Pizza Hut - parking Lot Variance

RE:
Section S-14S(c)(4) of the Code of Ordinances requires that when
a variance to Section 5, Article X, Parking Lots is requested,
the Technical Review Boad must forward to the Planning and Zoning
Board a recommendation, and that the recommendation forwarded is
to be made part of the public hearing proceedings. To that end,
this memo is forwarded, consistent with S-14S(c)(4).
~Mark Sever, project architect for Pizza Hut, is requesting a
variance to Section S-142(a) "Scope" of the Parking Lot
. Regulations. Section 5-142(a) requires that "when a parking lot
serves an existing building(s) where said building(s) is proposed
to be enlarged or when an additional building(s) is proposed to
be constructed", then compliance with the requirements of Article
X is required. In this instance, the applicant is requesting
relief from the requirement to comply with Article X in
connection with the proposed remodeling of the kitchen, which
includes the addition of a walk-in cooler and dry storage area
(see attached copy of site plan submitted for approval by the
Technical Review Board). The existing restaurant is located at
the northwest corner of south Federal Highway and S. E. 20th
Court.
For an explanation of the code requirement, the nature of the
variance requested and the variance justification, please refer
to the attached Notice of Public Hearing and application.
On Tuesday, December 5, 1989 the Technical Review Board (TRB) met
to review the plans and documents submitted and to formulate a
recommendation with regard to the variance requested. After
review and discussion, the TRB recommended that the variance
request be approved, subject to meeting the following additional
code requirements which would benefit the site from a public
safety standpoint:
1. Compliance with Section S-142(a) "Lighting" of Article X,
Parking Lots.
2. Compliance with Section S-142(c) "Traffic Control" of
Article X, Parking Lots (i.e., provision of stop signs and
stop bars at all three exits onto S.E. 20th Court.
The reasons for this recommendation are as follows:
1. The expansion and renovation of the kitchen does not
constitute an expansion or intensification of seating
capacity or customer service.
2. The existing non-conforming parking lot is situated on a
small lot and compliance with all of the requirements of
Article X would likely result in the elimination of existing
parking spaces in order to meet all of the requirements of
this ordinance as well as substantial reconstruction of the
existing paved parking lot.

3. The site plan submitted for approval by the Technical Review

NATURE OF VARIANCE REQUESTED
The variance requested is to allow an existing parking lot
serving an established restaurant (pizza Hut) to remain with
a layout not conforming to all current parking lot design
standards. The restaurant wants to add a cooler/dry storage
area to the rear which requires them to bring their parking
lot up to code. When the restaurant improvements are made
they will bring parts of the parking lot design up to code
such as: Parking stall size, striping, landscaping, landscape
buffers, handicap parking space requirements and the addition
of an unloading zone for deliveries.
Parts of the parking lot design that will not be brought up to
code are the following: Proper back-up space of 27'-0" where
24'-0" is provided, maximum allowed two driveways serving a
parking lot' where three are provided, proper maneuvering space
for trucks unloading the dumpster, existing drainage not
conforming to current runoff storage calculations and existing
catch basin located in the middle of the parking areas,. they:,shOUld
be located in landscape. areas, and lighting not providing proper
illumination.

JUSTIFYING THE REQUESTED VARIANCE

The special condition for this variance is the existence of a
non-conforming parking lot serving an existing restaurant
which needs improvement to continue in business. '

The existing Pizza Hut Restaurant was built in 1976 under
past design standards for parking lots and operation standards
for restaurants. Pizza Hut is currently upgrading all their
existing restaurant to current operation standards which requires
the addition of a cooler/dry storage unit on the rear to improve
food preparation and working conditions inside the restaurant.

The City of Boynton Beach requires existing parking facilities
to be brought up to current codes when additional square footage
is added to an existing building. If the existing'parking lot
was to be redesigned to current code requirements they would lose
as many as eight-ten spaces where 33 total cars are required.
Since the existing parking facilities have been in operation
for thirteen years with no problem concerning the amount of
parking or safety of the general public, Pizza Hut management
feels justified in their request to allow the existing parking
lot to remain in operation as it with upgrades to the design
as mentioned in the previous statement.

As we discussed by .telephone today, we are planning a remodel of'the
referenced location in the near future. .We have enclosed copie$ of our
proposed r~del plans for y~ur perusal.
Although the lease Agreement does not require that we obtain your consent
to make alterations. we wish to notify yOU of our intent to remodel and
request your approval in order to obtain the ,necessary penMits from the
City. For your reference. enclosed please find a copy of Section 2.7
Alterations from the Lease which provides that we are allowed, to make such
alterations as long as they are at our s01e 'expense, of good workm~nship
. and material, and they dO,not reduce.the slze of the existing structure or
materially adversely affect the appearance or market value of the premises.
As you can see by the attached map. our remodel is simply that we are
adding-a 12 ft. wide cooler to the building and'removing four parking
spaces. Once the cooler is added. there,will not be adequate room for cars
to use these four spaces for parking. We assure you that the remodel will
be of good workmanship and/material, that it will neither reduce the size
or strength of the eXisting structure nor materially or adversely affect
the appearance or matket valu~'of the pr~ises. In fact. this remodel will
enhance the appearance of the building and our business operation.
Of course. all.improvement costs will, of course, be paid by Pizza Hut,
Inc. and we assure you that rent, payments will continue during the
construction period. We hav~ engaged Mark'Seve~ of Sever Design Group
Architects for professional serVices on this project. Pizza Hut hereby
expressly agrees, to save and hold you'harmle$$~ as'wel1 as the demised
premises. from any and all claims or liens which could arise as a ~esult of
, the proposed construction.
We are anxious to commence and complete this project as quickly as
'possible. In order to do $0, the City require. your apprOVal of

2.4 Con~truetion Obl~gation. The conGtruc~ion obliga-
tion.of Leesor shall be limited to the sum of $90,000.00 to con-
struct the improvements on the le~ssd premioos in accordance Wi~l
Lessee's plans and specifications. The const~uction obligation
of Lessor shall be further limited to ~equiroments as set forth
in ~aid plans and specifications, and Lessee shall do any and all
othe~ work, hook-up and installation of ~dditional requipmsnt, fur-
niture and fixtures whatsoever at its Role cost, expense and risk.
Lessee is he~~by authorized to make such changes in plAns and speci-
fications as may be necessary-or proper withou~ the written consent
of Lessor, provided such changes do not materially'af!ect the appear-
ance or atructuro of the improvements. In the event construction
costs exceed the construction obligation hereinabove, Ltlssee a9'rees
to promptly pay such excess, and does hereby indemnify La_sor against
any construotioa,obligation in excess of that berein specified.
All risk of loss to the leased premises prior to.completion of
construction shall remain with Lossor and shall be adequately
covered by insurance, the cost of whieh shall be deemed a cost
of construtltion

2.5 Pa~m~nt. Lessee a9re~s to advan~e.all construction
. draws and payments for construction of improvements in accordance
with the construction contract. Within thirty (30) clays following
i5suanc~ of Certificate of Occupancy, Lessor, upon receiving proof
. of payment and appropriate lien waivers, a9ree~ to ,reimburse Lessee
. for con~truction costs up to hut not exceeding the, sum of $90,000.00.
2,.6 Warranties. Lessor warrants that there are' no
easem~nts, buildinq restrictions, rostrictions of use.or zoning
which would prevent the construction of improvements according to
the plans and specifioations AS referred to herein. Lessor further
,warrants that sewer and utilities ~re available to: the pr~perty
line of the leas~d premises and are of su~ficient size to handle
Lessee's proposed usage. In the event said sewer or uti1ities are
'not available, Lessor shall make them available at Lessor's expense.
Lessor, on behalf of the contractor constructing improvements
hG~eund$r, does here~y warrant said ,improvements to-b9 free from
defects in material or workmanship for a period of one (1) year
following completion of construction, it being understood that any
rsCOUrse by Lessee for detects during said period: shall be against
.said contra~tor only, but W1th the cooperation and assis~ance of
t..essor.

2.7 Alterations. Lessee shall have the right to mAke
a~ta~ations to the leased premises, providing that such alterations
