Parking Lot Variance
Section 5-144(c)4 of the Code of Ordinances requires that when a
\.variance to Section 5, Article X, Parking Lots, is requested, the
'Technical Review Board must forward to the Planning and Zoning
Board a recommendation, and that the recommendation forwarded is
to be made part of the public hearing proceedings. ._To..that end,
this memo is forwarded, consistent with 5-144(c)4.
~
Capstone, Inc., agent for the First Church of Christian
Scientists, has requested a variance to Section 5-142(g), Parking
Lot Construction, which states the construction standard required
for parking lots. For an explanation of the Code requirements,
the nature of the variance and variance justification, please
refer to the attached application and Notice of Public Hearing.
On Tuesday, June 6, 1989, the Technical Review Board met to
review the ,plans and documents submitted, and to formulate a
recomendation~with regard to the variance requested. After
review and discussion, the Technical Review Board recommended
that the variance request be approved for the following reasons:
(1) The surface type requested .for the expanded paved area
is the same surface that was". granted a variance by the
Planning and Zoning Board on February: 16, 1984 for the
existing parking area at the front of the church.
(2) Because the existing parking area in the location of
of the proposed expansion was not built according to
the site plan that was approved with the original
variance, traffic congestion has resulted during peak

The standard construction consists
of six (6). inches of compacted, Palm
Beach County approved shell 01" lime
rock on a compacted sub-grade. The
rock shall be compacted to 98Y. of
-maximum dry density as determined
by AASHO T-180. The shell l"ock shall

a minimum calcium carbonate content

and recommendation to the Planning and Zoning. Therefore, it is
recommended that the public hearing for the above-referenced
request be continued to the June 13, 1989 meeting at 7:30 P.M.
Please note that because the cost of the parking lot/site
improvements proposed is under $100,000 in value, the site plan
modification request does not require review by the Planning and
Zoning Board and City Commission; only administrative review by
the Technical Review Board is required. Should the site plan
application and plans for small project review be received no
later than May 24, 1989, this request can be reviewed
simultaneously with the parking lot variance request at the June
6, 1989 Technical Review Board Meeting.

Mr. Gustafson said that the granting of an easement was the
intention. This was being done because it seemed to be easier
than paying to have the wire removed.
The public hearing was closed as there was no one to speak in
favor or in opposition to this request. Mr. Wandelt made a
motion to recommend approval of this abandonment request, and
Mrs. Bond seconded the motion, subject to applicant granting an
easement to Florida Power & Light.
The motion carried 7-0.

LEGAL DESCRIPTION:
In addressing this issue, Mr. Annunziato commenced by saying that
this church has recently added a facility, and the parklng that
has been added conforms to the current codes, however, the driveways
and parking that existed did not conform with current code require-
ments. In speaking of the code, Mr. Annunziato said that when an
addition is constructed and the intensity of the facility is increased,
all driveways and parking lots are to be brought up to current
standards.

The applicant, he continued was asking to be relieved of this re-
quirement of improving that portion of the driveway and parking
lot that exists which is gravel.
The Technical Review Board Mr. Annunziato said, did not recommend
approval of this request. This denial was based upon the fact that
no adequate substitute was.proposed. He went on to say that there
were alternatives, however, none were presented by the applicant.
