SUBJECT
As a condition of site plan approval, the following comments should
be incorporated into the related documents by the applicant:
1. The free-standing sign is shown in a drainage easement. Please
clarify this detail.
2. The buffer wall, as presently shown, is encroaching into the Lake
Worth Drainage District easement in the northeast section of the
pror-:;rty. Their written approval of this condition is required
prior to permitting this wall.
3. Parking stalls should be double striped in accordance with City
Codes. Handicapped stalls require double striping, four feet in
width; 1.5 - 2 feet for normal stalls. Wheel stops should be two
feet from the end of an 18 foot stall. City Code requires curbing
around all landscaped areas, adjacent to parking stalls.
4. Landscaping adjacent to the right-of-way must be 36 inches at the
tlrr.ci of planting'.
5. Side walks in the right-of-way must continue through the turn out
and be ramped for handicapped accessibility.
6. All documents prepared by design professionals for public record
must be signed and sealed.
7. Sidewalks should be provided to encourage safe pedestrian circula-
tion from the right-of-way into the site.
8. The 15 foot alley behind the commercial building should be desig-
nated 'one-way' from west to east to allow for safe garbage pick
~up and vehicular travel.
9. There are no provisions in the current Sign Ordinance for signage
~n P.C.D. .Zoning Districts. All anticipated sign areas should be
included in the present plans for Community Appearance Board,
Planning and Zoning Board and City Council approval.
Many of these comments are being made for the third time.
The following information is for the applicant's information:
In order to facilitate the building permit review process, the following
information should be provided, in duplicate, at the time of plans
submittal:
1. Copies of the South Florida Water Management District approval and
Lake Worth Drainage District approval for site construction.
2. Copies of signed and sealed soil tests and State Energy Code
compliance forms.

Attached please find the results of one exfiltration test performed at
the above referenced project. Verbal authorization for our work was
received from you on March 27, 1986.
The exfiltration test was performed on March 28, 1986 in general
accordance wi th gui del ines publ-i shed by the South Florida Water
Management District for the "Usual Open Hole Test". The test location
was approximately 50 feet north and 100 feet west of the southeast
. . 'property corner, at the location chosen by yourself.

~he purpose of this letter is to'follow up on our conversation of
r:~y 5, 1989 concerning the Sunny Gourmet restaurant at the Cross
~~eek shopping center and the shopping center in general. To
reiterate, the City's zoning code will allow for the expansion of
uses into the sidewalk area, consistent with the availability of
parking and continuation of safe pedestrian access on the
walkway. Because other tenants may be desirous of serving or I
displaying outdoors, it will be necessary to balance potentially
conflicting desires against available parking. In order to
determine parking available for expanded retail and service uses,
I suggest that you refer this matter to the project architect and
;: have him evaluate the relationship between parking required for
the existing shopping center configuration versus the expanded
configuration. If surplus parking is avai1able~ it is further
suggested .that the architect outline areas on the paved walk for
use by the shopping center tenants. When completed, these plans
should be submitted to the Planning Department for review by the
,City's Technical Review Board. .

Please place the referenced item on the City Council agenda for
March 17, 1987 under Development Plans. . '<J
DESCRIPTION: 'Kevin McGinley, Land ~esearch Management, Inc.,
agent for Steven Rhodes, Trustee, D. R. Associates, has requested
site plan approval to construct a 35,000 square foot Planned
Commercial Development consisting of a 20,000 square foot
commercial building and a 15,000 square foot office building on
4.715 acres to be located on West Boynton Beach Boulevard at LWOD
E-4 Canal, northwest corner.
RECOMMENDATION: The Planning and Zoning Board recommended
approval of this request, subject to staff comments, copies of
which are attached. Additionally, the Board has requested that
the applicant screen the roof top and mechanical equipment. They
also have requested that the Community Appearance Board consider
the aesthetics of the building in relationship to the other
structures in the area.
EXPLANATION: The motion to recommend approval of this request
was made by Mr. Schultz and seconded by Mr. Pagliarulo, with Mr.
Ryder dissenting.

As a pre-condition to resubmit plans for site plan approval, the
following comments should be incorporated into the related documents
by the applicant:
1. The site plan does not indicate an existing utility easement
along Boynton Beach Boulevard. The free-standing sign cannot
be constructed in this easement without written approval from
the ~pp1icab1e utility departments.
2. The masonry buffer wall should be constructed two feet off the
east property line. Show construction details of the wall on the
p1an~. If an access road is required, a gate should be installed
along the buffer wall. Show details of the gate on the plans.
The wall, as presently shown, is encroaching into the Lake Worth
Drainage District easement. Their written approval is required
prior to permitting this wall.
3. South Florida Water Management District and Lake Worth Drainage
District approval is required.
4. Show details on dumpster pad and enclosure, including construction
details of the walls and gate.
5. City Code requires curbing around all landscaped areas adjacent
to parking stalls.
6. Parking stalls should be double striped as per City Code.
Handicapped stalls require double striping, four feet in width;
1.5 - 2 feet for normal stalls. Wheel stops should be two feet
-from the end of an 18 foot stall.
7. Handicapped ramps should be shown adjacent to the parking stalls.
8. Handicapped stalls should be marked with adequate signage.
9. "All awnings must be engineered for 120 mile per hour wind loads.
10. Doors on the rear of the building should not open into the
traffic lane. Show details.
11. Show details on how the tenant separation will be maintained at
the skylights. Skylights must comply with Section 707 of the
Standard Building Code.
12. Landscaping adjacent to the right-of-way must be thirty-six
inches (36") at time of planting.
13. Department of Transportation turn out permit is required.
14. Fire lanes are required per City Code.
15. Site lighting should be designed to withstand a 120 mile per
hour wind load. Show on plans. Light poles should be protected
from vehicular traffic behind the retail building.
16. The fence shown on Sheet A-3 is not indicated on the site plan.
17. The buffer wall is shown constructed on top of catch basins and
conflicting with other drainage details.

This memorandum is in reference to the landscape plan for the
above project. The following comments should be addressed by
the applicant:
1. The hedge material along Boynton Beach Boulevard must be
36" in height at the time of planting.
2. .All interior parking lot trees must have a clear trunk
of 5' at time of planting.
3.. The dumpster must be enclosed on three sides with a
visual barrier.
4~ The variety of landscape materials do not meet the re-
quirements of the revised "Boynton Beach Comprehensive
Plan Addendum, November 19, 1986", pg. 4,5. The appli-
cant should review these pages and make changes accord-
ingly in the landscape plan.
