Consequently, variances will be necessary from the Community Appearance Board, where the landscaping on the site does not meet the requirements of the Landscape Code. Furthermore, as indicated by Item No. 9 on Memorandum 90-098 from the Engineering Department, you will be required to provide one (1) handicapped parking stall. Accompanying this memorandum you will find a copy of the report from the Engineering Department concerning the existing condition of the parking lot for the above-referenced site. If it is the decision of the Board to approve variances for only those sections of the Parking Lot Regulations where a variance is necessary, the following variances appear to be needed: 5-142(a) "Lighting" *5-142(d) "Landscaping" 5-142(1) "Parking Lot Striping" *Approval of this variance would not exempt the applicant from any specific requirements of the Landscape Code, as the Landscape Code is a separate ordinance and any exceptions thereto must be granted by the Community Appearance Board, if determined to be necessary by the Building Department. Finizio Acting ~.ssistant to the City Engineer RE: Harrpshire Gardens, Inc. - Cn-Site Review of Existing Parking Facility Variance Detenmnation - Continuance of the April 11th Ha:npshire Gardens Variance Request A quantity of two (2) on site inspections were conducted at the above referenced cannunity in order to determine site carpliance with applicable required improve- 'rrent sections of our City's "Parking Lot Regulations", specifically Article X, Sections 5-142 (a) through 5-142 (0). My findings are as follows: 1. Section 5-142 (a) (b) "Lighting" (Variance) M inspection conducted during the evening hours of Saturday, .~ril 14, 1990 resulted in a deteiminiation that the in-place lighting does not carply with our most recent parking lot illumination level requirernents. Special consideration should be afforded Harrpshire Gardens, for the lighting syste!ll was originally installed prior to the City adopting new standards in 1987. The in-place system is fully functional and provides a suitable level of illumination necessary for proper color rendition and visibility. . ,. 2. Section 5-l42(c) "Traffic Control" (Approved) The existing facility provides for stop signs at the main exit and a variance will not be necessary for this required improverrent. 3. Section 5-142 (d) "Landscaping" and Chapter 7.5, Article II, Sections 7.5-4 (c), Section 7.5-34 "Landscape Requirements for Yard Areas and Off-Street Parking and Other Vehicular Use Areas", Section 7.5-35 "Particular Requirements" Sub- sections 7.5-35 (a) through (1), Section 7.5-36 "Landscape Plan Approval" and 7.5-38 "Applicability of Landscape Ordinance and other Regulations". (Variance) The existing landscaping is maintained and well groomed. The applicant requests a variance due to the naninal size of this addition. 4. Section 5-142 (e) "CUrbs and Car Stops" (Approved) Car stops are provided at every stall. 5. Section 5-142 (f) Drainage" (Approved) During substantial rainfall periods of 4/14/90 the on-site storrnwater drainage facility functions properly and adequately handles the ston11W-ater generated by i..npervious pavement areas. The facility did not exhibit "pending" of stomwater and I conclude that the requirerrent to relocate the existing drainage structures into lawn areas is an unnecessary hardship at this time. Section 5-142 (g) "Parking lot Construction" (Approved) The on-site pave.ment area construction canponents exceed the design requirerrents set forth in this section. t 7. Section 5-142 (h) "DrivewayS" (Approved) Section 5-142 (i) "Parking lot Layout" (Approved) The on-site facility is in substantial conformance with these two sections. 8. Section 5-142 (j) "Parking Garage" (Not Applicable) 9. Section 5-142 (k) "Handicap Requirements" (Approved) There is a quantity of eighteen (18) parking stalls allocated for the pool building. In conformance with this section including State of Florida Building Codes, the applicant agrees, as a condition of approval, to install one (1) handicap stall. 10. Section 5-142 (1) "Parking lot Striping" (Variance) This well maintained parking facility was recently sealcoated and re-striped in conformance with the original site layout. The facility has l:een striped in white single lines spaced in accordance with our minimum standards. The requirement to double stripe this existing facility will result in the facility being re-sealcoated and re-striped at a cost of over ten thousand dollars. . 11. Section 5-142 (0) "Parking lot Maintenance" Parking lot maintenance is a requirernent regardless of the applicability of this code. Golden Senior City Planner DATE: April 3, 1990 SUBJECT: Hampshire Gardens - Parking Lot Variance - File No. 462 Section 5-145(c)(4) of the Code of Ordinances requires that when a variance to Section 5, Article X, Parking Lots is requested, the Technical Review Board must forward to the Planning and Zoning Board a recommendation, and that the recommendation forwarded is to be made part of the public hearing proceedings. To that end, this memo is forwarded, consistent with 5-145(c)(4). Thomas Avalle, President of Hampshire Gardens, Inc., is ,requesting a variance to section 5-138 "Scope" of the Parking Lot Regulations. Approval of the variance would exempt the project from having to comply wi th the design requirements contained within Article X. section 5-138 requires compliance with the Parking Lot Regulations under any of the following conditions: (a) When a parking lot serves an existing building(s) where said building(s) is proposed to be enlarged or when an additional building(s) is proposed to be constructed; (b) When a change in building occupancy occurs as defined in the standard building code; (c) When a change in use occurs which results in additional parking being required as noted in section 11.H.16 of Appendix A, Code of Ordinances; . (d) When compliance with the landscaping code is required; (e) When temporary sales trailers are proposed; (f) When an existing parking lot is expanded by twenty-five (25) percent or more in parking stalls beyond what was originally approved; and (g) When any new parking stalls, driveways, access aisles, or parking lots are proposed, these newly constructed areas must comply with the requirements of this article. In this instance, the applicant is requesting relief from the requirement to comply with the requirements of Article X-Parking Lots in connection with a proposed 644 square foot addition to the existing clubhouse. The existing project is located on the east side of South Federal Highway, south of S.E. 23rd Avenue. For an explanation of the code requirement, the nature of the variance requested and the variance justification, please refer to the attached Notice of Public Hearing and application. On Tuesday, April 3, 1990, the Technical Review Board (TRB) met to review the plans and documents submitted and to formulate a recommendation with regard to the variance requested. After review and discussion, the TRB recommended that the variance 5 request be approved as submi tted. The basis for this recommendation was the minor nature of the change requested (relocate restrooms, provide handicapped access and provide additional office and storage space) and the justification provided by the applicant on the application form. Al though the TRB did not note any existing safety hazards with respect to the layout and design of the existing parking lot, it was the consensus of the TRB that it was difficult to arrive at this conclusion because the existing layout and design of the parking lot was not shown on the site plan. ~ J. Short title. This article may be referred to as the "Boynton Beach Parking Lot Regulations." (Ord. No. 87.28, ~ 2, 9.17.87) , . Sec. 5-137. Purpose and intent. The purpose of this article is to provide a set of regulations to govern the design and construction of parking lots within the City of Boynton Beach. It is intended that these regulations provide a minimum set of standards to be followed when parking lots are constructed in order to protect the health, safety and welfare of the public. Furthermore, the City of Boynton Beach recognizes the relationship of these regulations to the goals and objectives of the comprehensive plan. (Ord. However, any newly constructed areas must com. , - : ply with the requirements of this article. (e) When a multi.family residential project is proposed and is designed in such a manner so as to include units contain. ing garages served by driveways, then these units shall be exempt from the requirements of this article.
