Accompanying this memorandum you will find a copy of a letter
submitted by the applicant's attorney requesting a postponement
of the above-referenced requests. The reasons for the post-
ponement are outlined in the letter.
It is recommended that the public hearings for the parking Lot
Variance and the Conditional Use -{items 5A2 and 6A1) be
continued to the April 11; 1989 meeting at 7:30 p.m. or as soon
thereafter as the agenda permits at Prime Bank Plaza. An
announcement should also be made that the public hearing before
the City Commission will be continued to the April 18th meeting
at 6:00 P.M. or as soon thereafter as the agenda permits at
Prime Bank Plaza.

Dear Jim:
Because I will be out of town fpr the above-referenced hearing, please
consider this my request to be postponed at the March 14th Planning
and Zoning Board hearing, as well as the March 21st City Commission
hearing, on the parking lot variance and conditional use petition. In
addition, my client is working with City staff to develop a landscape
plan to satisfy the concerned neighbor. We intend to develop such a
plan, and then meet with the neighbor prior to the Planning and Zoning
and Commission hearings. The postponement will also provide us the
;. opportunity to do that. Please advise me, at your convenience, in
writing as to when these matters will be rescheduled.

RE:
Section 5-145(c)(4) of the Code of Ordinances requires that when
a variance to Section 5, Article X, Parking Lots is requested,
the Technical Review Board must forward to the Planning and
Zoning Board a recommendation, and that the recommendation
forwarded is to be made part of the public hearing proceedings.
To that end, this memo is forwarded consistent with 5-145(c)(4).
Alan J. Ciklin, agent for BP oil Company, has requested a
variance to Section 5-142(h)(3) "Driveways" of the Parking Lot
Regulations which requires, among other things, that no driveways
may be constructed closer than 180 feet to the intersection of
the rights-of-way lines on collector and arterial roads. The
property in question is located at the northeast corner of
Woolbright Road and South Seacrest Boulevard. In this instance,
the applicant is requesting to be permitted to provide a 35 foot
wide driveway onto Woolbright Road located a distance of
approximately 133 feet from the intersecting rights-of-way lines
and a 32 foot wide driveway onto South Seacrest Boulevard located
a distance of 101 feet from the intersecting rights-of-way lines.
The variance request has been submitted in connection with a site
plan which proposes that the existing service station and the
adjacent deli be razed and that the property be redeveloped for a
new service station and convenience store. For an explanation of
the code requirement, the nature of the variance requested and
the variance justification, please refer to the attached Notice
of Public Hearing and application.
On Tuesday, March 7, 1989 the Technical Review Board (TRB)' met to
review the plans and documents submitted and to formulate a
recommendation with regard to the variance requested. After
review and discussion, the TRB recommended that the variance
request be approved as submitted. The basis for this
recommendation include the following:
(1) The applicant would be unable to access the property if
required to not have driveways within 180 feet of the

intersecting rights-of-way lines; and
(2) The proposed driveway configuration conforms to the greatest
extent feasible with the locational criteria for automotive
service station driveways (Section ll-L(5) of Appendix A,
Zoning) .

grant to the petitioner a variance to Article X "Parking Lots",
of Chapter 5, "Building, Housing and Construction Regulations," of
the Code of Ordinances of the City of Boynton Beach, Florida, as it

Avenue), Being a variance of 101 feet from the required 180 feet~ and having a \

parking lot driveway at 133 feet from the intersection of Secrest Boulevard and

Before me, the undersigned authority, personally appeared Jack C. Burdett
of Sohio Oil Company (DBA Gulf Products Division, BP Oil Company), who being
by me, first duly sworn on his oath, deposes and says:
- That Sohio Oil Company, is the owner of the following described
property, to wit:
See Exhibit "A" attached hereto
- That they desire to obtain a variance to the parking lot regulations
that require parking lot driveways to be constructed a minimum of
180 feet from the intersection of streets of a higher classification
as shown on the City or County Thoroughfare plans, and they approve
and consent to such action.
- That Jack C. Burdett is the Real Estate & Market Development Manager
of Sohio Oil Company, and has been authorized by said company to
execute this Agentls Agreement.
- That they consent to the appointment of ALAN J. CIKLIN, Esquire of
Boose, Casey, Ciklin, Lubitz, Martens~'McBane & O'Connell to act as
Agent on their behalf to accomplish the above.
- That Alan J. Ciklin has the authority to consent to all conditions

Accompanying this memorandum you will find documents related to a
request for a variance to the Parking Lot Regulations (Section'
5-142.h.). Also enclosed is a check for $400.00 to cover the
review and processing of this application. The site plan and the
letter from BP Oil Company authorizing Alan Ciklin are
forthcoming and will be forwarded to you upon receipt to this
office.
Please advertise this request for a public hearing before the
Planning and Zoning Board at the February 14, 1989 meeting.
