please review the City's records to see if there is a condition
imposed on the Knollwood Groves P.U.D. that requires the
developer to pay for the construction of Miner Road between
Sandalwood Blvd. and Citrus Glen. It is my understanding that the
City, during the approval process for Knollwood Groves, required
the developer to pay for this link of Miner Road out of traffic
impact fees.
Could you respond and indicate how this developer commitment is
going to be implemented and what is the time element.
On a second issue concerning Knollwood Groves, I would like you
to respond to the following. It is my understanding that the
City, in approving the Knollwood P.U.D., requested the developer
to commi t funds from hi s traff ic impact obI igat ion for the six
laneing of Hypol uxo Road between Congress Avenue and Lawrence
Road. The City adopted Resolution 89-NNN on November 7, 1989,
(see enclosed) requesting the County Commission to place the
construction of the segment of road on the five year plan. The
Traffic Department of the County Engineers office indicated that
this section of Hypoluxo Road is not on the five year plan.
My questions is, how is the traffic situation going to be
overcome if this road does not have time certain to be
constructed and have the conditions of approval been violated
because the road improvement is not on the five year plan.

KNOLL WOOD GROVES PUD - RESPONSE TO TRB COMMENTS

Dear Jim,
Thank you for your recent comments letter, and for the assistance
given us by the members of the Technical Review Board in its
review of the Knollwood Groves PUD application. The purpose of
this letter is to summarize our response to the issues and
comments of the TRB, identified as follows:
1) As requested by the TRB, we have extended the access road
from Hypoluxo Road south to Meadows Boulevard. We have expanded
the right-of-way for this road to the collector standard of 813'.
Both this connector road and Meadows Boulevard will be dedicated
as public roads, as intended by the comprehensive Plan and the
subdivision code.
2) The revised plan removes the residential lots from the east
property line of the project, eliminating any concern over
setbacks in this area.
3) A IS' setback requirement along the south property line of
the day care center site will not represent a problem, and will
be accommodated when a detailed site plan is prepared for that
facility.
4) A 25' setback from the abutting County AR (Agricultural
Residential) zoned property at the northwest corner of our
project will be more than accommodated for both the single family
and multi-family portion. We have designed a 25' landscaped
buffer into the perimeter of the project.
5) We agree that a bike path will be provided on one side of the
collector roads (813' r/o/w) and a sidewalk on the other side.
Further, sidewalks will be provided within the interior of the
housing tracts.

6) As requested, we have indicated the required r/o/w dedication
for both Hypoluxo Road and Lawrence Road.
7) As requested I we will work with the City Forrester in the
preparation of a management plan for the preservation of
appropriate citrus trees. It is our intent to preserve and/or
transplant viable trees into the designated open space parcels in
the single family area, and to prepserve viable trees, where
possible, in the multi-family area. Further, some trees will be
left on the single family lots, where site planning and grading
considerations allow. We will also, if desired, retain the
citrus trees in the park area. However, it must be understood
that the majority of the citrus trees are beyond their prime and
may not be preservation worthy.
8) We have reviewed the "Summary of Land Development policies"
document that you have provided to us. We will be able to comply
with all of the provisions of this summary, with the exception of
strict compliance with the provisions of the County Traffic
Performance Standard. As we have previously discussed with
Carmen Annunziato, no significant project in this area could
feasibly comply fully with the County standard. We have agreed
to construct substantial roadway improvements, which will result
in the betterment of the system in the area, far beyond the
impact that we will create. In this regard, we feel that we
comply with the general spirit of the County standard. The
roadway improvements that can be accomplished by this development
are as follows:
- Extension of Meadows Boulevard from Club Meadows to Lawrence
Road;
- Construction of connector road from Meadows Boulevard to
Hypoluxo Road;
- Construction of 2 additional lanes on Hypoluxo Road from
Lawrence Road to Congress Avenue, provided that sufficient
right of way exists or is acquired by the County or the City.
In addition, we will construct turn lanes at our project
entrances on both Hypoluxo Road and Lawrence Road.
9) We have eliminated the planting islands in the cul de sacs
and eyebrows, so no irrigation of these areas will be necessary.
10) The revised plan reduces the number of cul de sacs and
generally improves traffic flow. We have added a 20' emergency
access tract from Meadows Boulevard. This access will be marked
and constructed with a stabilized base and/or pavers, to the
satisfaction of the Fire Department.

11) Cul de sacs will have a minimum of 20' of pavement I as noted
by the Public Works Department, and will have a minimum 45'
turning radii. Fire hydrants will be provided consistent with
Code requirements.
12) A plan showing the setbacks and buildable areas for the
single family lots has been provided for your review.
13) Security gates will be designed and installed in accordance
with the performance standards outlined by the Fire Department in
its memo of July 26th, and a "hold harmless" agreement will be
executed when appropriate.
14) Preliminary engineering drawings have been modified to
accommodate comments submitted by John Guidry, Director of
utilities.
Accompanying this letter is six copies of the revised master plan
reflecting TRB comments where appropriate, six copies of a
preliminary site plan for your review, and six copies of revised
engineering drawings. We hope that we have adequately
accommodated all of the recommendations of the various City
agencies. We look forward to meeting with the TRB at your
meeting scheduled for August 17th. If you have any further

It is my suggestion that an interlocal agreement be entered into between Palm Beach County and
the City of Boynton Beach which would contain the following points:
o The City of Boynton Beach would hire and pay for a consulting engineer to -complete
construction plans for this roadway to County specifications and provide these plans to
Palm Beach County in a bid ready format. The consultant for this work, along with the
fee, would be approved by Palm Beach County.
o The City of Boynton Beach has approximately $297,840 available from developers to
accomplish this construction. The costs for the plans would be subtracted from this

be an acceptable proposal that would result in Miner Road being constructed.
As noted in Mr. Walker's letter, he has requested Ellie Halperin, Assistant County
Attorney, to prepare a draft of this interlocal agreement between the two governmental
entities. You of course will be consulted regarding the content of said document.
It is felt by this office that this proposal is certainly one that has merit, and hopefully it
will be accepted and approved by both the City and the County. Should you have any

Thank you for taking the time to meet with me and James Ballerano Friday
regarding the Knollwood Groves PUD.
To summarize as briefly as possible the most recent history of this project, we
submitted an application in September. 1992 to amend the conditions of the PUD's
approval. That application was submitted pursuant to the several conversations
we had with City staff regarding the payment of funds for the completion of Minor
Road, a specific condition of the Knollwood PUD approval. The resolution of the
issues regarding the funding of the Minor Road construction has been complicated
by the need to complete agreements between several other property owners, in
addition to the agreement with my clients.
On January 1 8, 1994, the City Commission approved first reading of an ordinance
to amend the conditions of the PUD's development order. We had anticipated
second reading of this ordinance on February 1, 1994. The ordinance's second
reading was to have been done concurrent with the approval of an agreement
wherein the owners of the Knollwood PUD agreed to contribute funds for the
construction of the missing link Minor Road, and to dedicate a five acre park site
within the PUD. As you are now aware from our discussion, we learned only on
February 11 of the decision of one of the property owners to withhold signature on
the deed for the largest portion, 4.2 acres, of the park site.

Mr. Ballerano and I represent Meadowood Groves, the owners of 86.6 acres of
the 111 acre Knollwood PUD. Our clients will present to the City a deed, when
and if requested by the City, for the .8 acres of the park site which is within the
part of the PUD which they own. Our Clients will also pay the amount previously
agreed to for the Minor Road construction ($108, 550.00). The agreement sent to
you Friday by Mr. Bal!erano incorporated tile changes regarding the park site
dedication that we discussed.
We understand that the Comprehensive Plan designation for the park site, located
in the southeast corner of the PUD, remains unchanged.
It is our desire to present the agreement we discussed to the City Commission on
Tuesday, February 15, 1994, and we will request approval of the agreement at
that time.
We are by this letter requesting withdrawal of the ordinance to amend the PUD
conditions of approval. We expect to submit within a very short period of time
(three to four months) an application to amend the PUD. This application will
include a proposal to meet our parks and recreation requirement, with land
dedication or cash in lieu thereof.

Phasing for the project will ultimately depend on market demand.
However, it is anticipated that the multi-family units, whether
for rental apartments or for condominiums, will be built
immediately after all necessary construction approvals are
obtained, and that all multi-family units will be constructed at
the same time. It is expected that the land development for the
single family units will require approximately two years, and
absorption of all units will occur over a period of about three
years.

Enclosed you will find a copy of the traffic impact analysis,
master plan, and conceptual site plan for the above-referenced
rezoning to a Planned Unit Development. The property is located
near the southeast corner of Hypoluxo Road and Lawrence Road.
Abutting this PUD on the east side is the Meadows 300 Planned
Unit Development.
Please review the developer's traffic impact analysis for
consistency with County ordinances and provide our office with
your written comments by August 1, 1989 for incorporation in the
public hearing proceedings.

Dear Mr. Simmons:
SUBJECT: Knollwood Groves P.U.D.
Enclosed is a sketch indicating the location of existing water and
force mains in the area of the referenced P.U.D. As you can see,
we have an existing 16" water main along the east side of Lawrence
Road. with an 8" force main (reducing to a 61') along the west side.
There is also an 8" water main stub. and a 6" force main stub with-
in a connecting right-of-way to the Meadows P.U.D.
Your proposed development must obtain water service from the 16"
main and the 8" main (to the Meadows). In addition. it will be
necessary to extend a 12" water main from the intersection of Hypo-
luxo Road and Lawrence Road, eastward to your eastern property line
with a connection point into the project.
Sewer service shall be provided via connection to the 8" force main
in Lawrence Road. Of course, a new lift station and force main
will be required, and both should be large enough and the station
deep enough, to accommodate the parcel to the northwest of your
site.
Allowable credits for oversizing of the sewer facilities will have
to be negotiated once the sizing is determined. Credits for over-
sizing the water main shall be calculated as stipulated in the City
Code.
