Dear Ms. Peterson:
After researching our files and reviewing the situation with the City
Attorney, contractor storage is not a penmitted use in the Boynton Commerce
Center PID.
I have enclosed for your infonmation letters the City sent in 1987, 1988
and most recently in February of 1991 to the Commerce Center leasing agent
going over the penmitted and non-penmitted uses. These lists are issued by
the Planning Department each time there is a change, but as you can see
contractor storage has been specifically prohibited since the inception of
the center.
The only avenue for potential relief from your situation at the present
time, is to request an amendment from the Planning and Zoning Board to
allow indoor contractor storage as a penmitted use in the Boynton Commerce
Center PID.
Please address your request to - Chris Cutro, Planning Director, City of
Boynton Beach, P.O. Box 310, Boynton Beach, FL 33425-0310, and I would be
as specific as possible in explaining your request (# of years at the
center, square feet involved, type of materials stored etc).
The Planning and Zoning Board will hear the case and mayor may not decide
to amend the requirements. There is no fee for the processing of this
request.

Dear Mr. Annunziato:
We are preparing to execute a lease with Jolly Good Industries,
a wholesaler of household gumball machines, that plans to set up its
distribution center at the Boynton Commercenter.
The company plans to lease 3500 square feet, and is solely a
wholesaler. On the November 13, 1985 memorandum it states under per-
mitted uses, not requiring environmental review approval:
Any use listed in Sections 8AIC (2),(3), (4), (6), (7), (14)
and (16). The operation of Jolly Good Industries falls under (3)
Household goods; storage, wholesale, and distribution only; retail
display or sales shall be prohibited unless specifically allowed in
accordance with sections 8Al, 8A2, 8A3, or 8A4.
It seems clear that the prospective tenan~s use is permitted -
I would greatly appreciate a response from you verifying the permitted
use of Jolly Good Industries.

I am currently negotiating with Kaufman & Roberts, a
appliance retailer, that wishes to set up a distribution center
at the Boynton Commercenter.
The company plans to lease between 35,000 and 45,000
square feet. Kaufman & Roberts plan to distribute appliances
to their stores and to other retailers, and also plan to retail.
They envision their retail business to 25% of their gross receipts.
On the November 13, 1985 Memorandum it states "Retail
Sales are allowed for goods listed under these sections, provided
that less than 50% of the goods sold on the premises are sold at
retail". It seems clear that the tenant's use is permitted~ Be-
fore the tenant negotiates further, they want to be assured by you
that their occupancy is permitted~

As you are aware, I delivered a letter to Jim Golden on January 6th
concerning the business enterprise of Tim Rand of Boca Raton. Tim Rand, with
his gymnastic equipment distributorship/gymnastics training school is a pros-
pective tenant of the Boynton Commercenter. I understand that your initial
response was not to allow Mr. Rand into the Boynton Commercenter since his use
did not apply to any category of current permitted uses for our office park.
Based upon the November 13, 1985 Memorandum, Revised Permitted Uses,
Boynton Commercenter PID, your response was obviously correct. It is the
hope of Mr. Rand and myse If, that you wi 11 con sider the deta i 1 s of Mr. Rand'S
enterprise in depth, and consider revising the November 13, 1985 Memorandum.
Firstly, Mr. Rand wants to base his enterprise in the City of Boynton
Beach. He has looked in other areas; he likes this community best. Accord-
ing to Appendix A IIZoningll it appears that Mr. Rand's operation would be a
permitted use in a Recreation District (REC). Sec. 511. 1. Uses permitted.
Within .........(pg. 1912.) A. All public. . .. golf courses.
Unfortunately for Mr. Rand, there is not a building in a recreational
district in this City that satisfies his needs of an 18' food ceiling height
and 50' x ISO' inside dimensions. If Mr~ Rand is establishing his enterprise
in this City, he will have to do so in a district other than a recreational
district.
Gymnastics training, schools/gymnastic equipment distributorships
are very popular in the State of Florida as well as elsewhere in the United
States. Of the schools contacted by either Tim Rand, his associates and
myself, many, if not most of these schools were located in bays of new
warehouse buildings, like the buildings at the Boynton Commercenter. The
required inside dimensions and ceiling heights make a warehouse building
most desirable for such enterprises. Of the schools we called, the zoning
of their district was either M-1 or LIW, not a recreational district. And
please, let's not fail to look at the biggest picture of all ---the assets
an enterprise such as Mr. Rand's brings to our City. Most importantly, Mr.

Rand's school provides a healthy, wholesome, inexpensive outlet to the
youth of this ~ty. Gymnastics provides a child with lessons on sports-
manship, dedication to a goal and creativity. In a non-academic
environment, the child can test her physical, emotional limits, and push
them at her own pace into new territory.
On occasional Saturd~ there will be gymnastics competitions--
meets. Our area restaurants~ retail stores a~ if will enjoy this in-
flux of these young people and their parents~ They will be able to find
out firsthand how the 8ity is growing, and the Saturday meets will create
no parking problem. The vast majority of our businesses do not operate
on the weekends~
In summary, Mr. Rands enterprise will be an asset to this com-
munity. It would be a terrible and unnecessary loss not to find a place
for this business in Boynton Beach~
We respectfully request a hearing with the Planning and Zoning
Board at the earliest date convenient for you.

Carrin of 631 Snug Harbor Drive in Boynton Beach. Pastor
Carrin has expressed an interest in moving his congregation,
Grace! Fellowship, to the Boynton Commercenter.
The congregation would, of course, meet almost exclusively
on Sundays. Mr. Carrin and a few of his staff would operate dur-
ing the weekday out of an adjoining office. There would be an
occasional seminar during the week in the early evening.
I am hopeful that you will consider the Grace Fellowship
a desirable and welcome tenant to the Boynton Commercenter.

The Boynton Commerce Center has a prospective tenant who wishes to
lease 7500 sq. ft. of space whose operation consists of an Excalibur
type auto assembly. At a later date they plan to expand their facility
to approximately 20,000 sq. ft. and go into our first office/warehouse
building.
This operation would be desirable and would promote growth to the
area. The owner has been to the city and has discussed his operation
but doesn't recall who he spoke with.

Dear Carmen;
In response to your memorandum to the PLanning & Zoning Board,
we would like to provide the additional information as recom-
mended by your office.
Specifically, we wish to include under our permitted uses, the
following contractors:
Electrical Contractors
Plumbing Contractors
Drywall Contractors
Building Contractors
Air Conditioning Contractors
Painting Contractors
Maintenance Contractors
As mentioned in our letter dated April 1, 1985, the contractors
would be required to store all material within their unit.
Construction equipment will not be allowed to be stored on site,
such as boom trucks, ditch witch, etc. All other vehicles shall
be kept in a professional manner. Vehicles will only be allowed
to be stored on site over night and must be removed from the site
during normal operating hours.

We also wish to expand our uses under manufacturing to include
all uses allowed under M-1 zoning. Although there are uses
which are not appropriate under M-1 zoning for this project, we
wish to ask the Planning and Zoning Board to allow Mr. Annunziato
to make the determination as to the acceptability of a specific
tenant when and if such determination becomes necessary.
Hoping these comments satisfy the pursuit of these matters.

With the increase of interest by potential clients for Boynton
Commercenter, we have had requests for uses that are not on the
approved list of uses.
We therefore are requesting to expand our list of approved
uses to include the following:
RETAIL -
As a secondary use to a primary use such
as a wholesale operation.
CONTRACTORS -
Electrical, plumbing, drywall, etc. - these
contractors would be required to store all
material within their unit. No one will be
allowed to park unsightly vehicles that are
not kept in a professional manner on the
premises of Boynton Commercenter.
MANUFACTURING -
All manufacturing as long as it is approved
by the governing enviromental agencies.
OFFICE -
It is the intent of Boynton Commercenter to

With the increased activity of potential companies that
may occupy space at the Boynton Commercenter, we wish to expand
the list of approved uses to include retail. It is not the
intent of Boynton Commercenter to become a retail center, but
rather a secondary use to accompany a primary use.
An example of this would be a wholesale operation whose
primary business is shipping and selling to the trade and se-
condary would be a small/percentage of retail sales.
Enclosed, we have prepared an analysis of different dis-

we are unable to define the exact percentages of office,.retail
& warehouse space we have assumed certain conditions.
As you can see, under certain conditions we will be short
parking. If the end result of leasing will give us a need for

the minimum distance requirement specified in

(12) Rubber products, limited to forming of rubber
materials, and excluding tire and innertube
manufacturing and rubber reclaiming--where such
uses would be established within the minimum
distance requirement specified in Section 8.A.2.
(13) Fiberglass fabrication and repair, including
fiberglass boat fabrication and repair.
(14) Machine shops, welding and metalworking
shops, tinsmith, sheet metal fabrication, and
blacksmith shops; machining, stamping, cutting,
joining, forging, drawing, bending, or other
forming of metals as either a principal or
accessory use--where such uses would be established
within the minimum distance requirement specified
in Section 8.A.2.
(15) Electrical and electronic goods involving
processes other than assembly of parts or
materials.
(16) Vehicles, transportation equipment, and boats;
farm and construction machinery.
(17) Mobile homes, provided that such uses shall
be located west of Interstate 95.

electroplating and anodizing as either a principal'
