Heyden, AICP Planning and Zoning Director THRU: FROM: Jerzy Lewicki Assistant Planner DATE: September 4, 1996 SUBJECT: Boynton Beach Community Development Corporation - PKLV 96-004 Parking Lot Variance (Driveway Distance from the Right-of-Way) NATURE OF REQUEST The Law Office of Allen Wm. Martincavage, Sr., agent for Boynton Beach Community Development Corporation, owner of the land and building to be developed as the office for the Boynton Beach Community Development Corporation, is requesting a variance from the City of Boynton Beach Land Development Regulations, Chapter 23 - Parking Lots, Article II, Paragraph H - Driveways, Subsection 3. Subsection 3 states: "Distance from streets. Parking lot driveways shall be constructed at least thirty (30) feet from the intersection of the right-of-way lines along local streets... ". According to the proposed site plan, the distance between the driveway and the Gateway Boulevard right-of-way line would be approximately five (5) feet. BACKGROUND This request is being processed in connection with an application for a major site plan modification of the property to be developed as an office for the Boynton Beach Community Development Corporation. The property is located at 2191 Seacrest Boulevard, which is southwest corner of Gateway Boulevard and N. Seacrest Boulevard, immediately east of N.W. 1st Street (see Exhibit "A" - location map). The developer is proposing the remodeling of the existing structure. Parking for this facility will be constructed west of the existing building. Access to the parking lot and site will be provided only from N.W. First Street (see Exhibit "B" - survey and Exhibit "C" - proposed site plan). Due to the construction of the Gateway Boulevard exit of Interstate 1-95, the western part of the northern right-of-way of the subject property was reuced to accommodate the construction of this ramp. This alteration resulted in reduction of the frontage of the property on N.W. 1st Street that further limited accommodation of a driveway access to this property from N.W. 1st Street. According to the proposed layout for this facility, the distance between the proposed driveway and the southern right-of-way line of Gateway Boulevard would be approximately five (5) feet. ANALYSIS A copy of the parking lot variance application submitted by the applicant has been provided in Exhibit "D", which includes a statement of justification. I Page 2 Parking Variance Staff Report Memorandum #96-447 Boynton Beach Community Development Corporation Office On Tuesday, August 27,1996, the Technical Review Committee (TRC) reviewed the plans and related documents. Staff discussion focused on safety concerns that would emerge if the variance would be granted. In particular, a concern was expressed that, if the variance would be granted as submitted and, taking into consideration limited visibility caused by severe elevation changes and short distance of multi-directional turning movements, a potentially hazardous vehicular traffic situation will be created at the intersection of Gateway Boulevard and N.W. 1st Street. RECOMMENDATION Based upon the above safety concerns, the TRC recommends denial of this request. However, if the Planning and Development Board and/or the City Commission elects to grant this variance, staff recommends that the safety concerns, at a minimum, be addressed through redesign of, and changes in traffic circulation at this intersection. These changes would be as follows: . Convert to one-way the northern portion of the N.W. 1st Street (north of the proposed accessway); . Alteration of the intersection of Gateway Boulevard and N.W. 1st Street to allow only right-turns from N.W. 1st Street onto Gateway Boulevard; and . Elimination of the right-turn movement from Gateway Boulevard onto N.W. 1 st Street. After incorporating the above design solutions, city staff would support the approval of the variance, subject to the remaining comments as enumerated in Exhibit "E" - Conditions of Approval.
