Downtown Review Board Meeting - December 12, 1989
After conducting a public hearing, unanimously approved
the Boynton Beach Plaza parking lot 'variance to Section
5-142(h)(3) "Driveways" of the Parking Lot RegUlations
as submitted. The motion to approve was made by Mr.
Blanchette and seconded by Mr. Lehnertz.
Unanimously approved the request for Appeal of
Administrative Decision to the CBD landscape
regulations for a reduction of the 3 foot wide
landscape strip at the rear of the supermarket to 2
feet for a distance of approximately 50 feet. . T,he:-
motion to approve was made by Mr. Richter and'secondeh
by Mr. Collins.
3. Unanimously recommended approval of the Boynton Beach
Plaza site plan to allow for elevation changes and
parking lot improvements to an existing 48,700 square
foot shopping center on 3.96 acres. The motion to
recommend approval was made by Mr. Lehnertz and
seconded by Mr. Howard.

Accompanying this memorandum you will find a copy of the
application and related documents for the above-referenced
request. This is a resubmittal of a previous request on ,which no
, action was taken due to the denial of a variance for on-site
drainage. Denial of the drainage variance precluded approval of
the driveway variance and site plan. Also included is a check in
the amount of $400 to cover the review and processing of this
application.
The applicant has not yet submitted a copy of the site plan and
survey. Copies of these documents will be forwarded to your
office in the near future.
Please advertise this request for a public hearing before the
Downtown Review Board at the December 12, 1989 meeting.

Section 5-145(c)(4) of the Code of Ordinances 'requires that when
a variance to 'Section 5, Article X, Parking Lots is requested,
the Technical Review Board must forward to the Planning and
Zoning Board a recommendation, and that the recommendation
forwarded is to ,be made part of the public hearing" proceedings.
To that end, this memorandum is forwarded, consistent with ~
5-145(c)(4). ,I,
William L. Osborn, agent for Cynwyd Investments, has requested a
variance to Section 5-142(h)(3) "Driveways" which requires, in
this particular situation, that no driveways may be constructed
closer than 180 feet to the intersection of the rights-of-way
lines on arterial roads. Boynton Beach Boulevard is shown as an
arterial road on both the City and County Thoroughfare Plans. In
this instance; the applicant is requesting that a 27 foot wide
portion of an existing driveway be allowed to continue. The
driveway is to be located at a distance of approximately 94 feet
from the intersecting right-of-way lines. Currently, the entire
parking lot frontage on Boynton Beach Boulevard serves as a
driveway. '
The Boynton Beach Plaza is located at the northeast corner of
North Federal"Highway and East Boynton Beach Boulevard extended.
For an explanation of the code requirement, the nature of the
variance requested, and the variance justification, please refer
to the attached Notice of Public Hearing and ,application.
On Tuesday, November 7, 1989, the Technical Review Board met to
review the plans and documents submitted and to formulate a
recommendation with regard to the variance requested. After
review and discussion, the TRB recommended approval of the
variance request as submitted. This recommendation was based on
he following ,findings:
1) That the applicant would be unable:to provide access
from the main parking lot access aisle to Boynton Beach
Boulevard and the signalized intersection with Federal
Highway if required to not have driveways within 180
feet of the intersection of the right-of-way lines; and
2) The entire shopping center frontage on Boynton Beach
Boulevard currently serves as a driveway and the
proposed location, width and design of the driveway
represents a substantial improvement in traffic flow
and control as compared to the existing 'situation.
