assessment of the property is needed.
(ii) Interest accrued shall be credited to Seller.
(e) seller represents it holds all reimbursement rights under

being true and correct. Buyer is aware all marine work must be
done under cover and therefore upon construction to enclose
facility, the property can be used as above represented.
Notwithstanding the above and notwithstanding anything herein in
this contract to the contrary, in the event Buyer is required to do
construction work greater than enclosing the existing structure
currently located on the premises in order to do the contemplated
work hereunder, the Buyer at Buyer'S option shall be entitled to
terminate this contract and shall be entitled to an immediate
refund of its deposit.

A sealed survey, by a surveyor registered in the state
of Florida, and not older than six (6) months, showing

easements on or adjacent to the site, utilities on or
adjacent to the site, legal description, acreage to the
nearest one-hundredth (1/100) of an acre, location

front-end loader to back into any street. If any use
requires the disposal of wet garbage, a ten foot by ten
foot (10' x 10') concrete slab shall be provided. All
dumpsters must be screened and landscaped in accordance
with the City Landscape Code (see Sec. 7.5-35(i)). A
minimum 10 foot wide opening is required for dumpster

In addition to the above requirements, the
following items shall be submitted to the Planning
Department no later than the site plan deadline:
a. One copy of colored elevations for all buildings
and signage to be constructed on site. These
elevations must be of all sides of each type of
building and signage proposed and the colors
proposed must be accompanied by a numerical code
from an established chart of colors. Elevations
must also include information related to building
materials. All elevations must be submitted on
24" x 36" drawings. Buildings constructed will be
inspected on the basis of the elevations submitted
to the City and approved by the City Commission.
Failure to construct buildings consistent with
elevations submitted will result in the
Certificate of Occupancy being withheld.
b. A transparency of the site plan (maximum size of
8-1/2" x 11"). At the discretion of the
applicant, the Planning Department will prepare

result from the submission of poor quality site
plan blueprints, and poor quality transparencies
will not be presented to the Planning and Zoning

be required by the Technical Review Board to determine

Dear Chris,
I am in receipt of your August 15, 1994 letter regarding the above
referenced use and property. Please be advised that it has previously
been determined by city legal staff that the 1983 conditional use
approval for Bayfli te Marine for boat sales at 1406 North Federal
Highway has expired. Therefore, a new conditional use application needs
to be submitted to the Planning and Zoning Department to reestablish
boat sales on the subject property.
The conditional use process requires site plan review, however if no
improvements are proposed, a detailed survey showing all elements
required of a site plan (see attached list), can be submitted. This
survey will require review by staff and the Technical Review Committee
(TRC) to ascertain whether the existing site improvements meet code and
whether the use, in conjunction with the existing conditions on the
site, meets the attached twelve (12) standards for evaluating
conditional uses, listed in Appendix A- zoning, section 11.2.d. of the
Boynton Beach Code of ordinance. After their review, the TRC will make
a recommendation to the Planning and Development Board and City
Commission for approval of the conditional use.

It is further AGREED AS FOLLOWS:
1. Each party represents and warrants to the other that neither
they nor any of their agents have directly or indirectly dealt
with, been shown or otherwise consulted any broker or agent thereof
in connection with this transaction. Each party hereto shall save
and hold the other harmless against any claim or loss (including
reasonable attorney's fees incurred at trial or appellate levels)
which may be asserted against the other by reason of any claims or
determinations in contravention with representations and warranties
contained in paragraph.
2. Radon is a naturally occurring radioactive gas that, when it
has accumulated in a building in sufficient quantities, may present
health risks to persons who are exposed to it over time. Levels of
radon that exceed federal and state guidelines have been found in
buildings in Florida. Additional information regarding radon and
radon testing may be obtained from your county health unit.
Pursuant to section 404.056(8), Florida Statutes.
3. Seller agrees to repair roof leaks at least ten (10) days prior
to closing and Seller agrees to install two new air-conditioner
units where two old units were previously located at the premises
and have the same installed and working properly and any
surrounding areas damaged where previous air-conditioner units were
located shall be repaired also. Seller agrees to repair indoor
roof tiles due to water damage and remove the three existing
barrels from south side of property (to off the premises) and clean
up any spillage in the vicinity of said barrels that may exist.
4. Seller's Environmental Representations and Warranties:
(a) Seller expressly acknowledges and agrees that it will pay
for all contamination, assessment, remediation, and clean-up costs,
as well as reimburse, defend, indemnify and hold harmless Buyer,
its officers, shareholders, and employees from and against any and
all liabilities, claims, damages, penalties, expenditures, losses
or charges (including, but not limited to, all costs of
investigation, monitoring, legal fees, remedial respo,nse~"-Yemc)"val",
restoration or permit acquisition), which may now or ~ the future,':
be undertaken, suffered, paid, awarded, assessed,' -or.--otherwise
incurred as a result of:
(i) any soil or ground water contamination existing on,
above or under the property at the time of Closing. It is
expressly understood that Seller's duty to pay, reimburse, defend,
indemnify, and hold harmless includes the petroleum contamination
described in the April 20, 1994 contamination Assessment Report
("CAR") prepared by Tower Engineering.
(ii) any investigation, monitoring, cleanup, removal,
restoration, remedial response or remedial work undertaken on the
Property subsequent to the sale to Buyer.
(b) The foregoing indemnity shall survive the Closing and
shall be for the benefit of Buyer and shall be assignable by Buyer
to any subsequent purchaser of the property or any part thereof.
(c) Seller acknowledges and agrees that its transfer of the
property to Buyer shall not and does not relieve or release Seller
of any legal liability and responsibility Seller would otherwise
have as the owner of the Property whether by way of damages,
penalties, remedial actions or otherwise for any adverse effects or
consequences resulting at any time from any contamination existing
on, above or under the Property at-the time of Closing.
(d) Ten Thousand ($10,000.00) Dollars of net sales proceeds
shall be placed in Seller's attorney's trust account at closing and
shall be held in escrow for the purpose of paying the contamination
assessment, monitoring and cleanup costs, described in paragraph
4(a), supra, for which Seller is responsible and which Buyer may
incur subsequent to closing, including, but not limited to, costs
for preparing the CAR and for soil and ground water monitoring and
air stripper, if needed.
(i) Remaining escrowed funds shall be returned to Seller
upon Buyers receipt of written confirmation from appropriate
government agencies that no further remedial action, monitoring, or
assessment of the property is needed.
(ii) Interest accrued shall be credited to Seller.
(e) Seller represents it holds all reimbursement rights under
...) A.: T. R. P. for the property and hereby assigns those rights to Buyer.
()~'~~j; (f) The funds shall be held in escrow until both Parties
J ,agree and no further remedial action and monitoring of the site is
required as determined by a third party chosen by the Buyer and

5. Seller represents the property being sold hereunder is
currently zoned C-4 and the Buyer shall be entitled to use the
property as marine repair and sales and related services
(boat/yacht brokerage, sales, and repair services and storage).
This Contract is subject to and contingent upon such representation
being true and correct. Buyer is aware all marine work must be
done under cover and therefore upon construction to enclose
facility, the property can be used as above represented.
Notwithstanding the above and notwithstanding anything herein in
this Contract to the contrary, in the event Buyer is required to do
construction work greater than enclosing the existing structure
currently located on the premises in order to do the contemplated
work hereunder, the Buyer at Buyer'S option shall be entitled to
terminate this Contract and shall be entitled to an immediate
refund of its deposit.
C7 6. Seller's title agent shall provide Lender with mortgagee title
o~ insurance for a cost not to exceed $250.00 together with normal
minimum charges for endorsements if required by Lender.
7. Seller represents that the property consists of not less than
29,100 square feet as Seller represents the property is 150 ft. by
194 ft.
8. Seller represents he has no knowledge of any pending or
anticipated condemnation proceedings or road widening which would
affect the within premises nor any governmental action which may
affect Buyer'S use of the said premises being purchased.
9. This Contract is subject to and conditioned upon Buyer being
able to obtain all appropriate occupational licenses from
applicable governments and municipalities and related agencies
prior to closing and Buyers shall use best efforts to obtain same.
Buyer agrees to use Kutro Associates to help obtain necessary
licenses from the city of Boynton Beach.
10. All representations and warranties set forth herein shall
survive closing.
This Addendum, upon its execution by both parties, is herewith made
an integral part of the aforementioned Contract.
