Lot Variance
Section 5-145(c)(4) of the Code of Ordinances requires that when
a variance to Section 5, Article X, Parking Lots is requested,
the Technical Review Board must forward to the Planning and
zoning Board a recommendation, and that the recommendation
forwarded is to be made part of the public hearing proceedings.
To that end, this memo is forwarded, consistent with 5-145(c)(4).
Craig R. Livingston of Burns & McDonnell, Inc., agent for Palm
Beach Leisureville, is requesting a variance to Sections
5-142 (i) (1) "Standards" and 5-142 (1) "Parking Lot striping" of
Article X - Parking Lots. Section 5-142 (i) (1) requires that
"Parking lots shall be designed to meet or exceed the dimensional
requirements for stalls, driveways, and access aisles as provided
for in City standards". These standards were adopted in
resolution form by the City Commission. The specific standard
that the applicant is requesting relief from is the requirement
to provide a 27 foot wide access aisle for 90 degree parking.
The applicant is requesting to be allowed to retain the existing
20 foot wide access aisles (the access aisle width is actually 22
feet wide or 24 feet wide in different locations due to the
parking space length which has been striped to 20 feet instead of
l8 feet). The recreation center is located at the southwest
corner of s.w. l3th Avenue and S.W. 20th Street. For an
explanation of the code requirement, the nature of the variance
requested and the variance justification, please refer to the
attached Notice of Public Hearing and application.
On Tuesday, November 7, 1989, the Technical Review Board (TRB)
met to review the plans and documents submitted and to formulate
a recommendation with regard to the variances requested. After
review and discussion, the TRB recommended that the request for a
,variance to Section 5-142(i)(1) be approved. The basis for this
recommendation is that requiring the applicant to reconstruct the
existing parking lot to accommodate the additional access aisle
width required would impose an unreasonable hardship. with
respect to the request' for. a variance to Section 5-142(1)
"Striping", the Technical Review Board is recommending that this
request be denied. It was the consensus of the Technical Review
Board that, as a condition of approval for the variance for the
reduced access aisle width, the applicant should be required to
re-stripe the existing 20 foot long parking stalls to a length of
l8 feet to allow for ,an increase in the access aisle width from
20 feet to 24 feet.

a. We are seeking variance from the parking lot regulations because special
conditions and circumstances exist which are peculiar to the structure
at Leisureville, These special conditions and circumstances are that
the effected building was constructed prior to the initiation of the
present parking lot regulations and zoning requirements. Additionally,
because the building has been in existence for more than 20 years,
we feel that history has demonstrated that more then adequate parking
exists ~nd that adding 941 square feet of storage area and one office
will not burden current parking lev~ls.
b. The special conditions and circumstances of this building being constructed
many years prior to the City's adoption of these regulations is not
the result from the actions of the applicant.
c. This request applies only to relief of regulations for this building.
Applicant respectfully reserves the right to seek other variances
to existing buildings as part of an ongoing improvements program,
d. Literal interpretation of the provisions of this chapter would work
unnecessary and undue hardship on the applicant in that no available
land exists at this facility for additional parking, no increase in
personnel or visitors is expected, and it would deprive the applicant
of use of its property.
e. If granted, this variance is the mlnlmum variance required to make
· possible the reasonable use of the land.
