RE: Lopez Medical Office Complex-Parking Lot Variance
Section 5-144(c)(4) of the Code of Ordinances requires that when
a variance to Section 5, Article X, Parking Lots is requested,
the Technical Review Board must forward to the Planning and
Zoning Board a recommendation, and that the recommendation
forwarded is to be made part of the public hearing proceedings.
To that end, this memo is fprwarded consistent with 5-144(c) (4).
Nelson Lopez, M.D., property owner, has requested a variance to
section 5-141(e) "Drainage" of the Parking Lot Regulations, which
requires that storm water be retained on-site at a capacity of
not less than three inches of rainfall in one hour. The subject
parcel is located on the south side of S.E. 23rd Avenue,
approximately 330 feet west of the right-of-way for the Florida
East Coast Railroad, and includes lots 9 and 10 of the High Point
subdivision (see attached surveys and site-plan). In this
instance, the applicant is 'requesting that the existing storm
water flow onto S~E. 23rd Avenue be allowed to continue. For an
explanation of the Code requirement, the nature of the variance
requested, and the variance justification, please refer to the
attached Notice of Public Hearing and application.
On Tuesday, May 5, 1987, the Technical Review Board (TRB) met to
review the plans and documents submitted, and to formulate a
recommendation with regard to the variance requested. After
review and discussion, the TRB recommended that this variance
request be denied. The reasons for this recommendation are as
follows:
1.
S.E. 23rd Avenue in the vicinity of the subject parcel is
currently prone to flood{ng during periods of heavy rainfall,
and the storm water run-off from the Lopez property would
further exacerbate this situation.
2.
The parking ,lot is being expanded to provide for additional
parking and therefore, should be subject to all of the
requirements of the Parking Lot Ordinance, including the
requirements for on-site storm water treatment and
containment.

3. A surplus of three (3) parking spaces exists which may be
eliminated in favor of increased landscaping and swale areas
to accommodate the storm water run-off.
In addition, the TRB requested that the applicant be advised that
if the Planning and Zoning Board approves this variance request,
then the property owner will be required to dedicate fifteen (15)
feet of right-of-way for S.E. 23rd Avenue to Palm Beach County
within forty-five (45) days of variance approval.
