Section 5-145 (C)(4) of the Code of Ordinances required that when a
variance to Chapter 5, Article X, Parking Lots is requested, the Technical
Review Committee must forward a recommendation to the Planning and
Development Board. The recommendation is to be made part of the public
hearing proceedings. This memorandum is forwarded to you, consistent with
Section 5-145 (c)(4).

Craig Livingston, agent for the owner, has requested a variance to Section
5-142 (h) (3) and (7) "Driveway" of Article X-Parking Lots. Section 5-142
(h) (3) states, among other things, that "no parking lot driveway may be
constructed closer than one-hundred eighty (180) feet from the intersection
of the right-of-way lines along "collector or arterial roads" as shown on
the city or county thoroughfare plans. II Section 5-142 (h) (7) states, IINo
more than two (2) driveways shall be permitted from any property. Where
properties abut more than one (1) public or private right-of-way,
additional driveways may be permitted depending upon traffic volumes, but
in no instance shall the number of driveways exceed two (2) on each
street." In this particular instance, the applicant is requesting approval
to allow a second driveway, to the site from Federal Highway and said
driveway be one-way into the site. The proposed driveway is to be located
on Federal Highway and one-hundred sixty-two (162.00) feet south of the
S.E. 5th Avenue intersection. The intersection is non-signalized. The
closest driveway to the proposed driveway is located approximately ten (10)
feet north and is on the adjacent property (Benson's Restaurant). The
accompanying site plan drawing illustrates the location of the proposed
driveway. Additional details concerning the nature of the requested
variance and the variance justification are outlined in the attached Notice
of Public hearing and Parking Lot application form.

On Tuesday, April 28, 1992, the Technical Review Committee (TRC) met to
review the plans and documents submitted for the variance. After review and
discussion, the board made the following recommendation regarding the
variance requests:

The Committee unanimously recommended that the request for an
additional one-way, right-turn only driveway, into the site
from Federal Highway be approved with the condition that when
the property owner submits drawings depicting future development
to the site that the location and number of driveways and on-site
traffic patterns be re-evaluated.
If the Board rules in favor of the variance requests, the Technical Review
Committee encourages the Board to include the previously identified
condition as part of the approval. The Technical Review Committee feels
that the condition is a safeguard to eliminate the possibility of traffic
hazards that may result from the future development proposed for the site.
Approval of the variance would require the applicant to receive approval of
a minor site plan modification to implement the proper usage of the new
driveway. The modification process would require the applicant to submit
working drawings showing the installation of the driveway, landscaping,
traffic control signage and pavement markings consistent with the
requirements of the applicable codes.

Justification for Variance Request
This request for a variance is based on the following:
1. Special conditions exist which are peculiar to this
property in that this entrance is an existing curb cut
that has been used without any reported accidents, and
is used mainly by large incoming vans for delivery. The
other entrance to the site (the southerly curb cut) is
a sharper 90 degree entrance that is extremely unsafe and
difficult for the large vans to negotiate.
2. A literal interpretation of the provisions of this ordinance
would deprive the applicant of rights commonly enjoyed by
other properties in that this is an existing curb cut that
staff is requiring be closed, the property to the immediate
north would retain a similar curb cut.
.
3. Special conditions and circumstances of this existing curb
cut are not the result of any action from the applicant in
that the property was purchased by the applicant in this
condition.
4. Granting this request will not confer any special privilege
on the applicant in that he already has been using this
entrance for two years, by eliminating the curb cut he may
be exposed to a liability from large vans attempting to
enter the site and from any traffic hazard presented by the
inability to safely enter the site.

Re: Boynton Motel
Dear Mr. Cutro:
The existing plans for the proposed Boynton Motel Addition
presently show the elimination of the north driveway along Federal
Highway.
In rethinking this elimination, we believe this would create a
hardship on our motel business. Approximately 95% of all our
clients use this first driveway to enter our motel, and the
southern drive as the exit. We want to leave the site as it is.
In contacting certain authorities regarding the motel, we have
found that no accidents or violations have been attributed to
having the two driveways. To resolve this matter, one suggestion
was to make the southern drive an exit only, and the northern
drive the entrance only. This would be an excellent idea.
As always we woulu like to cooperate with the city and welcome any
further comments or suggestions regarding this matter.

Dear Mr. Cutro;
Please find enclosed our application for a variance for the above
referenced project. Please note that our request regards keeping
the existing north entrance into the site. We have very large vans
making deliveries into our site, and they are unable to negotiate
the sharp turn into the southern entrance.
We have met with the City of Boynton Beach Police Department and
were told that no traffic accidents have ever been reported our
entrance, and we feel this more than justifies our request to
maintain it in its present condition.

The following is a list of deficiencies made in response to the
submission of amended plans and/or documents for the above
referenced parking lot variance that were received by this office
on April 10, 1992. Note: All information and documents must be

1. Show and specify on the site plan the overall distance from
the north edge of the proposed driveway to the south
intersecting line of S.E. 5th Avenue and u.S. #1.
2. Specify on the site plan the distance from the north edge of
the proposed driveway to the north property line of subject
property. A landscape strip with a minimum width of 2.5' is
required.
3. Complete the first response required on page 3 of the
application.
4. 'Complete the second response,required on page 3 by
specifying the code required distance in feet that the
driveway shall be located from the intersection and the
distance in feet that the applicant is requesting the
proposed driveway be located from the intersection.
5. I recommend revising the statements of justification for the
variance to align with the variance procedures identified in
