ABANDONING A TEN (10) FOOT WIDE UTILITY
EASEMENT (CRANBROOK LAKE ESTATES); SAID
PROPERTY · BEING MORE PARTICULARLY
DESCRIBED HEREIN; AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A DISCLAIMER
FOR SAID EASEMENT; PROVIDING THAT THE
ATTACHED DISCLAIMER BE RECORDED IN THE
PUBLIC RECORDS OF PALM BEACH COUNTY,
FLORIDA; PROVIDING AN EFFECTIVE DATE;
AND FOR OTHER PURPOSES.

WHEREAS, Lawrence J. Marchbanks, Esq., agent for David
M. Gaudette and Joan Gaudette, owners of said property, has

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1:
The City of Boynton Beach, Florida, by
and through its City Commission, does hereby abandon a
certain ten foot (10') wide utility easement, located in the
City of Boynton Beach, Florida and attached hereto as
Exhibit "A".
Section 2:
The Mayor and City Clerk are hereby
auth6rized and directed to execute and deliver the attached
Disc;laimer and cause the same to be filed in the Public
Records of Palm Beach County, Florida.

Lot #67, Block 2, Cranbrook Lakes Estates
2665 S.W. 23rd Cranbrook Drive, Boytnon Beach, Florida
The Engineering Department herein provides the following
information to you, for the purpose of reactivating the above
referenced abandonment request.
1. Transmittal memorandum from Southern Bell Engineer, Chuck
Lonsdale dated 3/27/90 containing copies of abandonment
acquiescence letters dated December 27, 1990 and March 13, 1990;
2. Photocopy of recorded Right-of-Way Easement; and,
3. Relocation authorization letter dated February 27, 1990,
signed March 20, 1990; and,
4. Recorded release of utility easement; and,
5. Easement abandonment acquiescence letters dated December 1989,
January 1990 and March 1990.
The applicants' prior abandonment attempt was never finalized by
the previous administration and in light of the'time interval the
applicant has waited, I respectfully request you promptly
reactivate the abandonment procedure for immediate consideration
and advertizing. I am coordinating this effort with the
applicant's attorney and I promised him I would bring this matter
to a timely close for his clients. The Engineering Department
in conformance with Chapter 22, City of Boynton Bea~h Florida, code
of Ordinances, has no objections to the abandonment.

A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
ABANDONING A TEN (10) FOOT WIDE UTILITY
EASEMENT (CRANBROOK LAKE ESTATES); SAID
PROPERTY BEING MORE PARTICULARLY
DESCRIBED HEREIN; AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A DISCLAIMER
FOR SAID EASEMENT; PROVIDING THAT THE
ATTACHED DISCLAIMER BE RECORDED IN THE
PUBLIC RECORDS OF PALM BEACH COUNTY,
FLORIDA; PROVIDING AN EFFECTIVE DATE;
AND FOR OTHER PURPOSES.
WHEREAS, Lawrence J. Marchbanks, Esq., agent for David
M. Gaudette and Joan Gaudette, owners of said property, has
requested the abandonment of the hereinafter described ten
foot wide utility easement; and
WHEREAS,
comments have been solicited from the
appropriate City Departments; and
WHEREAS, public hearings have been held before the
City's Planning and zoning Board and the'City Commission on
the proposed abandonment; and
WHEREAS, based on the foregoing information, the said
road no longer serves any useful purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1:
The City of Boynton Beach, Florida, by
and through its City Co~ission, does hereby abandon a
certain ten foot (10') wide utility easement, located in the
City of Boynton Beach, Florida and attached hereto as
Exhibit "A".
Section 2:
The Mayor and City Clerk are hereby
authdrized and directed to execute and deliver the attached
Disc;laimer and cause the same to be filed in the Public
Records of Palm Beach County, Florida.
