Dear Mr. Osborne:
Accompanying this letter you will find a copy of the site plan
which was approved by the City Council on Tuesday, April 15,'
1986. These plans were approved subject to your compliance with
the attached stipulations. After you have amended you plans' to

your submission to the Building Department for permits.

Dear Mr. Osborn:
Your letter dated October 15, 1991, indicating to this office that you
would like to break ground on Phase III, has been reviewed, and the site
plan previsou1y approved examined, by the Building and Planning
Departments. They both agree that if penmit drawings are submitted con-
sistent with the 1986 Site Plan Approval, then only penmit review and
approval to construct additional mausoleum units in Phase III will be
rc'qu ired.
Reference concerns expressed relative to the contract language in Section V
of the Agreement between the City of Boynton Beach and Boynton Beach
Mausoleum, Inc., it is the legal opinion of the City Attorney that this
language does not prohibit additional phase construction prior to the 80%
of use, therefore, the construction of additional facilities is penmissib1e.
Regarding your request that the City waive all penmitting and building fees
relative to Phase III, unfortunately, due to the poor financial condition
the City is presently experiencing because of the economy we must charge
appropriate penmitting and building fees. The Building Department, espe-
cially, must pay for itself; in essence, the expenses of the department
must be covered by revenues generated from penmitting and building fees.
You may proceed in an appropriate manner to break ground on Phase III in
the immediate future.

The Boynton Beach Mausoleum would like to break ground on
Phase III in the immediate future. When Phase II was
constructed, former City Manager Peter Cheney requested
that we include Phase III on the site plan application,
since it would be identical to Phase II. In response to
his request, we did include Phase III on the site plan
~hat was subsequently approved by the city. It was Mr.
Cheney#s thought that by including Phase III on the site
plan it would expedite the process when we decided to
construct Phase III.

In addition, we would respectively request that the city
waive all permitting and building fees regarding Phase
III. We feel this to be appropriate and equitable in
that the Boynton Beach Mausoleum is acting as an agent for
the city, the building is located on city property and
upon completion of the construction, the city will own the
building. This is the procedure followed by other
municipalities in similar circumstances.
