Please be advised that Tuesday, l7 September, 1985, City Council
approved both the requested conditional use and the site plan for
Bud's Chicken and Seafood Restaurant. This approval, and approvals
received previously from the Community Redevelopment Agency and the
Do~ntown Review Board, &lZow you to apply for a building permit
after complying with all Technical Review Board and other reviewing
bodies commentary, excepting only matters pertaining to pedestrian
or parking lot lighting, periferral sidewalk\treatment, and amenities
such as benches and waste receptacles. ,These listed specifics have
been isolated from the site plan approval, pending Downtown Review
Board's. establishment of appropriate standards.
Currently, the ,Downtown Review Board is in process of studying lighting
and: street amenities, and the landscape architect contracted by Com--
munity Redevelopment Agency is preparing plans that will embody speci-
fications for these matters, sidewalk treatments and landscaping.
When this work is complete, you will be notified concerning how to
comply with set standards, as you assured City Council, Community
Redevelopment Agency, and the Downtown Review Board during the reviews
and! processing of your applications. I
Specifications of such details should not, to my knowledge, cause any
delay in your receiving a building permit. Should the issues not be
determined by the time your permit is available, it is my understanding
that you could begin construction, planning to have final approval on
these isolated aspects before construction enters the phase of their
installation.

Dear Mr. Howell:
During last night's meeting of the Community Redeve10pemnt Agency (CRA),
Commissioners reviewed the materials from Downtown Review Board (DRB) and
the Technical Review Board (TRB) conducted by Chief Plans Inspector Don
Jaeger, concerning final details of Bud's Chicken & Seafood Restaurant,in
the downtown Central Business District (CBD).
Commissioners found the questions involving this project resolved and, by
unanimous,vote, determined to accept the DRB and TRB recommendations to
approve the resolutions reached during.the March DRB meeting.
The C~~ also received a DRB report concerning Barnett Bank's request to
install an automatic teller at its Federal Highway address in the CBD.
and the accompanying TRB report noting a need for handicapped access to
this teller. As DRB's report to CRA recommended, the Commissioners deter-
mined to approve this project, subject to staff comments on Revision Plan
007 (indicating handicapped parking space, sign, and ramp placement and
construction), as reviewed and approved by DRB and Mr. Jaeger during the
March DRB meeting. A unanimous vote confirmed Commissioners' approval.
All draWings and plans for the bank teller and handicapped facilities are
with Mr. Jaeger~ and a form signed by Agency Commissioners is attached to
this letter, with a copy of the letter and form being sent to Mr. Jaeger.
Also attached are DRB REPORT forms, signed by Chairman Virginia Foot, for
both projects noted in this letter. In the future, CRA will comply with
code-required application processes via a form ,similar to that of the DRB,
which was produced by the CRA Office~

The Community Redevelopment Agency reviewed this project
during its September 5 meeting; both Downtown Review Board (DRB)
and Technical Review Board (TRB) previously reviewed the project.
City Council is slated to review and/or approve both conditional
use and the site plan during its meeting scheduled for Tuesday,
September 17.
, The attached letter from CRA Chairman Henry Thompson con-
stitutes ~he required written report from the agency to Council.

ably on both conditional use and the site plan.

The Boynton Beach Community Redevelopment Agency (CRA) voted
unanimously Thursday, September 5; 1985, to grant the requested drive-
through-restaurant conditional use for this initial Central Business
District (CBD) project.
The agency also reviewed the -site plan for this project, including
reports from the City Technical Review Board (TRB) and the DowntoWn
Review Board (DRB), as well as the determination reported from the DRB
meeting held immediately prior to the September 5 CRA meeting.
While- CRA voted unanimously to approve the site plan, it did so
subject to DRB's explicit request to isolate from this approv~l all '

issues relating t,-, ~'edestrian and parking lot lighting, pending DRB' s
,
- further study and recommendations on .this aspect of the plan.
Further, CRA approval was granted subject to the following DRB
comments:
"a. Dumpster pick up to meet the satisfaction of Mr. Richard
Walke, Director of Public Works, in connection with the
closing, not abandonment; of N.E.' Fourth Street. The
attached letter from Mr. Walke, of August 22, suggests
2 alternatives to handle this situation;
* - b. Wood posts to be lO-foot high for'pedestrian lighting,
with a spherical top fixture;
* - c. Parking lot lighting to be 16-foot aluminum posts; .
d. Street furniture style and type of wood to be selected
by DRB at a later date, and DRB to ,notify you. of the
selections;
e., If bongossi wood is used for street furniture, DRB asks
you to stain wood post of pedestrian lighting to match;
* per DRB request, Sept. 5, lighting issues isolated from approval
pending further study.

Further, this site plan approval was granted subject to TRB comments
except where lighting is concerned, as lighting is an issue still pending
DRB determination.
The agency noted, during the site plan review, that the applicant
also requested a parking lot variance, concerning the exit onto Boynton
Beach Boulevard, and that DRB granted this variance August 22, 1985, subject
to TRB comments.
We would like to report to you that the agency also joined DRB in
commending co-owner Michael Brinkman and architect Brian D. Idle for their
dedication to CBD "Design Guidelines" when they created plans for this project.
As the initial CBD development, we believe the adherence to and concern for
the Co~unity Redevelopment Plan and "Design Guidelines" will have a favorable
impact on other developers and redevelopers who will, as a matter of course,
look to this project for design precedents.
The Community Redevelopment Agency respectfully recommends that
Council members also approve this project su Ject to the above comments.
