Specify on the plans the color of the buffer wall. I recommend choosing a color that will be harmonious with the surrounding structures. 3. Indicate on plans, the location of car stops in relation to the proposed wall. Distance from wall should be a minimum of three feet. Federal Highway DATE: TO: RE: Per your request regarding the above, please be advised of the following: 1). october 3, 1990. - TRB comments submitted to the Planning Dept. 2) November 20, 1990 - Met with Mr. Corbett and Mrs. Bingham .Plans were submitted and reviewed at that time. .Property owner and architect argued that the wall is being constructed voluntarily in an ,effort to keep other persons from trespassing on the owners' property (i.e., motor vehicles from an adjacent business on Federal Highway use the owners' property as a short cut upon completing their business) . They also felt that since the wall was not a buffer wall nor is it a required wall for the parking lot, that the comments contained in the TRB memo (see. attached) should not be addressed. .Hy comments were not based on an interpretation of whether or not the wall was required, but rather based.on the fact that according to the code and the central Business District (CBD) guidelines, The Wall, represented construction in the CED. The owner did state, however, that she wanted to install some landscape, but that she wanted to install it en her own, when she felt it was appropriate. I informed them that I would look into the matter further and get back with them upon ~ompletion of my investigation. 3) November 28, 1990 - Met with Mike Haag to discuss the issue as it relates to development in the central Business District (code requirements and CBD Design Guidelines). :section 19-90 of the City'S code of Ordinance (Article V, Central Business project Review and Approvals) indicates that II any person owning property... des irinq to obtain a buildinq permit for construction of any buildinG or structure shall submit to the City Planner project plans and supporting data prepared by... with appropriate surveying, landscape... in reviewing and evaluating the proposed use, building or structure (pg. 1383). /7 S-1I~ Page 2 - J. Scott Miller - Memo #90-212 12/14/90 . section 7.5-33: Construction of language and definitions relating to the landscape code: A " building II or "structure" includes any part thereof (pgs. 606 & 607). .Section 7-5.57: CBD landscape requirements states "development in the CBD shall conform to these minimum landscape requirements, and where possible. phall conform with recommendations ,of the CBD Guidelines." (see attached for perimeter strip landscaping (pgs. 622 & 623) Please note that an error was made on the TRB comments. Instead of landscaping areas 1b page 623, it should be 1a pages 622 << 623. CBD Design Guidelines also address buffers and walls (pg.18). 4) December 4, 1990 - Met with Mr. Corbett to discuss the above requirements. He (and Mrs. Bingham) was still of the opinion that since the wall was not required, the City should not require the owner to landscape the area. Based on ~hat was in the code and my feeling as to the affordability of the project, I proposed the following: 1. Instead of landscaping being placed along the entire perimeter of the site (as per the code), landscaping would be placed only in the area of the newly-constructed wall. .. 2. Instead of sod being placed in the area between the wall and the head of the (existing) parking spaces, other material such as rocks and pebbles could be used. 3. That the above be indicated on the plans or that a date and description of the landscape be placed on the plans. Mr. corbett took the plans and indicated that he would speak with the owner to see if she would agree to the above. 5) December 11, 1990, I called Mr. Corbett to get an update on the discussion. He informed me that the owner's opinion ~ad not changed. she did not want to be required to install landscape nor the wheel stops. ,He also informed me that he returned the plans to Mrs. Bingham. /if . . Mrs. Bingham feels, however, that the wall is being installed voluntarily, that it is not a required wall, and that no code ):'equirements should be enforced. Mrs. Bingham would like to install the landscape (her choice) when she feels that it is appropriate for it to be installed. . . . Development infhe central business district shall conform to these minim4m landscape requirements, and where possible shall ,conform with recommendations of the central business district design guidelines. (1) Landscaped areas: a. Perimeter strip landscaping. Landscape strips with landscaping material are required to be located within the properly line along the entire perimeter of park- ing and vehicular use areas, and shall meet the follow- ing minimum requirements: 1. Landscape perimeter strips shall be at least three (3) feet wide. 2. Living plant materials shall cover at least seve enty (70) per cent of the required landscaped area, and shall include trees, shrubs, and ground cover, but not lawn grass. 3. Trees are required at the rate of one (1) per thirty (30) linear feet of perimeter strip, and may be either grouped or uniformly spaced. Trees required may be planted a maximum of twelve (12) feet from the property line. 4. 'Shrubs shall be planted eighteen (18) inches on center in perimeter strips to form continuous screen hedges. Hedges shall be allowed to grow and shall be maintained at a height of two and one.half(21h) to three and one-half (31h) feet. Screen walls may be installed in lieu of hedges. 5.
