LEGAL APPROVAL 3~ ORDINANCE NO. 094-7 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AMENDING ORDINANCE NO. 89-36, PROVIDING FOR AMENDMENT OF THE CONDITIONS OF APPROVAL FOR THE PLANNED UNIT DEVELOPMENT FOR KNOLLWOOD GROVES, INC., CONCERNING ROADWAY IMPROVEMENTS; PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. WHEREAS, Knollwood is the owner of a certain parcel of land consisting of approximately 111.78 acres located within the municipal limits of CITY; and WHEREAS, on October 17, 1989, the CITY duly adopted Ordinance · No. 89-36 which approved a rezoning of KNOLLWOOD's property from AG (agricultural) and RlAAA (Single family residential) to Planned Unit Development; and WHEREAS, since the rezoning of the property in 1989, . circumstances have changed pertaining to the roads in the area which require improvement; and WHEREAS, Knollwood and the City have negotiated an Agreement, i a copy of which is attached hereto as Exhibit "A", NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE iCITY OF BOYNTON BEACH, FLORIDA, THAT: I I '1 Section l. The City Commission of the City of Boynton i 'iBeach, Florida hereby amends the conditions of approval for the I I I Planned Unit Development as set forth in Ordinance No. 89-36 concerning roadway improvements to provide that Knollwood's . compliance with the terms of the Agreement requiring the payment of $108, 515 . 00 to the City shall constitute the commencement of development as contemplated by Section 10(c) of Appendix B, Planned Unit Development Code of the City of Boynton Beach. Section 2. All ordinances or parts of ordinances in ; conflict herewith be and the same are hereby repealed. Section 3. Should any section or provision of this ordinance or portion hereof, any paragraph, sentence or word be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the remainder of this ordinance. R94-87, EXPANDING THE SCOPE OF SERVICES FOR ROSSI AND MALAVASI ENGINEERS FOR ENGIN,::ERING SERVICES FOR MINER ROAD; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on May 17, 1994, the City Commission approved the execution of a Contract with Rossi and Malavasi, Engineers, Inc., or engineering services for Miner Road; and WHEREAS, it is in the best interests of the City to expand the scope of services for that Contract; and WHEREAS, the expanded scope of services is attached hereto s Exhibit "A".
