Predicated on the responses received as listed above, it is my
recommendation that the abandonment request be approved subject
to an easement equal to the width of the right-of-way to provide
for all utilities.

Dear Mr. Clark,
Southern Bell objects to the abandon-rent referenced above and shown on
the attached sketch. The reason for the objection is due to the fact ~
have a major conduit nm (16 Dlct) 5 feet north of the center line of
N.W. 1st Avenue that continues under 1-95. This objection can be
removed,.if the 50 foot wide, 'strip 'of land is' changed to a utility
easerrent.

or proposed cable facilities vithin the area of abandonment.

Dear Mr. Clark:
As requested in your letter of March 16, 1987, we have revie......ed the proposed
abandonment of N. W. 1st Avenue bet......een N. W. 4th Street and 1-95 in Boynton
Beach, Florida.
We can not agree to the abandonment of this right-oi-......ay as our feeder main
serving the City of Boynton Beach and adjacent communities is located within
this right-of-......ay. As you kno......, N. W. 1st Avenue is the main corridor for
most of the utilities that cross 1-95 to serve the Boynton Beach area.
We would, ho......ever, agree to the proposed abandonment if a suitable perpetual
easement ......ould be prepared and granted simultaneously with the proposed
abandonment that ......ou1d encompass the entire area covered by the right-of-......ay
abandonment.
If, after the granting of the easement, the property owner's use of the ease-
ment would require a grade change and adjustment of our facilities, we would
expect the property owner to pay the entire relocation cost of our facilities.
We will be happy to work with you and the property owners to resolve this
matter.

contains a large water Main which crosses under 1-95 at that point and
provides a Major feed to Leisureville and points west. We also have a
gravity sower in the right-of-way.
AbandonMent of this right-of-way MU5t not be considered until such tiMo
as appropriately-sized easeMents have been reviewed and agreed upon by
this off ice.
