Dear Mr. Cutro:
This Idler is written to support a request by Knollwood Groves to extend the existing
PUD approval for the project and to modify certain developer agreement conditions.
Background
A traffic impact study was prepared for the Knollwood Groves development in June
1989. The development plan presented at that time included approximately 539
residential dwelling units and a daycare center. A 1996 buildout was envisioned. The
development order conditions resulted in a requirement to pay $760,000 to improve the
roadway system in the area. This payment was approximately equal to the road impact
fees for the site and the applicant agreed to use these funds to pay the cost to construct
Miner Road between Sandlewood Drive and the Citrus Glen Plan Unit Development.
Other Developments
A major element of the 1989 traffic analysis was the cumulative traffic impact from a
large number of committed developments in the area. Various economic and market
conditions have caused these developments to significantly low their pace of
development. Therefore, the traffic volume projections from the 1989 analysis have
proven to he overstateu.
Current Conditions
Traffic count data from the Palm Beach County Traffic Engineering Department
indicate that all roadways in the area of the Knollwood Groves project are operating at
or very near acceptable level of service conditions.
. Lawrence Road is carrying approximately 7,750 vehicles per day with
the Level of Service "D" thresholds of 13,700 vehicles per day.
. Hypoluxo Road is carrying traffic between 18,000 and 25,000 vehicles

. Congress Avenue north of Hypoluxo Road is carrying approximately
27,000 vehicles per day with the carrying capacity of 30,200 per day.
. Only Congress Avenue south of Hypoluxo Road is slightly over its
carrying capacity of 30,200 vehicles per day (existing volume is 30,390
vehicles per day).
The Miner Road Improvement
As mentioned earlier, the development order conditions in the Knollwood Groves PUD
approval requires the construction of Miner Road between Sandlewood Drive and
Citrus Glen Planned Unit Development. This condition also envisions that two other
pieces of the Miner Road improvement be accomplished by adjacent developers:
. The Sandlewood development has constructed Miner Road from
Sandlewood Drive to Congress Avenue.
. The Citrus Glen development would complete the roadway from
Lawrence Road to the east.
But Citrus Glen has not accomplished their component of the Miner Road
improvement. The completion of the middle third by Knollwood Groves will have no
benefit to the roadway network in the area.
Conclusion
Therefore, on behalf on Knollwood Groves, I request that the development order
conditions related to making the road impact fee payment be extended because:
. Existing conditions are at acceptable levels of service.
. Construction of major developments in the area has slowed to the
extent that traffic imp3cts proje~ted in tbe 1989 report are not being
realized.
. Other sections of Miner Road, have not been constructed by other
developers in the area.

Dear Mr. Cutro:
Thank you for your comments regarding our application for an extension of
platting requirements for the Knollwood Groves PUD. We are in agreement that
the condition of the PUD approval related to the payment of traffic impact fees
in advance of the project's development should be modified. We are, therefore,
requesting by this letter such modification.
The condition of approval related to the payment of traffic impact fees was one
of three imposed by the City Commission for the project. We do not anticipate
amending any of the other conditions.
Our request to extend the period of time in which to make payment of the
required impact fees is based on the same factors which necessitated the request
for extension of the PUD. The project has not gone forward as expected because
of the overall state of the economy, particularly the depression in the development
industry, which has been exacerbated by the inability of developers to obtain
financing for new projects. The modification of this condition and the granting of
the requested extension will allow the property owner to continue to market the
project as it has been approved.
Only the project's timing is affected by the modification and extension requested,
not its validity or appropriateness. Knollwood Groves PUD was consistent with
the City's comprehensive plan's goals, objectives and policies when it was
approved, and will continue to be so if the timing for the commencement of its
development is extended. The proposed density and housing type mix were
consistent with the development pattern in the general area when the project was
approved, and nothing has occured since which would require revisions to the
project to achieve this same consistency. The City will reap the same benefits from
the eventual development of the project as it would if the project had commenced
development earlier - the extension of Meadows Boulevard will be constructed, the
Parks Department will obtain the 5 acre park in the south east corner of the site,
and City revenues will be enhanced through permit fees, impact fees and ad
valorem taxes.

The payment of traffic impact fees in advance of the commencement of
development was intended for use for the construction of a "missing" section of
Miner Road. The sections of Miner Road to which this "missing" section were to
have been connected have also not yet been built. Therefore, there is no necessity
to now pay fees for construction of a road which will have no utility until the
other sections have been constructed.
Please note also that growth in the west Boynton area has been significantly
below that which had been projected when the Knollwood PUD was approved in
1989. As verified by traffic engineer Fred Schwartz in the attached report, all
roadways in the area of the PUD are operating at or very near acceptable level
of service conditions. Allowing the delay of the payment of impact fees not
currently needed for immediately anticipated or warranted road construction will
have no negative impact on the ability of the existing roadway network to operate
efficiently or safely.
We would appreciate consideration of this modification request concurrent with
the City's review of our PUD extension request. We look forward to further
