Dear Ms. Hayden:
I am the record owner as Trustee of the above referenced property. I am seeking
direction from you on the course of action that we should take.
My fJrevious partner, David Bumgardner and I owned the property since early 1980,
We purchased this for investment purposes, and to have it continue to operate as
a used car lot. At the time of acquisition, the property was leased and operated by
an operator for the next five (5) years. The operator (Wellington Auto) sold the
business to another individual, who proceeded to allow the occupational license to
lapse and did not pay the rent. We were forced to evict him and when we went to
operate as a car lot we were denied an occupational license by the City. We
subsequently sold the property to Mr. Williams who made a good faith effort to
comply with all of the City's regulation and to receive a special exception. Again, it
is my understanding that the City Commission voted against him. When Mr.
Williams failed in his endeavor to receive a special exception he spent over $30,000
in professional fees and carrying cost, which forced him to file personal bankruptcy.
He subsequently deeded the property back to me as Trustee. However, the City did
vote to deed a portion of the rear property to the owner of the property, conditioned
upon the owner tearing down or removing the metal overhang on the rear of the
building. If this is the case, we wit! make an immediate effort to tear down this
overhangr if the City will deed this back property to us.
We i1ave been trying to lease or sell this property since reacquiring it from Mr.
Williams over four years ago. Due to the surrounding area and remaining building
we are unsure as to what will be an appropriate use for this location. We think the
property would work best as a used car lo( or automotive detail and repair facility.
I respectfully request that you provided me WIth your thoughts as to the feasibility of
obtaining the special exception for this property. We would like to handle this
ourselves without bringing in a high priced professional. I anXIously await your reply.

Please be advised that on Tuesday, August 20, 1991, the City
Commission approved the above-referenced request for abandonment
of a 20 foot wide alley at 1009 N. Federal Highway, subject to
the following conditions, copy of which is attached:
The applicant dedicating a 20 foot easement over the width
of the alley for the purpose of maintaining the existing
City sewer main and Southern Bell facilities, the applicant
providing the City with a hold harmless agreement for the
improvements proposed by the applicant in the future
easement and the applicant demolishing that portion of the
existing building that was constructed as an addition.
The resolution will not be placed on the City Commission agenda
for final approval until the conditions have been satisfied.

alley no longer serves any useful purpose.

OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:

The City of Boynton Beach, Florida, by

CONDITIONAL USE REVIEW

In accordance with the City of Boynton Beach, Florida, Code of Ordinances,
specifically Chapter 19, Section 19-17, "Plan Requiredll, including Chapter 5,
Article X, "Boynton Beach Parking Lot Regulations", Section 5-142 inclusive,
the applicant for the above referenced project shall submit the following plan
revisions, information and technical data.
1. The applicant shall provide a photometric plan depicting the level of
illumination within the parking facility. Lighting systems shall be photo-
cell activated and plan submissions shall comply with the requirements as
set forth in Section 5-l42(a), "Required Lighting", including Section 5-l42(g),
"Lighting Standards".
2. Provide handicap stall striping details which conform to the requirements set
forth in the Department of Community Affairs Accessibility Requirements Manual
(lastest edition). Section 5-l42(k), "Handicap Requirements".
3. Provide raised continuous concrete curbing where parking stalls abut landscaped
areas in accordance with Section 5-l42(e), "Required Curbing". Curbing shall
be interrupted to facilitate stormwater drainage into grassed areas.
4. Clearly depict upon the submitted plans, the proposed vehicle display area.
The display area shall not block the ingress/egress aisle nor encroach upon
the 27 feet free backup area for the designated standard and handicap stalls
as specified within Section 5-142 appendix.
5. Federal Highway shall be posted with standard Department of Transportation
approved (No Parking) signage in accordance with the State of Florida,
Department of Transportation's "Roadway and Traffic Design Standardsll,
Index tJl7358.
6. The specified lighting system contains luminaires with the equivelent of
1,000 watts and in order to abate glare, the lighting system should be modified
in order to limit glare. Standards and luminaires types shall be modified to
utilize energy efficient fixtures with an approximate wattage of 400 watts.
Additionally, light poles should be located outside of the subject easement
area. Factors to be considered by committee in review.
7. The Engineering Department recommends that the applicant provide proof of a
Building Permit for the addition that is encroaching upon a public dedicated
rights-of-way. As the structure is constructed over a force main the Engineering
Department recommends demolition of the addition if proof of permits cannot be
provided to the City.
8. The pavement area, as depicted upon subject plans, encroaches upon a public
dedicated rights-of-way and a letter of indemification shall be provided to
the City of Boynton Beach to ensure that utility repairs, construction or
reconstruction, within the alley which may cause damage to the parking lot, will
result in the parking lot being repaired at the owners expense.
9. The drainage plans addresses water quality (2.5 inches) but has no positive
outfall, therefore a 3 year - 24 hour analysis is required.

Dear Mr. Finizio:
Please be advised that Southern Bell has no objection to the
requested abandonment under the following condition:
The property owner will provide a properly recorded utility
easement suitable to Southern Bell for the maintenance of
the existing Southern Bell poles and aerial cables/terminals
serving this location and the customer at 1017 N. Federal
Highway. Southern Bell facilities presently exist within
this area under Florida Statutes addressing utilities
construction within public rights-of-way. Southern Bell has
no objection to the subsequent encroachment of the existing
structure within this easement.

Please be advised that Florida Public Utilities Company has no obejction to the
abandonment of the existing 20 I easement described in your July 17, 1991
letter.
At the present time, we have no underground gas distribution facilities located
within the limits of the proposed abandonment.
