Section 5-145(0)(4) of the Code of Ordinances requires that when
a variance to Section 5, Article X, Parking Lots is requested,
the Technical Review Board must forward to the Planning and
Zoning Board a recommendation, and that the recommendation
forwarded is to be .made part of the public hearing proceedings.
. To that end, this memo is forwarded, consistent with 5-145(c)(4).
William L. Osborn, agent for Cynwyd Investments, has requested
two such variances:
1) A variance to Section 5-142(f) "Drainage", which requires
that storm water be retained on site at a capacity of not less
than 2.5 inches of rain fall in one hour. In this instance, the
applicant is requesting that the existing storm water runoff at
the rear of the shopping center be allowed to continue to flow
onto adjacent properties and rights-of-way.

2) A variance to Section 5-142(h)(3) "Driveways", which
requires, in this particular situation, that no driveways
may be constructed closer than 180 feet to the intersection
of the rights-of-way lines on arterial roads. BOYnton Beach
Boulevard is shown as an arterial road on both the City and
County Thoroughfare Plans. In this instance, the applicant
is requesting that a 27 foot wide po~t~on of an existing
driveway be allowed to continue at a d1stance of
approximately 94 feet from the intersecting rights-of-way
lines. Currently, the entire parking lot frontage on
~oynton Beach Boulevard serves as a driveway.
The Boynton Beach Plaza is located at the northeast corner of
North Federal Highway and East Boynton Beach Boulevard extended.
For an explanation of the code requirement, the nature of the
variance requested, and the variance justification, please refer
to the attached Notice of Public Hearing and application.
On Tuesday, June 6, 1989, the Technical Review Board met to
review the plans and documents submitted, and to formulate a
recommendation with regard to the variance requested. After
review and discussion, the TRB recommended approval of the

I subject to the developer submitting a letter of intent to work
with the adjacent property owner, if and when the adjacent
property is developed, to mitigate the existing storm water
runoff onto the adjacent property through the installation of
landscaping, swales, etc., along that portion of the property
boundary where the ordinance requirements cannot be met.
With respect to the recommendation for approval of the variance
to Section 5-142(h)(3) "Driveways", the TRB made findings that
the applicant would be unable to provide access from the main
parking lot to Boynton Beach Boulevard and the existing
signalized intersection with Federal Highway if required to not
have driveways within 180 feet of the intersection of
rights-of-way lines.
With respect to the recommendation for approval of the variance
to Section 5-142(f) "Drainage", the TRB made the fOllowing

The existing narrow service corridor at the rear of the
shopping center is sloped toward the east and south and the

storm water runoff from the roof and parking lot currently
flows onto adjacent property and right-of-way.
There is insufficient impervious area available at the rear
of the shopping center to accommodate the storm water
runoff.
There is an existing 18 inch sanitary sewer main beneath the
paved area at the rear of the shopping center which severely
restricts the opportunity to install french drains or
exfiltration trenches.
A narrow landscape strip is proposed along the east property
boundary which will accommodate som~ of the storm water
runoff; and
The proposed landscape strip should ~e~inverted to capture
as much storm water runoff as is possible.

Storm water shall be contained on
site. Containment capacity shall be
designated for a minimum of two and
one-half (2.5) inches of rainfall in
one (1) hour. Drainage structures and
French drains shall comply with mini-
mum city standards. established by the
city engineer. For impervious areas
exceeding twenty~five .thousand
(25,000) square feet, the design of
the parking lot and facilities shall
be done by an engin~er registered in
the State of Florida, and the plans
submitted shall be sealed. Maximum
storage capacity of soil shall be con-
sidered at the rate of one (1) inch of
water for each six (6) inches of soil
above the water table. Drainage
calculations are required in all
instances. The hydraulic conductivity
of soil shall be determined with tests
made at the site using test procedures
recommended by the South Florida Water
Management District or other proce-
dures which have been approved by the
city engineer.

Boynton Beach Shopping Center
On Tuesday, June 13, 1989, the Planning and Zoning Board, acting
as the Downtown Review Board, conducted a public hearing on two
Parking Lot ordinance variance requests and reviewed an
associated request for approval of a site plan to remodel the
Boynton Beach Plaza (Shopping Center) (see attached minutes).
After conducting a public hearing on the Parking Lot ordinance
variances, the Board unanimously denied both requests. Then the
Board unanimously recommended that the site plan be denied.
Denials of Parking Lot ordinance variance requests by the Board
are not appealable to the City Commission. Given the proposed
site plan design, denial by the Board rendered the project
unbuildable. '
This is the current status.

In our efforts to remodel the Boynton Beach Shopping Center,
located on the corner of Federal Highway and Boynton Beach
Boulevard, we have met many times with the city planners and
other city professionals. We have agreed to meet all of
their demands and followed their advice, only to be rejected
by the variance board.
Firstly, we have reviewed the city building codes and cannot
find any requirement for the installation of drainage as
long as the building size is not altered. We haven't
changed the size of the building, however, we went along
with the requests of the city planners to install drainage.
The front parking lot, 100~ drainage, the rear parking lot
30~ drainage.
The reason for the 30~ drainage in the rear is that there is
a city sanitary sewer line, which runs the entire length of
our property. There just isn't ~nough room for the soakage
pits. At present, the existing condition is 100% runo~f at
both front and rear, and if we cannot proceed, it will
remain as is.
The city planner felt this was adequate and advised us to
apply for a variance. At the meeting, both the city planner
and the assistant city planner were present and spoke in
favor of this and urged approval of the board. It appeared
to be a power struggle as the c.hairman raved and carried on.
When we saw the direction the meeting was taking, we
attempted to have the matter tabled. However, the chairman
forced a vote making derogatory remarks about Cynwyd Invest~
ments.

the center in 1985, but the Downtown Redevelopment Committee
demands would have tripled our costs.
An oddity I must bring to your attention i~ just ,two, days
'after the rejection by the variance board, we were
approached by parties interested in purchasing the center.
A coincidence, maybe.
Our goal is to remodel the center, hopefully you can give me
some advice as to how to proceed and reach a solution
keeping a friendly atmosphere. We will not be selling and
we do wish to proceed.

frontage. Mr. Golden elaborated on the driveways and the
request for variances. ' (See "Addendum A" attached to the
original copy of these minutes in the Office of the City
Clerk. )
The Technical Review Board (TRB) recommended approval of the
variance to Section 5-142(h)(3) "Driveways" as submitted
and approval of the variance to Section 5-142(f) "Drainage",
subject to the comments in Addendum A.
The TRB recommended approval of the site plan, subject to
staff comments.
Mr. Blanchette asked if the City is starting to approve
runoffs from one person's property to another~ Mr. Golden
replied that this situation has existed for many years.
Mr. Blanchette knew the situation had existed, but he ques-
tioned whether the City would be liable in a lawsuit, if the
request is, granted and the storm water continually drains
off onto the property to the east. He thought this was a
time when it should be corrected instead of having it happen.
Mr. Blanchette added that some day, it might be developed if
they get permits. '
Mr. Golden informed Chairman Walshak that the run-off flows
to the east, and some drains toward N. E. '5th Street.
Chairman "Walshak inquired whether there had been any
discuss~ons between the City Engineer, this proper~y owner,
and the property owners to the east. Mr. Annunzitg answered
that there had not been any discussions, and he 'adqed that
the City has had this problem a couple of times be~6re when
the City has had existing shopping centers attempting to
renovate. He stated that it is almost impossible to
redesign the site to accept all of the storm waterlthat is
to be generated. Mr. Annunziato mentioned the shopping .
centers at Woolbright Road and U. S. 1 and recalled that the!
method of design in those days was to spill the water to the
east or to the wetlands. Over the years, the Department of
Transportation (DOT) has attempted to design their storm
water systems to accommodate some proportion of the
adjoining right-of-way.
Mr. Annunziato commented that this was a difficult situation,
especially in the back where it gets so narrow relative to
the property line. Unless they would remove all of the
asphalt behind the shopping center, it is almost a "no win"
situation. Even there, they would be impeded by the
existing 18" gravity sewer main. Mr. Annunziato stated that

all of the cards are stacked aqainst this project, tn terms
of addressing the drainage. - l
Mr. Blanchette pointed out that the City usually re uires
that any water going any place has to be pretreated, and
this is a case where they will allow untreated water to
travel into the mangrove section. In this instance,
Mr. Annunziato said there is some pretreatment of water by
the landscape strip. The City's program for storm water pre-
treatment is to run it through pervious areas. In this
'instance, the undeveloped private property to the east would
be a pervious area.
Mr. Blanchette asked about running it into the DOT storm
drains. Mr. Annunziato did not think there could ever be a
permit to tap into storm drains. Chairman Walshak thought
there should be discussion between the City Engineering
Department, DOT, and the people who have the adjoining pro-
properties to the east before rushing into this. He thought
the Board had discussed at length in the Comprehensive Plan
the dumping of storm water run-off in the upland section of
the wet areas. Chairman Walshak thought it was a "no, no"
then and a "no, no" now. .
William L. Osborn, Architect, 1759 North Andrews Ext.,
Suite 102, Fort Lauderdale, FL 33311, had his Engineer try
to work out something on the drainage in the back, but the
existing parking lot,to the rear slopes three feet from the
building to the property line. There is an existing berm
along the property most of the way, so he did not think too
much water was spilling onto the lot. Mr. Osborn thought
it was going into the public street to the south.
Mr. Osborn showed where they were installing a con~iderable
landscape strip and said it will be swaled down to catch a
lot of water there. He indicated where they will ut addi-
tional swales to pick up water, so they are going 0 pick up
as much water as they can. There is no way to put a catch
basin back there.
Chairman Walshak referred to the landscape area and asked
how they will get the trucks out. Mr. Osborn pointed to the
location of the loading dock and the paved section. He
believed the Winn-Dixie trucks deliver in the front, not the
back.
Mr. Blanchette asked if they considered a retaining wall

build the property up, Mr. Osborn said they would be three
feet above the streets on each side (north and south). ,Mr.
Blanchette realized they would have to drive up to it.

Vice Chairman Collins wondered at what stage they w~re
planning to contact the owners of the property regarding the
drainage. Mr. Osborn, believed the Planning Department
recommended that they submit a letter to the City stating
they would work with the property owners when that property
is developed and put what would be needed there to take care
of the water on both properties. Chairman Wa1shak asked if

they attempted to contact any of the owners. Mr. Osborn had
not. Chairman Walshak noted that some of the owners were
present at the meeting. '
Chairman Walshak inquired whether Mr. Osborn had contacted
DOT. Mr. Osborn answered that he had, only in regard to
widening Boynton Beach Boulevard. DOT replied that there is
nothing in the works at this time. Mr. Osborn asked DOT
about tapping into their drainage system, and they said it
would not be acceptable.
Mr. Osborn told Vice Chairman Coll~ns that the applicant is
retaining probably 70% of the water because all of the water
in front of the property is now draining on the street.
They are going to retain, that on the property and will retain
probably 20% to 30% of the water in the back in swale areas.
Mr. Blanchette asked if Mr. Osborn was talking about french
drains for retention on the front. Mr. Osborn answered
affirmatively.
Mr. Blanchette asked if the water was about four feet below
the surface now. Mr. Osborn thought it was about three feet.
He confirmed Mr. Blanchette's statement that it is
continually being flushed. According to DOT and his
Engineer, Mr. Osborn said they have sufficient retaining for
2; inches on the front property, and he said it is a natural
slope from Federal Highway to the Intracoastal.
Mr. Osborn informed the Members that they plan on spending
in excess of $500,000 remodeling this and have gone as far
as they can. Many studies have been done on the b~ck parking
lot in an attempt to find out what to do. They fi*ally
decided the only thing they could do would be, to put in the
swale areas. I

are not increasing the size of the shopping center at all.
They are just' putting a new front and sides on it,
landscaping and paving.
Mrs. Huckle noticed a lot of additions had been put on the
rear (especially Winn-Dixie> to accommodate different uses.
They looked sort of tacked on, and she wondered if the
additions would remain. Mr. Osborn replied that they plan
on cleaning up the back of the building and repainting it.
It will also be landscaped. '
Mr. Osborn said they are getting rid of the parking'directlY
against the building, so they can have the required fire
lane.

Mr. Howard referred to the percentage of water thatl would
be retained on the site and thought it was a poor'percentage
and bad solution to the problem. Mr. Osborn repeated prior
statements and added that it was a "Catch 22" situation.

Chairman Walshak had no sympathy for the' applicant. He
remarked that the owners of the shopping center must have
made a tremendous amount of money -in the last 10 to 20 years
and have not put a dime into it. Chairman Walshak
expressed how he thought the shopping center looks.
Vice Chairman Collins asked what the colors are in terms of
of the frontage. Mr. Osborn answered that they are gray and
blue. There will be blue ceramic tile on the columns and on
the walls below the windows. The fascia and canopy will be
off white.
Chairman Walshak asked if anyone wished to speak in favor of
the requests, and there was no response. He asked if anyone
wished to speak in opposition to the requests.
Dr. James Weege, Ocean Ridge, Trustee of the 2! acres
directly behind and to the southeast of the Plaza, showed
the location of his property on the overlay and ,said it is
where most of the run-off presently takes place. They have
been trying to keep the lot cleared, are in the process of
cleaning it up more, and they have renewed interest in
developing the property.
Dr. Weege commended the applicant for wanting to renovate
the shopping center. He thought the shopping center was an
eyesore and also thought most of the people in the 'City feel
CJ) this way. Dr. Weege did not think enough was goin~ into the

shopping center, and he thought it was too little too late.
He did not think the City should condone making a bad situa-
tion worse. He understood the parking and run-off were not
up to Code and thought it w6U1d be totally wrong to increase
that violation. I
When the property owners behind the shopping center want to
improve their lot, Dr. Weege asked "why they should have to
deal with the problem that would be created by the City, if
the City condoned this. He totally disagreed with what was
going on here. If there was a prob-1em with run-off, it was
because the buildings were existing and grandfathered in.
Dr. Weege thought perhaps the applicant should consider more
of an investment in redoing the entire piece of property.
At this point, doing what they are proposing to do will not
be good for the City, and it certainly will not be good for
the people behind them. Therefore, Dr. Weege disagreed with
the requests. If the City grants these requests, he thought
the City would have a liability to the property owners
behind the project and anybody else who has a property along
that area. The City would also be liable for any future
problems that might arise from it~

As no one else wished to speak in opposition to thJ requests,
THE PUBLIC HEARING WAS CLOSED. '

Mr. Richter recalled that they had always worked, o~ bonding
certain things. Now, they were coming up with a'letter of
intent, and up to this point the property owners had not
even been contacted. Mr. Annunziato advised that ~onding is
required where public improvements are involved.
Mr. Annunziato informed Dr. Weege that the amount of storm
water is not increasing. It will decrease substantially
(totally in front and about 25% to 30% in the rear) from
what currently exists. Although it will not meet, the speci-
,fic requirements of the City Code even after the proposed
renovation, in situations like this so long as the applicant
is meeting as much of Code as is reasonable, it would be up
to the Board to determine whether the applicant has made a
reasonable attempt to meet the Code requirements. That is
why there is a variance procedure.
Mr. Richter felt any attempt by the applicant would be
an improvement, but he questioned whether,they were doing
enough. He noted they are out of town owners.

Mr. Annunziato asked if the retaining wall mentioned by
Mr. Blanchette would raise the earth and provide for a
greater swale. If they made a swa1e at both the north and
south entrances, the water would not escape out. They
could put a two to three feet retaining wall there ,to bring
it up to the same level it is in back of the building
itself. A swale could be put there to separate it from the
rear. Mr. Blanchette thought that then, they would probably
eliminate any run-off. If he made a motion tonight,
Mr. Blanchette said he would move to deny the request until
such a'proposal was brought back.
Chairman Walshak asked if the decrease of 25% to 30% of the
run-off would be because of the landscape area in the rear.
He noted big tractor trailers go in there, and he felt that
landscaping would be there for a year and would be gone.
Chairman Walshak reminded the Members that this is in the
Central Business District (CBD) , and he repeated prior
statements.
Chairman Wa1shak wanted to see more of the building
addressed, and he voiced his objections to the drainage and
the appearance of the property. '
Vice Chairman Collins asked for Mr. Osborn's opinion of the
recommendation made by Mr. Blanchette. Mr. Osborn replied
that it was possible. They would still have some run-off to
the south and the north because they will have a slope in
their driveways. He agreed that the run-off would be a lot
less than it would be with what they were now:proposing.
By going south, Mr. Blanchette said the run-off would be
running on the right-of-way. Mr. Osborn agreed. '
It seemed to Mrs. Huckle that this was an enormous building
for the site. She asked if anyone thought of choppfng off
each end of the shopping center to make an adequatejpro-
visions for drainage an~ to make the building more amenable
to the site. Mr. Osborn answered that would be a discussion
with the owners, and he added that cutting off some of the
building on the north and the south would not decrease the
drainage.
After further discussion, Vice Chairman Collins felt the
Architect should try to work out something with the City in
terms of a maximum drainage situation. That was what he
wanted to see. Chairman Walshak thought Vice Chairman
Collins' thinking was logical. He reminded the Members of

eventually run down completely. When a shopping center gets
into that state of disrepair, people stop going there. The
owners want to maintain the present square footage. Chair-
man Walshak elaborated.
Chairman Walshak suggested that Mr. Osborn work something out
with the City Engineer. He had no problem with the drive-
ways, but he thought the Board should take a look at that ,
Section in the downtown area and drop the 180 foot require-
ment down to something reasonable in the CBD because of the
close proximity of streets in the CBD. Chairman.Walshak
emphasized that something has to be done about the drainage.
Mr. Howard suggested that the applicant have its own
Engineer instead of the City Engineer doing the engineering.
He thought the applicant should come in with a new plan.
Mr. Annunziato apprised the Members that an Engineer that
works for the applicant designed this system. There was
discussion.

Mr. Zimmerman asked how much of the back of the building is
grandfathered in. Mr. Annunziato answered that the property
is nonconforming and can continue as it currently exists
indefinitely until the building is condemned. Because of
some crumbling elements of the facade, the applicant is
under Code Enforcement action. There was further discussion.
Mr. Osborn asked if the Board would agree to putting off the
drainage item and just voting on the driveway. They can
then work with the Engineering Department on the drainage and
come back. Chairman Walshak had a problem with that. Mr.
Blanchette stated that he would go along with the variance
for the parking, but he would not go along with the rest.
Mrs. Huckle asked if Mr. Osborn wanted to withdraw the site
plan request. Mr. Osborn answered that he would be with-
, drawing the variance for the drainage. If they could figure
out some way to retain 100% of the water, they would not
have to ask for a variance.

Personally, Chairman Walshak did not like the site plan.
Mr. Annunziato was concerned about the applicant withdrawing
one variance request. He preferred that the Board table
its action on all accounts and let the applicant address the
issue of drainage along with the site plan and come back to
the Board next month. Mr. Annunziato explained that it
would be difficult to extract one portion of the variance
because it could affect the site. Also, the plan recommended

for approval might not be the same plan that will be
developed.
Chairman Walshak wanted everyone in the city to hear how the
Board felt about this issue.
Motion - Site Plan
Mr. Blanchette moved to DENY the request for site plan
approval, seconded by Mrs. Huckle. Motion carried 7-0.
