from the Building Department.

SUBJECT: Nuttinl But Ribs (f/k/a Brady's Restaurant) - Request
for Approval of Extended Site Plan - File No. 178
Clifford E. Brady, II, is requesting that the City commission
grant an extension of the above-referenced Development Order
which expired on November 15, 1989 (NOTE: The applicant
incorrectly indicates in the attached correspondence that the
site plan expired on April 12, 1990).
With respect to concurrency issues, the site plan would have to
meet the County1s traffic ordinance if. the proposed development
generates 500 or more trips per day. The attached analysis
prepared by Walter H. Keller, Jr., Inc. indicates that the
proposed restaurant generates 149 fewer trips than the previous
service station that existed on the site. Therefore, the
proposed restaurant would meet the requirements of the County
ordinance.
Based on the above, the Planning Department has no objection to
the extension requested by the applicant. The maximum extension
, that could be granted would be for a period of one year.

Dear Mr. Golden:
We request your cooperation in granting an extension to
our site plan approval which expired on April 12, 1990.
We have been unable to proceed with site development
due to the detection of small levels of groundwater
contamination which required corrective cleanup. The
PB County Dept. of Environmental Resources Management
recommends and expects the state's DER approval of a
monitoring only plan for this site as it is within the
DER's guidelines and the contamination is limited in
extent. We are presently awaiting the state1s approval
letter, and will provide a copy to Mr. A. Newbold, Permits
Administrator. I have enclosed a copy of the DERM letter
for your review.
Enclosed also is a copy of the Traffic Impact Statement for
our project which was prepared by Walter H. Keller, Jr~, Inc.
The results of the analysis indicate 165 trips per day.

The Department of Environmental Resources Management (ERM) is aware that the
subject property is involved in a potential property transaction. This letter
is written at the request of Mr. Arnold Rogers of the One stop Oil Company. The
purpose of this letter is to relate to you this Department's appraisal of the
extent of contamination at this property and the need for future assessment and
remediation work at this site.
Contamination was 'discovered at this site in December of 1988 when the storage
tanks were removed. Pursuant to state guidelines, One Stop Oil Company notified
the Department of Environmental Regulation (DER) of the contamination.
Petroleum contamination sites, in the State of Florida, are required to be
cleaned up in accordance with the time schedules and procedures contained within
Chapter 17-770, Florida Administrative Code (F.A.C.). This Department is under
contract with the DER to administer this program for contamination sites located
in Palm Beach County and is responsible for reviewing and approving assessment
and remediation documents for contamination sites. These reviews are conducted
in accordance with the state guidelines for petroleum cleanup which are contained
within Chapter 17-770, F.A.C. and the policies of the Florida Department of
Environmental Regulation.
A Contamination Assessment Report and Petition for a Monitoring Only Plan was
submitted to this office by Nutting Environmental of Florida. After reviewing
the Report and proposal the Department requested that additional assessment
information be supplied. The additional information was supplied and the
Department approved the Contamination Assessment Report and is recommending the
Monitoring Only Plan for approval.
In review of the Contamination Assessment data for this site, it is the opinion
of the Department that the magnitude and extent of soil and groundwater
contamination is limited at this location. The contamination is contained
within a small portion of the site. Based on our knowledge of the propo~ed
renovations and planned use, it is our opinion that the contamination will have
no effect on the planned construction or intended use of the property.
As the levels of contamination are moderate and appear to be limited in extent,
the Department concurs that a Monitoring Only Plan is appropriate. The levels
of groundwater contaminants present at this site fall within DER guidelines for
Monitoring Only Plans at sites where no receptors are located downgradient. ~n
the event that continued monitoring fails to show a decline in the levels of
groundwater contamination, it is expected that any remediation which would have
to occur would be minimal in nature.

has forwarded the Monitoring Only Plan to the DER for approval. Please note that

An existing gas station site at the southwest corner of US 1 and NE 10th Avenue.in
the City of Boynton Beach is proposed for redevelopment into a takeout restaurant .
Walter H. Keller Jr., Inc. has been retained to determine the traffic impacts of this
proposal.
The project site plan shows the existing 373 square foot structure will be renovated to
accommodate the takeout restaurant. A trip generation analysis has been performed
based on the Institute of Transportation Engineer's Trip Generation Manual 4th
Edition. The trip generation analysis includes a credit for the existing gas station use.
Although the gas station has not been in operation since September, 1985, the Palm
Beach County T~affic Performance Standards allows a credit for an existing use if the
site has been operating within the last five years. The analysis is shown on Table 1
and indicate.s the proposed use will generate 149 fewer trips per day,
