RE: JACK QUATMAN
LAND USE AMENDMENT AND REZONING
Sununary: Jack Quatman, property owner, is requesting that a .115
acre parcel of land be rezoned from C-3, Community Commercial, to
R-1AA, Single-Family Residential, and that the Future Land Use
Plan designation for this parcel be amended from "Local Retail
Commercial" to "Low Density Residential." Currently, the
property is vacant and it is occupied by several pine trees. The
proposed use of this property, if rezoned, would be to combine it
with the existing R-1AA zoned single-family lot to the east (lot
62 of the Coquina Cove subdivision), which is also owned by Jack
Quatman, to allow for the addition of a two car garage onto the
existing single-family detached home.
Surrounding Land Use and Zoning (See attached location map):
Abutting the subject parcel to the east is a single-family home
which occupies lot 62 of the Coquina Cove subdivision. This home
is owned by Jack Quatman and is zoned R-1AA. Further to the east
are additional single-family homes in the Coquina Cove
subdivision which front on Shore Drive and are zoned R-1AA.
~. These homes are generally in very good condition. Abutting the
SUbject parcel to the south is the Boynton (C-16) Canal.
Abutting the subject parcel to the west is a 1.605 acre C-3 zoned
parcel which is currently vacant (the .115 acre C-3 zoned parcel
proposed to be rezoned by the applicant was originally a portion
of the larger C-3 zoned parcel which lies to the west, and was
purchased by the applicant in April, 1987). Abutting the subject
parcel to the north is a 50 foot wide right-of-way for Shore
Drive.
Present Zoning: The subject parcel would be undevelopable under
the present C-3 zoning, as it does not meet the minimum criteria
for the C-3 zoning district regulations.

Rezoning: Rezoning to R-1AA, Single-Family Residential, would
allow the ,applicant to seek a unity of title on his property, in
order to allow for the addition of a new two car garage onto the
existing single-family detached home, which is located on lot 62.
If both parcels are combined under a unity of title, the expanded
lot 62 would exceed the minimum requirements of the R-1AA zoning
district regulations.
Comprehensive Plan-Future Land Use Map: The property in question
is currently shown on the Future Land Use Element as "Local
Retail Commercial", so an amendment to the Future Land Use
Element to "Low Density Residential" would be necessary.
Comprehensive Plan-Text: The following Comprehensive Plan
policies are relevant to this rezoning request:
"Provide a suitable living environment in all
neighborhoods." (p.6)
"Preserve the present stock of sound dwellings and
neighborhoods." (p.6)
"Eliminate existing and potential Land use conflicts."
(p.7)
"Promote home ownership and owner-occupancy within
existing neighborhoods." (p.18)
"In areas where demand for conunercial uses will not
increase, encourage the development of vacant commercial
parcels for residential and other uses." (p.39)
Issues/Discussion:
1. Whether the property is physically and economically
developable under the existing zoning.
As previously noted, the subject parcel is currently un-
developable under the current C-3 zoning, as it does not
meet the minimum requirements of the C-3 zoning district
regulations. Furthermore, the extremely small parcel size
would preclude the development of this property for commer-
cial purposes, owing to the numerous variances that would be
required to the Zoning and Parking Lot Regulations, as well
as the severe physical limitations imposed by the parcel,
which would continue to exist if all the necessary variances
were approved by the Board of Adjustment and the Planning
and Zoning Board.

2. Whether the proposed rezoning would be compatible with the
current and future use of adjacent and nearby properties or
would affect the property value of adjacent and nearby
properties.
The proposed use of the property would be compatible with the
current and future use of adjacent and nearby properties, as
it would result in a 30 foot westerly expansion of the exist-
ing R-1AA zoned district, and would not decrease the size and
, dimensions of the existing C-3 zoned parcel at the southwest
corner of Federal Highway and Shore Drive to the extent that
a variance would be required to develop this property under
the existing C-3 zoning. It is not anticipated that the use
of the subject parcel for residential purposes (i.e., a two
car garage) will have an adverse impact on neighboring
residential and commercial properties.
3. Whether the proposed rezoning would be contrary to the
established land use pattern, or would create an isolated
district unrelated to adjacent and nearby districts, or
would constitute a grant of special privilege to an
independent property owner as contrasted with the protection
of the public welfare.
As previously noted in this report, the proposed rezoning
would represent a 30 foot westerly expansion of the exist-
ing R-1AA zoning district and would be consistent with the
established land use pattern. The proposed rezoning would
not constitute a grant of special privilege to an independent
property owner, as it would not violate the protection
of the public welfare, and would provide the applicant with
an opportunity to construct an attached garage onto his
single-family home, consistent with similar attached garages
on neighboring homes.
4. Whether the proposed rezoning would be consistent with ap-
plicable Comprehensive Plan policies.
The proposed rezoning would be consistent with all of the
Comprehensive Plan policies previously outlined in this re-
port under the heading "Comprehensive Plan-Text."
Conclusions/Recommendations:
The proposed rezoning and use of property would be compatible
with existing and proposed land uses in the vicinity. Re-
zoning to R-1AA is consistent with Comprehensive Plan
policies for the location of residential land uses and
preservation of established neighborhoods.

Therefore, it is the Planning Department's recommendation
that the application for rezoning, from C-3 Community
Commercial, to R-1AA, Single-Family Residential and the
Land Use Amendment from "Local Retail Conunercial" to "Low
Density Residential" be approved without reservations.

Accompanying this memorandum, you will find a copy of a Land Use
Amendment/Rezoning request submitted by Jack Quatman, property
