Article III, Section 1 of the Articles of Incor- poration of the Association provides as follows: liThe Association shall have all of the common law and statutory powers of a corporation not for profit which are not in conflict with the terms of these articles." There are no restrictions provided in the Association's articles of incorporation relating to the con- struction of an addition to the existing building located upon lands held under recreation leasehold by the Association membership, provided however, that the cost of such project be financed from sources other than assessment upon members. Counsel is advised that the cost of the proposed project will not be financed from membership assessments, either regular · or special. It is my opinion that the Association as lessee of the lands of the Leisureville Golf Course has obtained appropriate authority in writing from Ramino Andino, Trustee Lessor, owner of record of said lands, to build the Golf Course Building addition described in the pending Site Plan Approval Application. II. Further, it is my opinion that under the "all powers" authority contained in the above cited Section 617,021, Florida Statutes, the Association has authority to construct the proposed addition to the Golf Course Maintenance Building as described in the aforesaid application.
