Please be advis~d that on Tuesday, April 21, the City Commission
approved the ref.erenced Site Plan Modification, subject to staff
comments, copies of which are attached. After you have amended your
plans to reflect these stipulations, please have the appropriate
Department Heads initial the attached check-off sheet, prior to your I
submission to the Building Department for permits.
The approval of the City entitles you to construct only the
improvements shown on the site plan. _ The site plan will be viewed
procedurally as an as-built or record drawing. Also, all capital
facilities fees and road impact fees, if applicable, are payable at
the "time of permit.
If you have any questions concerning this matter, please do not

When this building was originally permitted, it was classified as
a Business Occupancy. The seating capacity has been increased above
the threshold for Assembly Occupancy and due to this change in
occupancy classification, the entire building must be brought up to
today's Codes for Assembly Occupancy.
The Parking Lot Ordinance requires a clear backing aisle of 27 feet
between the ends of parking stalls. A variance would be required
to decrease this dimension below Code requirements. When the dimen-
sions of the parking area on the rear of the structure are added,
the site plan seems to indicate an existing building setback of
65.7 feet. This is inconsistent. with the dimensions on the survey.
showing a rear setback of 62.9 feet. This inconsistency would
indicate a three foot encroachment onto neighboring property for your
parking area. The survey also shows an existing light pole encroach-
ing and your site plan indicates a proposed four foot walkway encroach-
ing over the south property line. Any use of neighboring property
would have to be approached on a coordinated basis with the owners
of these properties.
The Landscape Code requires a five foot landscaped area along the
front property line, adjacent to the right-of-way.
Table 600 of the Standard Building Code requires that you limit your
glass area on the south elevation .of your structure to a maximum of 20
percent for the setback indicated.
The Countywide Amendments to tbe Standard Building Code requires
three handicapped parking stalls when between 51 and 75 stalls are
provided.
The dumpster wall details should hot have been deleted from your
plans ,as screening is required on three sides of the dumpster.
Additional lighting should.be provided for your rear parking area
to comply with the minimum Code requirement of one foot candle average
illumination.
Railings on handicapped ramps should be provided at 32 inches above
the surface of the ramp.
The following comments are for applicant's information:
In order to facilitate the building permit review process, the following
information should be provided, in duplicate, at the time of plans

structure from the property line. Roof overhangs are not permitted

The existing Bavarian Haus Restaurant is a part of '
"The Forum Shoppes". The existing drainage system
was designed by Michael B. Schorah & Associates, Inc.,',
Consulting Engineers; 1850 Forest Hill Blvd.; West
Palm Beach, Job No. 84-333. This drainage system
consists of the exfiltration system with positive
outfall (outfall structure).'
Proposed extention of the existing restaurant - A
new addition - will require to remove and replace
a part of the existing drainage exfiltration trench,
as shown on the drainqge plan. There is no sub-
stantial change in the amount of storm water flow
from this area.

It has been requested by you that I tender an interpretation as to
the applicability of the Zoning, Code to your project.
One of the comments made at Technical Review Board states "where
rear access is not available from a public street or alley, a side
yard of not less than 15 feet shall be provided on one side". Your
project, as presently proposed, would not be in strict conformance
with this passage. However, access to the rear of the property is
presently available permanently through a dedicated easement that
serves your property, Forum Shoppes property and the bank property.
Also, access can be gained through the adjacent shopping center.
Any effort to erase this access would jeopardize the site plans of
four properties. It is not conceivable that the site planning
process would allow this to occur. Therefore, it is my interpretation
that your property is proposed in accordance with the intent of the
Zoning Code in that there is permanent access to the rear of your
property.
