NOTICE IS HEREBY GIVEN that the Planning & Zoning ,Board of the
CITY OF BOYNTON BEACH, FLORIDA, will conduct a PUBLIC ,HEARING on
Tuesday, January l2, 1988 at 7:30 p.m. at Pineland Plaza,
Commission Chambers, 2ll S. Federal Highway, Boynton Beach to con-
sider an application to ABANDON a street right-of-way submitted by
property owner, Wilda Searcy, on a parcel of land more par-
ticularly described as follows:
A portion of NE 3rd Street between NE 12th Avenue and NE
l3th Avenue in Section 21, Township 45 South, Range 43
East, City of Boynton Beach, Palm Beach County, Florida;
being more particularly described as a 40 foot by
i90 foot portion of land named NE 3rd Street (platted and
dedicated as FIRST ST.), a public right-of-way lying bet-
ween BLOCK 1 and BLOCK. 2 in HAPPY HOME HEIGHTS, a sub-
division in the said City of Boynton Beach and recorded
in the official county records of said Palm Beach County
in Plat Book 11, Page 30, said portion of land being bounded
on the north by the south right-of-way line of NE 13th
Avenue (platted and dedicated as WASHINGTON AVE.) and
bounded on the south by the north right-of-wqy line of
NE 12th Avenue (platted and dedicated as LINCOLN AVENUE)
all as depicted on said subdivision plat.
ALSO
A PUBLIC HEARING will be held by the City Commission of the City
of Boynton Beach on the above request on Tuesday, January 19,
1988, at 8:00 p.m. at Pineland Plaza, Commission Chambers or as
soon thereafter as the agenda permits.
All interested parties are notified to appear. at said hearings in
person or by attorney and be heard. Any person who decides to
appeal any decision of the Planning & Zoning Board or City
Commission with respect to any matter considered at these meetings
will need a record of the proceedings and for such purpose may
need to ensure that a verbatim record of the proceedings is made,
which record includes the testimony and evidence upon which the
appeal is to be based.

Application for abandonment of N.E. 3rd St.
After reviewing ,the subject application and associated documents, we
have the following comments: .
1. We currently have an operational 6" water main in N .E. . 3rd
St. between N~E. 12th and 13th Avenues. This main must
remain in service.
..
2. The intended use of the subject right-of-way is not clear.
3. The right-of-way is only 40 feet wide. The presence of our
water main and its affiliated easement would make the property
unsuitable for residential development. We will require" a
minimum 12' wide easement centered on the water main, with a
clear a~cesspath throughout.
To summarize the above, we recommend against the requested abandon-
ment until such time that the applicant can. clarify the intended
usage and demonstrate that the City's water main will remain
serviceable.

Street (N.E. 3rd Street) between N.E. 12th Avenue and N.E. 13th Avenue in
Boynton Beach, Florida.
At the present time, we have no underground gas distribution facilities
located within the' above described right-of-way.

utility Companies have been contacted and their interest in
subject R.O.W. is as follows:
1. Florida Public utilities has no interest, letter of
December 30, 1987 included here.
2. Southern Bell Telephone Company does occupy this R.O.W.
and will need an easement. The letter on this is in the
mail.
3. Florida Power and Light Company does occupy the subject
R.O.W. and will need an easement. The letter on this is
in the 'mail.
4. Comcast, the cable company, does not have any interest in
the subject R.O.W.
It is my recommendation that easements be retained for utilities
if the R.O.W~ is abandoned.
