Dear Mr. Fetrow:
Please be advised that on Monday, November 6, 1989, the Community
Redevelopment Agency for commercial redevelopment approved the
site plan application for the above referenced property subject
to staff comments, copies of which are attached. In addition, on
Tuesday, October 10, 1989, the Downtown Review Board approved the
parking lot variance and the Central Business District landscape
appeal requested.
These plans were approved sUbject to your compliance with the
above stipulations. . After you have amended your plans to reflect
these stipulations, please submit two copies of final plan
drawings with the changes incorporated to the Building Department
for permitting purposes.
The approval from the City entitles you to construct only the
i~rovements shown on the site plan. The site plan will be
v~ewed procedurally as an as-built or record drawing and is valid

Upon review of the above mentioned project, the following
comments must be addressed in order to conform with Boynton Beach
City Codes:
1. Show on plans three feet (3) wide perimeter strip
landscaping.
2. Show on plans perimeter strip landscaping plantings spaced at
eighteen (18) inches on center.
3. Show on plans rear property landscape strip covered with 70%
of landscape material excluding lawn grass.
4. Show on plans concrete dumpster pad of at least 100 square
feet.
5. Show on the plans required dumpster enclosure landscaping.
6. Required lawn grass is st. Augustine turf grass sod.
7. Appeals to the Landscape Code must be heard by the Downtown
Review Board.

Gentile Commercial Building - Appeal of Administrative
Decision
Attached you will find a copy of the application for an Appeal of
Administrative Decision from the Boynton Beach Landscape
Ordinance. These requests are normally reviewed by the Community
Appearance Board. However, within the Central Business District,
the Code of Ordinances requires that these requests be approved
by the Downtown Review Board (Article III, Section 7.5-58).
Apparently, this section of the Code: of Ordinances was overlooked
when the original Downtown Review Board was disbanded. The
Communi ty Appearance Board should i be reviewing requests for
landscape appeals, as they are empowered to review landscaping in
all areas of the City, including the Central Business District.
The CBD landscape regulations require that perimeter landscape
strips shall be at least three (3) feet wide (Section 7.5-57(c)
a.1 of Article III). Elsewhere in the City, perimeter landscape
strips are requireq.. to be two and one-half feet wide. The
applicant is requesting to be allowed to provide a two and
one-half foot wide landscape strip instead of a three foot wide
landscape strip, as the property does not have sufficient width
to accommodate both the landscaping. and the forty-five foot wide
pavement for parking and access required by Article X, Parking
Lots. For an explanation of the code requirement, the nature of
the appeal requested and the applicant's justification, please
refer to the attached application.
Staff recommends that the variance request be approved as
submitted. The basis for this recommendation is the justifi-
cation provided by the applicant on the application form.

The owners of the property at.419 North Federal Highway recently
approached the planning and Zoning Department regarding setting
up a church at the above address. Our review indicates that
while the use is acceptable under the zoning code, the location
is within 1,000 feet of a liquor store. A 1,500 foot separation
is required.
There is no procedure that exists to vary this requirement and
forwarding such application to the Board of Adjustment would be
improper.
We believe that the question of reciprocity will be a problem
from time to time especially in the older sections of the city
when general purpose buildings that could be used for many
different uses are within the radiui of some special use.
The City Commission should first decide if it wishes to grant
relief to Mr. Gentile, the owner of 419 North Federal Highway.
From a use point of view, and in light of the fact that another
church is a similar distance from the liquor store, staff does
not believe that the church would have an adverse effect on the
other uses around it.
The second question for the City Commission to consider is
whether or not they wish to set up a review or appeal process
that would review requests for reductions of distance
requirements between uses.
This item has been scheduled for City Commission consideration on
April 21, 1992.

Dear Sir,
I am writing to you,upon the instruction of the city's planning
director Chris Cutro. He has reviewed my requset to set up the
Pentecostal City Mission and found that we meet all the requirements
but are within 1000 ft. of a liquo~ store.
lam requesting from either you, the city manager or the city com-
mission to wave the resiprosity requirement am to allow the Mission
to use the space at 419 N. Federal 'Hwy.
This property is located directly across from a Catholic Church
which is within the same distance as we are and has opperated for
years without any problems.
I would appreciate any help you could give me in my request or getting
the request on the city commission adgenda.
The building has been empty for over a year and this has been the
first interest I have had in rentJng the property in six months.
I also have gone to great expence in the installation of a city

This project is located in the Central Business District and must
meet the landscape guidelines for this area of the city.
1. Trees planted must be 30' o.c..
2. Perimeter landscape strips must be 3' wide.
3. Trees must be 12' height, 3" caliper, and have 6' clear
wood.
4. Ficus species of vegetation are prohibited from being
planted.
5. Shrubs/hedges specified must be 24" in height.
6. The type of sod used should be noted.
7. The road R.O.W. should be sodded and receive irrigation.
