As a condition of site plan approval, the following comments
should be incorporated into the related documents by the
applicant:
1. The proposed buffer wall must extend to the east and west
property lines.
2. The buffer wall must be stuccoed and painted on both sides.
3. Handicap striping must be painted blue in conformance with
the city code.
4. Specify the type of sod to be used.
5. Hedges must be provided along the west property line to the
limits of the parking area.
6. The building must be 4ccessible to the handicapped.
7. A Department of Transportation permit is required for work
in the Boynton Beach Boulevard right-of-way.
8. A demolition permit must be secured toremarethe carport.
The applicant's prompt compliance with the preceding comments
will insure a timely permitting process.

Handicap parking stall striping to be blue.
Drainage calculations are not correct. With a width of
5 feet and a depth of 5 feet, the exfiltration trench
would have to be 97.7 feet long. By making the trench 6
feet wide and 6 feet deep the trench length is reduced
to 63.6 feet. See attached calculations.

Attached you will find a copy of a design detail that is
referenced within the proposed Urban Design Plan for Boynton
Beach Boulevard. This diagram outlines the typical streetscape
improvements for the south side of Boynton Beach Boulevard east
of Interstate 95. From a physical development standpoint, it
would be possible to construct all of the improvements shown in
this diagram, including landscaping, lighting, the curvilinear
sidewalk, and the private sidewalk or steps. There is even a six
and one-half foot wide strip on the west side of the building
where the five foot private planting strip qould be constructed.
concerning the above, the only problem that I would foresee with
constructing all of these improvements is coordinating the layout
and spacing of the sidewalk, light pole fixtures and palm trees
with adjacent properties, as there are currently no plans for the
redevelopment of these properties. The solution to this dilemma
would be to create a master plan for that portion of Boynton
Beach Boulevard east of I-95 which shows for each parcel the
curvilinear sidewalk design and the location of streetscape
plantings and light pole fixtures. Such a plan would minimize
haphazard construction of streetscape improvements.

OWner, Michael Agnello, appeared at City
commission public audience (see attached
minutes). Briefly, Mr. Agnello expressed

Boynton Beach Boulevard plan discussion on
the agenda for the next City commission

the Commission felt this procedure should be followed or if
they wished to make changes. It was 'rioted that there are
inconsistencies among the various boards. The 1983 proce-
dure is attached as Addendum "E" to the original copy of
these minutes in the Office of the City Clerk. Some Boards
follow the procedure of letting a member abstain from voting
when an issue before them might be construed as a conflict.
Other boards have the alternate sit in for that portion of
the meeting and have the regular member go into the audience
if he has a confict with voting on an issue.
Commissioner Weiner had some other items she wished to
discuss relative to boards. Mayor Marchese felt it was a
good idea to place this on the agenda for the next meeting,
and he requested that the City Manager do so. Commissioner
Olenik wished to discuss some other issues relative to board
participation at that time as well.

. PUBLIC AUDIENCE
Parking Lot/Urban Design Plan
. Michael Agnello, 4012 Shelldrake Lane, Boynton Beach came
forward to explain a situation which has come about
regarding the requirement for a new parking lot which
conflicts with the Boynton Beach Boulevard Urban Design Plan
proposal. A dentist who has his office in the building has
been cited by Code Enforcement for operating without a
license. In order to get a license the parking lot must be
brought up to standard. The use is grandfat~ered in and the
parking lot is currently packed gravel. The Code
Enforcement Board has given them '6 months to bring this up
to code. Mr. Agnello has hired an architect, an engineer, a
surveyor and lighting experts. He has been told he will
have to apply for a variance which will cost $400 for the
application. This variance is for his driveway which is the
only entrance off Boynton Beach boulevard. He wanted to
improve the parking lot, but if he does he may be told in a
few months to take it all out to come into compliance with
the Boynton Beach Boulevard plan. The dentist, is concerned
about the liability of operating without a license, and Mr.
Agnello is afraid he will lose him as a tenant.
City Manager Cheney stated that Mr. Agnello had come to him
and talked with him about the situation. City Manager
Cheney stated that things of this nature come up from time
to time. He pointed out that Mr. Agnello has been requested
to do something which is in conflict with the implementation
of the Boynton Beach Boulevard plan. City Manager Cheney
felt that the Commission should understand that these type

Commissioner Olenik wondered if it was time to give the
Urban Design Plan more consideration. If this plan was
approved in the near future, Mr. Agnello might be able to
wait and avoid the situation. He could probably request an
extension of time from the CEB.

City Manager Cheney felt this was probably a good time to
give the plan serious consideration. The Commissione~s
agreed, and the Boynton Beach Boulevard Urban Design Plan
would be placed on the agenda for the next meeting of the
City Commission.

Sergeant Sheridan
Bob Fauser, 125 S.E. 6th Avenue, Boynton Beach, came forward
to speak about Sergeant Paul Sheridan. On October 19, 1988
Sergeant Sheridan got in trouble at the Tadpole Lounge in
Delray according to Mr. Fauser. The City found that
Sergeant Sheridan had used poor" judgment and displayed con-
duct unbecoming a pOlice officer which reflected discredit
on the City of Boynton Beach. He received a "slap on the
wrist" - 3-days suspension without pay. Mr. Fauser referred
to three previous incidents involving Sergeant Sheridan and
questioned why he was still 'working for the.Police
Department. A Lake Worth police officer investigated an
incident which took place in May, 1984 which involved
Sheridan. Sergeant Sheridan's pOlice informant was shot to
death. The Lake Worth Police report stated that Sergeant
Sheridan was intoxicated. The City of Boynton Beach:
cleared Sergeant Sheridan of any wrong doing, and the'Lake
Worth Police officer went to the press and told them that he
stood by his version of the event of 1984. He also stated
that "0fficial Police misconduct is everyone's concern, and
should not be taken lightly or concealed by any agency or
citizen. II Mr. Fauser felt this statement is true today as
well. He felt Sergeant Sheridan's conduct was a disgrace
and the fact that the City Manager continues to tolerate
such behavior after 4 incidents should be the concern of
everyone - Commission included. He wished everyone to know
that if Sergeant Sheridan's misbehavior drags the City
through a big financial mess, he will not be the only one
held accountable. He felt the responsible City Officials
who were aware of his record and chose to remain silent
would share the blame. This could be costly for the tax-
payer. He felt it was t\~e for the City Commission to
become involved in investigating the situation. He referred
to the situation in De1ray where the City Commission was
upset with the City Manager and held a special meeting.
As it turned out the Commission was satisfied and that was
the end of that. He referred to a law suit in.which

Mr. Golden made a presentation of both of these requests.
He said the driveway would be located approximately 127
feet east of N. W. 3rd Street. The City's parking lot regu-
lations do not allow driveways within 180 feet of the
intersection right-of-way line, as Boynton Beach Boulevard
is an arterial road. The proposed parking lot would serve
an existing dental clinic, which is currently under a Code
Enforcement action.
Concerning the site plan, Mr. Golden said there is an exist-
ing carport on the east side of the building that will be

removed to provide for the driveway to serve the six spaces
at the rear of the building. No changes are proposed to the
existing building. The Technical Review Board (TRB)
recommended approval of the site plan, subject to staff
comments attached to the original copy of these minutes in
the Office of the City Clerk as Addenda A-l through A-3
inclusive and to the following comments:
Utilities Department
1. Show all water and sewer utilities.
2. Provide a reduced pressure back flow preventer on the
water service.
Public Works
Public Works will offer can pick up of office trash only.
Planning Department
1. The buffer wall must continue along the entire south
property line from the east property boundary to the west
property boundary.
2. It is recommended that this project comply with the
greenbelt improvements that are required for the south
side of Boynton Beach Boulevard under the proposed Urban
Design Plan.

Mr. Golden said the recommendation of the TRB concerning the
parking lot variance was that it be approved as submitted.
The basis for the recommendation was that the applicant
would be unable to access his property, as his entire front-
age lies within 180 feet of the intersection of the right-
of-way line. Mr. Golden added that this would create an
undue hardship for the applicant.
Mrs. Huckle inquired whether the Code Enforcement action was
a result of not having obtained this relief, or if it was

because of doing business without a license. Mr. Golden
understood that the dentists moved in without obtaining a
license. Mrs. Huckle noticed there was an existing dentists'
office there, and she wondered what the application was all
about, if they were already underway. Mr. Golden answered
that the owner was present.

Vice Chairman Blanchette observed that the lot was non-
conforming, and he commented that was because the Code was
written to make it non-conforming as far as the driveway.
He noted this lot and Lots 1, 2, 3, and 4 are in the same
position.' Vice Chairman Blanchette felt the Board had no
choice but to allow this. He questioned whether they were
going to take a piece of property and make it useless.
As the location of this is on the south side of Boynton
Beach Boulevard, Mr. Zimmerman asked if there would be any
effort to get the applicant ~o conform with the greenbelt.
Mr. Golden referred to the comments from the Planning
Department and the Department of Community Improvement
concerning conformance, to the degree of being possibly
feasible with the Urban Design plan for Boynton Beach
Boulevard.

Mr. Zimmerman questioned whether there would be room for it.
Mr. Golden replied that they have about 19.58 feet, which
would just about squeeze in the 20 foot greenbelt. However,
there is another 5 foot and a seven foot corridor. One is
like an overhang, and the other is like an additional
landscape strip. They would not have room for that. Some
plantings are required in the rear, along the buffer wall.
Because of the width of the parking lot, as required by the
Parking Lot Ordinance, that would squeeze out all of the
room at the rear of the lot. It would be difficult to put
that in and make drainage work, etc.
Chairman Walshak asked if this was the area where, at the
last workshop meeting, the Board had recommended they go two
lots in the C-l professional category. Mr. Annunziato
answered affirmatively. Chairman Walshak thought they would
have that problem all along there until people moving into
these places understand that they can expand another lot
deep behind them. He thought there would be some relief in
the new Comprehensive Plan.

Mrs. Huckle asked if only one dentist was applying, even
though several names are on the building. Mr. Golden said
the owner could clarify that. The issue came up at the TRB

meeting, but the applicant did meet the Code. Mrs. Huckle
elaborated on how much parking may be needed if there would
be more than one dentist. If they met Code, she thought it
could represent a serious problem, and they should look at
the Code more closely because it would be unrealistic if
there was more than one dentist. After explaining, she
asked if it is according to square footage.
Mr. Aguila inquired whether the square footage could increase.
Mr. Golden answered that the building, as it stands, is at
the square footage. If they expand, they will have to do
separate site plans. Chairman Walshak thought Mrs. Huckle
had a good point and they could look at it when they look at
the new Comprehensive Plan.
Michael H. Agnello, 4012 Shelldrake Lane, Boynton Beach, FL
33436, and Mark. Morgan, Associate of Robert E. Fetrow, P.E.,
200 Knuth Road, Boynton Beach, FL 33436 came forward.

Mr. Agnello informed Mrs. Huckle that there are three
dentists. It is a partnership, and they operate two other
medical facilities, so there is only one dentist on site at
any given time. They rotate between Lake Worth, West Palm
Beach, and this site. There are only two rooms, so only
one dentist works on site. There is a receptionist, who is
also a dental.hygenist.
Mr. Agnello explained that the group of dentists applied for
a building permit, made the improvements inside, installed
a back flow preventer outside, and then went to the City for
an occupational license. After making $5,000 improvements
inside in addition to his several thousand dollars on the
exterior to meet the City requirements, Mr. Agnello said the
dentists were told they could not receive an occupational
license because there was inadequate parking to the current
parking standards presented by the City. That was why the
dentists were already there.
On the existing entrance, Mr. Agnello said there is already
a driveport in the carport area into the property. They are
not changing anything aesthetically. The front area is
already grassed and sprinkled. A row of bushes is in front
of the property, and it is an attractive sight.

There were comments about the landscape plan. Mr. Agnello
showed Mr. Aguila where the hedges are and said they have to
widen the entrance. Mr. Aguila thought it was very bare, as
far as the landscaping was concerned. He wanted to see

trees on Boynton Beach Boulevard. Mr. Aguila referred to
the 5th comment in the staff comments from Don Jaeger,
Building Department, which said hedges must be provided
along the west property line to the limits of the parking
area. He asked if Mr. Agnello had any proble~ with that.
Mr. Agnello answered that he would do that, and he had no
problem with it.
Mr. Agnello had a concern in reference to the request to
meet Urban Design's plans for several reasons: (1) The
property is only 50 feet wide. Referring to the entrance-
way, Mr. Agnello said that literally half of the property is
a driveway. The other is a grassed area. (2) The Urban
Design Plan has not been adopted. (3) All of this was due
to Code Enforcement because the occupant was in there and
did not meet adequate parking requirements.

Mr. Aguila further referred to the landscaping and was
concerned about what people see. Chairman Walshak inquired
whether Messrs. Agnello and Morgan were familiar with the
staff comments. Mr. Morgan answered that they had reviewed
them. Chairman Walshak asked if they were in agreement with
the staff comments. The only issue Mr. Agnello strongly
disagreed with was complying with the greenbelt improvement
due to the fact that the proposal for the downtown has not
been accepted yet.
Chairman Walshak responded that the taxpayers paid a lot of
money for that design, and the City fully intends to adopt
it in the very near future. He again asked if Mr. Agnello
was in agreement with the staff comments. Mr. Agnello
replied that he would feel more comfortable presenting his
issue to the City Commission, if that was the next step. He
certainly agreed with the other comments.
Chairman Walshak advised that he should address the Board.
When he goes to the City Commission, he should address them.
Chairman Walshak again asked Mr. Agnello if he was in agree-
ment with the staff comments. Mr. Agnello was not in agree-
ment with one of the staff comments.

Mr. Zimmerman asked if the temporary driveway on the west
side is being used by trucks that cannot get through the car-
port on the east side. Mr. Agnello confirmed that was
correct. Mr. Zimmerman inquired whether the temporary
driveway on the west side would be closed off and landscaped.
Mr. Agnello estimated about 1/8th of it is on the property
of the existing site. There is grass almost the entire part

of the parcel they were referring to. Mr. Zimmerman asked
if they were the only ones who can use the temporary drive-
way. Mr. Agnello answered that it is utilized by the
property due west and right now, by this property.

Mrs. Huckle questioned whether the temporary driveway is
legal access. She clarified for Mr. Agnello that she was
referring to the dirt road on the west. Mrs. Huckle asked
if the road was regularly used as a means to gain access to
. the property. Mr. Agnello answered that it is right now.
He told Mr. Zimmerman that with this plan, the back yard
will have a concrete curbi~g, which will prevent that from
happening. Also, there wi~l be a hedge along the concrete
curbing. Mr. Richter did not think that road was of any
consequence to this request. Mrs. Huckle thought it was an
interesting thing that the City should pursue. Mr. Richter
pointed out that if they are going to put a curb and bushes
there, the road cannot be used to gain access. Mr.
Zimmerman informed him that a curb is there now.
Mr. Aguila referred to the staff comments from Johnnetta
Broomfield, Director of Community Improvement, ~hich per-
tained to landscaping. He asked if that was all inclusive
or if the seven feet and five feet were part of the 20 feet.
Mr. Aguila also questioned why Mr. Agnello did not have
room in his 20 feet to do what the Board was asking him to
do. Mr. Golden answered that the 7 feet and the 5 feet are
additional (above and beyond the 20 feet). The building
sits where the 7 feet and 5 feet would be. Mr. Aguila
determined that Mr. Agnello could do the 20 feet but not the
7 and 5 feet. Mr. Agnello said the 20 feet consists of a
foot of bushes, as well as the new sod that they laid,
sprinkled, etc. It is green, attractive, and, there is a row
of bushes.

Mr. Agnello felt they were complying, but he had a strong
feeling of ripping out existing sidewalk at his expense. If
they conform to the Urban Design plan, to his knowledge, it
will be the existing property owners expense to rip up an
existing series of sidewalks that are there now to make it
winding. To Mr. Agnello, that would be an incredible waste
of the property owners' money if the plan is adopted. Mr.
Aguila interjected that the Board was not asking him to do
that. Mr. Agnello stated that all of the property owners he
is familiar with on Boynton Beach Boulevard are going to be
proceeding on that issue.
Mr. Agnello understood about the greenbelt, thought it was
beautiful, great, and he was in favor of it. That was what

he has done to the property since purchasing it. Mr. Aguila
said that then Mr. Agnello should not mind putting another
tree there. There were further comments about the planting
of trees, and Mr. Aquila stated that the Board could require
more trees.
Chairman Walshak asked if anyone wished to speak in favor
of, or in opposition to the project. There was no response.
THE PUBLIC HEARING WAS CLOSED.
vice Chai~man Blanchette wondered why they were talking
about trees when they were not the Landscape Board. All
they had before them was the request for approval of a
variance, and he elaborated. There was discussion about
the Community Appearance Board, landscaping, and Urban
Design's plan.

Chairman Walshak felt that the City staff recommended that
comment, and that was why he was interested in finding out
from Messrs. Agnello and Morgan if they agreed with the
staff comments. If they do not comply with all of the staff
comments, Vice Chairman Blanchette said they will not be
granted a permit.
Mr. Annunziato read the second comment from his memo. (See
"Planning Department", page 6 of these minutes). He
explained that the intent there was that the applicant should
comply with things he can comply with. There was no intent
to have him move the building. Mr. Annunziato elaborated on
other elements of the Urban Design plan for Boynton Beach
Boulevard and said the City has begun to tie in the
redevelopment of Boynton Beach Boulevard through street
lights, etc. He explained.
Chairman Walshak thought that was the way the staff comments
should read. Mr. Aguila wondered if the City had clarified
with the applicants what issues they could meet versus what
they could not, so they knew what the Board was referring
to. After further comments, Chairman Walshak asked if Mr.
Annunziato could get from the City Staff what the City Staff
feels the applicants can adhere to prior to them going
before the City Commission. Mr. Annunziato answered,

5 feet and a depth of 5 feet, the exfiltration trench
would have to be 97.7 feet long. By making the trench 6
feet wide and 6 feet deep the trench length is reduced

Attached you will find a copy of a design detail that is
referenced within the proposed Urban Design Plan for Boynton
Beach Boulevard. This diagram outlines the typical streetscape
improvements for the south side of Boynton Beach Boulevard east
of Interstate 95. From a physical development standpoint, it
would be possible to construct all of the improvements shown in
this diagram, including landscaping, lighting, the curvilinear
sidewalk, and the private sidewalk or steps. There is even a six
and one-half foot wide strip on the west side of the building
where the five foot private planting strip qould be constructed.
Concerning the above, the only problem that I would foresee with
constructing all of these improvements is coordinating the layout
and spacing of the sidewalk, light pole fixtures and palm trees
with adjacent properties, as there are currently no plans for the
redevelopment of these properties. The solution to this dilemma'
would be to create a master plan for that portion of Boynton
Beach Boulevard east of I-95 which shows for each parcel the
curvilinear sidewalk design and the location of streetscape
plantings and light pole fixtures. Such a plan would minimize
haphazard construction of streetscape improvements.

ing of the sign and said it is a back lit sign with a
plastic face. He confirmed that the sign conformed with the
Sign Ordinance.

Mr. Golden said the building is to be remodeled into a
dental clinic. The P&Z Board unanimously recommended
approval of the request, subject to staff comments. Concern-
ing the staff recqmmendation to construct the greenbelt
improvements that would be required under the proposed Urban
Design plan, the City Staff found there was an opportunity
to physically construct all of the improvements recommended
by the plan.
Mr. Golden pointed out that the previous projects on the
Boulevard that were approved were required to construct these
improvements. The Plan calls for the City to collect money
from developers and install the greenbelt because there may
not be complete continuity between sites as they develop
piecemeal. Mr. Golden thought that needed to be looked at
in consideration of this, as well as other projects on the"
Boulevard.

Boynton Beach Boulevard urban design that impacts this
property. Mr. Agnello pointed out that the plan involved
property on the south side of the Boulevard, and it
suggested eliminating many curb cuts and access to that
property from Boynton Beach Boulevard and to provide for a
roadway and access to the property from the rear of the
property.
Mr. Agnello informed the Commission that his property has
been cited as being in violation of the' city's parking
requirements due to a Code Enforcement violation of an
occupational license. He has been asked to install and
widen an entrance to his property from Boynton Beach Boule-
vard, which will be completely eliminated if the Boynton
Beach Boulevard urban design plan is accepted. Mr. Agnello
was also asked to put a parking lot in the rear of the
property complete with landscaping, drainage, lighting, etc.,
which is where there is a proposed roadway, which then
would also eliminate all of tho"se improvements.
Mr. Agnello was willing to improve the appearance of the
front of the property, and he accepted and endorsed a
majority of the Boynton Beach Boulevard urban design plan,
but he felt the plan had to be done with all of the property
owners on the Boulevard, not piecemeal, because the improve-
ments will be hodgepodge. The width of his lot is only 50
-feet, and he believed the widened driveway would be approxi-
mately 25 to 30 feet of a meandering sidewalk. Without
having all of the property owners together to do this, Mr.
Agnello predicted it would take many years for it to be
done.

Mr. Agnello requested a suspension of the Code Enforcement
Board ruling and the penalty that is to start on April 4th,
if the parking lot is not in place in the rear of the
property, until the City decides on these issues.
It seemed to Commissioner Weiner that Mr. Agnello had a
very valid point in that the Commission had not completed
the City's plan on Boynton Beach Boulevard. However, they
are about to in the City's Comprehensive Plan. Commissioner
Weiner thought Mr. Agnello was asking for time so the
Commission could have a definite view of what they want, so
he could comply. She thought Mr. Agnello was caught in a
dilemna.
Mr. Annunziato advised that the Comprehensive Plan will not
address the issue of whether the parking should be in front

of the building or behind the building. It will address
the depth of the commercial properties on both sides of
Boynton Beach Boulevard. Mr. Annunziato agreed that Mr.
Agnello had a problem, but he was not sure he agreed
totally with him. The Urban Design plan provided for park-
ing behind the buildings connected by a drive which ran from
side street to side street. This would not interrupt that
process. Mr. Annunziato saw that as something that could be
done and should be done in connection with the development
of this property, and it will serve the-property for many
year s to come.;

Mr. Annunziato thought the issue that needed to be
discussed was what would happen to the front of the build-
ing. In the past, wherever possible, the City has
recommended that all or as many elements of the Boynton
Beach urban design plan be required as a condition of
approval on development. Mr. Annunziato cited Kentucky
Fried Chicken but said this is different, because it is not
a corner property. The meandering sidewalk would not work,
and he explained. Mr. Annunziato stated that there are some
landscaping elements of the Boynton Beach uban design plan
which are not overly expensive to accomplish, which begin to
tie the whole street together. For the price of a couple of
Palm trees, he thought they would get the flavor for the
Boynton Beach urban design plan, and the applicant would not
be overly penalized because he has to provide one tree every
40 feet. Mr. Annunziato expounded about trees and sidewalks~
He thought the Commission had the authority to implement
what they thought was reasonable and to require them as part
of the site plan approval.

If they are required to put Palm trees in the front, Mr.
Fetrow told the Commission it will require them to remove
the sidewalk and replace it at the same time. He felt they
were in a Catch 22 situation. The City wants the seven foot
greenbelt area between the road area and the sidewalk. For
them to be able to do that, Mr. Fetrow said they will have
to remove the sidewalk. There is no Ordinance by the City
yet as far as doing the work in front of the buildings at
this time.-

There was discussion about the landscaping. Mr. Agnello
said all of the landscaping will be demolished once the plan
is accepted. He referred to the expense he has already gone
to and the demolition of an existing canopy, which would not
be demolished if the plan went through because there would
be no road access. Mr. Agnello said he already has an exist-

ing driveway, which will be demolished when the plan is
accepted. They will not add to it or widen it. He
questioned why he should go to all of that expense when they
were so close to having the plan approved. Mr. Annunziato
thought it would be many years before the urban design plan
would be implemented in the way Mr. Agnello was describing,
and he explained.
In the interim, Mr. Annunziato thought Mr. Agnello's
dentists' patients would be well served'by having a parking
lot that works efficiently and by landscaping which would
make it more aesthetically pleasing. Mayor Marchese thought
Mr. Annunziato carne up with a reasonable solution. Mr.
Agnello indicated the area that is green and said it is
sprinkled. He thought it was aesthetically pleasing in the
front.

Mr. Annunziato informed Commissioner Olenik that a sub-
standard driveway connects Boynton Beach Boulevard to the
rear of the property through a carport. If Mr. Agnello was
asked to perform all of the design guidelines to the rear of
his property when the access road behind the buildings is
constructed, Commissioner Olenik asked if he would have to
alter any improvements he has made. Mr. Annunziato replied
they would have to assume that the access aisle that would
serve the parking lot would corne through the property to the
extent that it would take out landscaping and paving, so the
answer was "Yes."

Commissioner Olenik asked if Mr. Agnello would have to
refigure his parking lot. Mr. Fetrow interjected that they
could not answer tllat question until they had a complete
overall view of the plan, which was not available at this
time. He thought Mr. Annunziato was answering a question on
an assumption. Commissioner Olenik asked if making Mr.
Agnello put the parking lot in the way that is requested in
the staff comments would be in conformance with the design
guidelines. He questioned whether they were putting Mr.
Agnello in an unfair position that when the road is
constructed, Mr. Agnello will have to tear something out.
If they start doing this to the business owners on Boynton
Beach Boulevard, Commissioner Olenik did not think they
would get them to do anything.
Mr. Annunziato advised that there is a Code requirement that
when a change in use occurs in a building, you have to
construct a parking lot to serve that facility. The plan
for the parking lot was what was before the Commission.

Commissioner Olenik alluded to Tri-Rail being allowed to
put in a temporary road and said that here, they were requir-
ing a landowner to conform to the ultimate when they were not
sure what the requirements would be.
Mayor Marchese did not think the requirement to put in a
parking lot now had anything to do with the Comprehensive
Plan. It is a standard requirement.
City Manager Cheney asked what was being required of Mr.
Agnello because of the Boulevard design. Mr. Annunziato
answered, "Only the elements of the landscape which are in
front of the building." He added that it would be landscap-
ing, trees, a change in the sidewalk, and lights. Mr.
Annunziato recommended that the only things that made sense
at this time were the trees.

There was discussion about the parking lot. City Manager
Cheney suspected that when they implement the Boynton Beach
Boulevard design, a lot of that will be with public funding.
If that was the case, Mr. Fetrow inquired why they must do
it now. City Manager Cheney responded that they need a
parking lot now.
City Manager Cheney explained about Tri-Rail and said it is
a little different. He said the parking lot back here may
be there and just need to be repainted. City Manager Cheney
did not think there was a basis for a waiver of the parking
lot for that use, and he thought the Code Enforcement Board
\~as stuck with requiring the parking lot. He did not think
they could grant a temporary parking lot.

Mayor Marchese advised that the parking lot was required now,
and he said they need two Palm trees. There was discussion
about the cost of Palm trees. Mr. Fetrow argued that -the
driveway would have to be torn out. Mr. Annunziato advised
that it was not a driveway that would meet the city's
requirements for a commercial building. There was
discussion about the urban design guidelines, roads, and
driveways. Up until tonight, Commissioner Olenik had never
heard they would take money from developers and do it as a
group project. Mr. Golden advised that the urban design
plan says that, but that has not been implemented.
City Manager Cheney said that one thing the P&Z Board said
was for the applicant and the City staff to work out some-
thing that appeared to be reasonable. That was part of
their motion. Mr. Annunziato was saying they should forget

Commissioner Olenik asked why they could not leave the drive-
way that is there today. City Manager Cheney answered that
they could go to the P&Z Board to get a parking lot
variance to allow that driveway, which is an access to the
parking lot, to not be paved to today's standards. After
further discussion by Commissioner Olenik, Mayor Marchese,
and Mr. Agnello about drainage, the parking lot, Boynton
Beach Boulevard, and the possibility of the applicant
incurring unnecessary expense, Commissioner Olenik stated
that he liked City Manager Cheney's idea of a parking lot
variance. City Manager Cheney supposed the applicant could
get a variance with a time limit of three years, a time
limit that related to the implementation of the Boynton
Beach Boulevard design, or no more than five years.
There were further statements by City Manager Cheney and
Commissioner Olenik about the parking lot and the variance.
City Manager Cheney thought the P&Z Board had been
sympathetic to the whole conversation. Mayor Marchese asked
the applicant if he would prefer having this tabled, so he
could come up with an agreeable settlement. Mr. Agnello
replied that he had an April 4th deadline with the Code
Enforcement Board, where he will be penalized on a daily
basis. After repeating prior statements, he added that it
had been grandfathered in over the years. At this point, it
seemed unfair, and he explained. There were statements
about the Code Enforcement Board.

City Attorney Rea interjected that the City could not grant
a temporary parking lot variance because the parking lot
variance would go with the use in perpetuity if that use
would continue. As far as the April 4th deadline for
complying with the Code Enforcement Board, if things were
worked out properly, after the Code Enforcement Board fine
took effect, the Commission could' mitigate or eliminate the
fine, if it chose to.

Because of the change in use, Mr. Agnello was not sure this
would remain as a medical office. He stated that he would
not be surprised if it went back to the general business
use. Commissioner Olenik asked if the dentist there did not
want to stay. Mr. Agnello answered, "Yes," but the dentist
wants more space. There was further discussion about the
application.

Mayor Marchese urged Mr. Agnello to put in the parking spa-
ces and to put up the Palm trees. Mr. Agnello stated that'
he would have no problem in putting up the Palm trees if
the Code Enforcement problem could be suspended until the
urban design plan is adopted. There was discussion about a
variance. Commissioner Weiner did not see any sign of a
hardship.
Motion
Commissioner Olenik moved to approve the site plan to
construct a parking lot to serve a proposed medical office
building on .155 acres, subject to staff comments, noting
the exception of constructing the meandering sidewalk until
such time as it occurs, and.including the Palm trees.
Commissioner Weiner seconded the motion, and the motion
carried 5-0.
There were further comments about where the Palm trees
should be located and a variance.
C. Consider motion to recommend consistency of expanded
c=: redevelopment plan with the City Comprehensive Plan
Over a period of two or three months, Mr. Annunziato said
the P&Z Board reviewed the redevelopment plan and
recommended to the Commission that the redevelopment plan is
consistent with the Comprehensive Plan, subject to the
comments in his memo to the Chairman and Members of the
P&Z Board dated December 8, 1988, as amended by the motion
of the P&Z Board, which he had forwarded to the Commission.
Mr. Annunziato explained to Commissioner Weiner that the
P&Z Board1s actions and recommendations were noted in his
comments to the City Commission. He confirmed Commissioner
Olenik1s statement that they were referring to the current
Comprehensive Plan.

Commissioner Weiner .asked if the parts that the P&Z Board
found to be inconsistent were to be included in the motion.
Mr. Annunziato answered affirmatively and clarified that the
above referred to memo of December 8th was reviewed as being
those areas of the Comprehensive Plan which needed to be
addressed as a result of the redevelopment plan. A lot of
time was spent on each of the land use changes. The P&Z
Board acted in such a way as to find consensus on some of
the land uses with the Comprehensive Plan but following up
with that, Mr. Annunziato said 'he put an item back on the
