SITE PLAN FOR PIZZA HUT
Upon review of the above-mentioned project, the following
comments must be addressed in order to conform with Boynton
Beach City Codes:
1. Show the setback distance from the new addition to two
adjacent property lines.
2. All plans submitted for public record and prepared by a
design professional shall show original raised seal and
signature of a Florida registered design professional.
3. Indicate the finish color of the exterior of the new
building and state it will match the color of the
existing building.
4. State the color of the proposed fence.
s. State the color blue is required to represent the handi-
capped parking symbol and parking space striping.
6. Indicate all landscaped areas shall be provided with an
automatic irrigation water supply 'system.
7. Show'the required five foot (5') wide landscape strip
along the entire property line abutting Southeast 20th
Court, except where the appropriate number and size of
ingress and egress driveways are located.

8. Show unobstructed cross visibility area and space
through the required site perimeter landscape strip at
both sides of all ingress and egress driveways. The
cross visibility area and space is shown by placing and
dimensioning on the site landscape plan drawing a ten foot
(10') isosceles right angle triangle with the right angle
on the property line at the edge of the driveway and land-
scape strip and completing the remainder of the triangle
into unobstructed landscaping and stating that the vertical
space within this area is clear of landscape material
between thirty inches (30") and six feet (6').

Dear Mr. Freund:
As we discussed by 'telephone today, we are planning a remodel of'the
referenced location in the near future. 'We have enclosed copies of our
proposed remodel plans for your perusal.
Although the Lease Agreement does not require that we obtain your consent
to make alterations. we wish to notify you of our intent to .remodel and
request your approval in order to obtain the ,necessary penmits from the
City. For your reference. enclosed please find e copy of Section 2.7
Alterations from the Lease which provides that we are allowed to make such
alterations as long as they are at our sole expense, of good workmanship
and material, and they do not reduce the s'ize of the existing structure or
materially adversely affect the appearance or market value of the premises.
As you can see by the attached map, our remodel is simply that we are
adding a 12 ft. wide cooler to the building and removing four parking
Spaces. Once the cooler is added.there.will not be adequate room for cars
to use these four spaces for parking. We assure you that the remodel will
be of good workmanship and material, that it will neither reduce the size
or strength of the existing structure nor materially or adversely affect
the appearance or market valu~ of the premises. In fact. this remodel will
enhance the appearance of the building and our business operation.
Of course, al1';mprovement costs will, of course, be paid by Pizza Hut,
Inc. and we assure you that rent payments will continue during the
construction period. We have engaged Mark'Sever of Sever Design Group
Architects for professional services Qn thi~ project. Pizza Hut hereby
expressly agrees to save and hold you harmless~ as we11 as the demised
premisest from any and all claims or liens which could arise as a result of
the proposed construction.
We are anxious to commence and complete this project as quickly as
. possible. In order to do so. the City requires your apprOVal of

2.4 Construct:ionObligation. The conGtruet:ion obliga-
tion.of LeGsor shall b~ limited to the sum of $90,000.00 to con-
struct the improvements on the l~~sed premisos in accordance Witl1
Lessee's plans and specifications. The const~uction obligation
of Lessor shall be further limited to requiraments as set forth
in said plans and specifications, and Lessee shall do any and all
other wo~k, hook-up and inatallation of additional requipmsnt, fur-
ni~ure and fixtures whatsoever at its' sole cost, expense and risk.
Lessee is her~by authorized to make such ch~ng~s in plans and speci-
fications as may be necGssary or proper withou~ the written consent
of Lessor, provided such changes do not mate'rially' affect the appear-
ance or atructurc of the improvsments. In the event construction
costs exceed the construction obligation hereinabove, Lessee agrees
to promptly pay such excess, and does hereby indemnify Lessor against
any construotion, obligation in excess of that herein specified.
All risk of loss to ~he leased premises prior to.completion of
construction shall remain with Lossor and shall b~ adequately
covered by insurance, the cost of which shall be deemed a cost
of constru~tion'
2.5 Parm~nt. Lessee A9re~s to advance, all construction
draws and payments for construction of improvements in accordance
with the construction contract. Within thirty (30) clays following
issuance of Certificate of Occupancy, Lessor, upon receiving proof
of payment and appropriate lien waLvers, agrees to ,reimburse Lessee
for con$truction costs up to but not exceeding the sum of $90,000.00.
2.6 Warranties. Lessor warrants that there are' no
easements, building reatrictions, restrictions of use.or zoning
whicnwould prevent the construction of improvements accordinq to
the plans and specifications as referred ~o herein. Le~sor further
warrants that sewer and utilities ~re available to: the property
line of the leased premises and are of su~ficiant si~e to handle
Lessee's p~oposcd usage. 1n the event said sewer or utilities are
not available, Lessor shall make them available at Lessor's expense.
Lessor, on behalf of the contractor constructing improvements
horeuridGr, does hereby warrant said improvements to' be free from
defects in material or workmanship for a period of one (1) year
following completion of construotion, it being understood that any
recourse by Lessee for detects during said period: Shall be against
said contra~tor on~y, but W1th the cooperation and assistance of
Lessor.
2.' Alterations. Lessee shall have the right to make
alterations ~o the leased premises, providing that such alterations
~re at Lessee's sole cost and expense and shall be of good
workmanship and material at: least equal to that of original

2.9 Bu11dinq Permit. Promptly upon execution of this
lease, Lessee shall fila a~d prosecute to conclusion, an application
for buildinq permit for construction of required impro~ements on
the laased premises. In the event the building permit is not issued
by proper authorities within sixty (60) days from the date hereof,
either par~y may cancel this agreement by written notice to the
other party within fifteen (lS) Qays following said 60-day period.
