PARKING LOT VARIANCE
Section 5-145(c)(4) of the Code of Ordinances requires that when
a variance to Section 5, Article X, Parking Lots is requested,
the Technical Review Board must forward to the Planning and
Zoning Board a recommendation, and that the recommendation
forwarded is to be made part of the public hearing proceedings.
To that end, this memo is forwarded, consistent with 5-145(c)(4).
Dr. Robert J. Snyder, Trustee, is requesting a modification to
conditions that were imposed in connection with a previous parking
lot variance approval. The variance was approved in February,.
1986, by the Planning and Zoning Board in connection with a site
plan for Humana Medfirst (see letter of approval and memorandum
in exhibit A). One of three conditions recommended by the staff
and imposed by the Board at the time of approval included the
closing and reconstruction of medians on West Boynton Beach
Boulevard in the vicinity of the property. These improvements
were based on a plan proposed by ,the Florida Department of
Transportation (FDOT) for reconstruction of medians on Boynton
Beach Boulevard west of 1-95 (see plan in exhibit B). Since the
time of variance approval, the FDOT has not gone forward with
this plan and Hurnana, Inc. is proposing to sell its property to
Dr. Snyder for construction of a medical office building. As
part of Dr. snyder's site plan approval, he was required to
construct the above-mentioned roadway improvements prior to the
issuance of a Certificate of Occupancy.
The applicant has hired Hurnana's traffic engineer,
Dan Murray, to prepare an alternative plan for the median
reconstruction which addresses the turn movement hazards and is
compatible with the reconstruction of Old Boynton Road to form a
signalized intersection with N.E. 8th Street (see plan in exhibit
C). The proposed width and location of the driveway onto West
Boynton Beach Boulevard from the time of approval of the Humana
Medfirst site plan to the time of approval of the Snyder-Hodes
site plan remains the same. For an explanation of the code
requirement, please refer to the attached Notice of Public
Hearing and application.
On Tuesday, October 4, 1988, the Technical Review Board (TRB) met
to review the plans and documents submitted and to formulate a
recommendation with regard to the variance requested. After
review and discussion, the TRB recommended that the modified
variance request be approved, subject to the following
condition:

On Tuesday, February II, 1986 the Planning and Zo~ing Board
conducted a public hearing and approved the requested variance
to the Parking Lot Regulations subject to Humdeco meeting three
conditions as noted'in the attached Memorandum from the Planning
Director to the Board.

As a result of discussions with the applicant's traffic engineer,
condition number one was modified by the Board to require the
following program of median c10s~re.
All median openings between Industrial Avenue and N.W. 7th Court
will be closed and new median construction will, where possible,
reflect the design proposed by the Florida Department of Trans~
portation (FDOT) in this area; however, instead of constructing
a U-turn for eastbound traffic at N.W. 7th Court as proposed by
FDOT, the applicant will construct a westbound U-turn median
opening, west of N.W. 7th Court with proper stacking.

Sally S. Benson, agent for Humdeco, Inc., has requested a variance to
Section 5-141(g) (3) Driveways, of the Parking Lot regulations which
requires, among other things, that no driveways may be constructed
closer than 180 feet to the intersection of the rights-of-way lines
< on streets of a higher classification (collectors/arterials). In
this instance, the applicant is requesting to be permitted to retain
an existing curb cut located on Boynton Beach Boulevard approximately
170 feet from the intersection with N.W.7th Street. For an ex-
planation of the Code requirement, the nature of the variance
requested, and the variance justification, please refer to the
attached Notice of Public Hearing and application.

Dear Mr. Lewis:
I am writing on.behalf of the 50+ businesses located in the Boynton
Beach Industrial Park who have been waiting several years for the DOT to
favorably consider their request for a traffic signal at the above
intersection. The DOT I s recornnendation for a reconstruction of the
median that would, in effect, prohibit left turns from Industrial Avenue
onto Boynton Beach Blvd. is strongly opposed by those who will be
. impacted by such action, and they would appreciate further review by
your office.,
Accident s.tudies have told us that this is indeed a dangerous
intersection, and traffic counts show that a signal is justified.
Furtherrrore, the traffic generated from the Industrial Park is mainly
large trucks. These include semi tractor-trailer trucks and fully
loaded gaSOline/diesel fuel trucks. The difficulty these vehicles now
experience in trying to turn left onto Boynton Beach Blvd. (to reach 1-
95) would only multiply if the median is changed. It \',QuId encourage
drivers to turn right onto Boynton Beach Blvd. and then attempt a U-
turn, which would be not only difficult, but dangerous as well. This
isn't an acceptable solution to the problem.
We recognize that the DOT has concerns about placing a signal at
this location because of its close proximity to 1-95, but would like to
propose an alternative solutio~ tor consideration. Presently there is a
signal on top of the overpass which controls east/west traffic on
Boynton Beach Blvd., but vehicles exiting 1-95 and traveling west on
Boynton Beach Blvd. have unrestricted flow. It is this latter situation

which creates a continual flow of traffic and makes it almost Lmpossib1e
for vehicles to exit Industrial Avenue. If a signal were installed to
regulate vehicles exiting I-95 to the 'west, it w:>uld provide a
sufficient break in the traffic to resolve this problem. I believe
other I-95 exits such as Forest Hill Blvd. and Palm Beach Lakes Blvd.
have this type of signalization.
We w:>uld request that you delay immediate action on the Iredian
changes until this suggestion can be given further review. I will look
forward to your early response, and any assistance you may be able to
provide will be appreciated.

We have received your conceptual design plan concerning median
channelization at the subject intersection. The design is an effective means of
reducing the number of right angle accidents and is therefore approved. As
previously discussed, signalization is unwarranted and would most likely
increase the number of accidents occurring at the intersection.

The Department recently issued permit number R-93200-082-89 which
modifies the median from this intersection west to N.W. 7 Court. The most
expedient means of accomplishing the subject median revision would be to include
the work under the permit contractor's job at existing unit prices. As the
Department currently does not possess the necessary funding, we respectfully
request your agency to fund the construction of the median modification.

like to coordinate the design and public information efforts with your offices

Dear Carmen,
With reference to the property upon which Drs. Snyder, Hodes, and Roberts are
building their new offices- in February, 1986, a variance was approved by the city
because the Boynton Beach Boulevard entry/exit is within 180' of the intersection
with N.W. 7th Street.
One of the three stipulations by Planning and Zoning was that the driveway
be constructed with a 25' radius.

This is shown on the approved site plan. However, D.O.T. will not approve the
work because the radius uses the adjoining property owner's section of the right-
of-way.
.
The only way to please D.O.T. would be to slide the proposed entry westward
25'. Unfortunately, there i,s a large concrete power pole, at that point which will
mean moving the entry/exit even further west. I believe to do this..would defeat
the intent of section 5, article X, Code of Ordinance.
There is an existing concrete curb "cut", 29' wide, beginning at the northeast
,corner of the property which was placed there by'D.O.T. to serve the site.
Use of this existing facility would make everyone happy, with the exception
of Lt. Hammack of the police department, who feels the radius would be safer than
the normal D.O.T.' "flares" that exist.

Gentlemen:

Enclosed you will find the completed Application for Variance
on the Snyder/Hodes Medical Building.
This is a re-submission of an Application for Variance ,due to
a Florida Department of Transportation change of plans which
made the prior Approval for Variance impossible to comply
with in that the conditions set forth therein would have to
be changed as a result of the Department of Transportation's
action.
We, request that yo~ modify the conditions of approval as per
the attached plans.
I enclose also a check to the City of Boynton Beach in the ~
amount of $400.00 for the Application Fee along with copies
of the letter from Humana giving us the authority to proceed
and the letter from the traffic planner, Daniel N. Murray,
wherein he states that the changes are insignificant.

In response t6,your letter of May 17, 1988 concerning the Dr.
Robert Snyder project, please be advised that the requirement to
construct certain median ~mprovements on Boynton Beach Boulevard
was a condition'of the parking lot variance apprQval to permit a
driv~w.ay within 180 feet of intersecting right-of-way lines. ,:In
order to modify this requirement to allow for an alternative
median design, a new parking lot variance application mus~ be '
subm~tted, including a revised traffic study which addresses the
safety and efficiency of the alternativ~ median design.

Dear Carmen:
I am somewhat confused on the need for a variance application
resubmitta1 on the subject matter. Because of modifications to
the U-Turn configuration on Boynton Beach Blvd. at the NW 7TH
Court intersection, it was my understanding that a variance
resubmission was 'necessary.

However, according to Dr. Snyder, you indicated that no variance
,resubmission was necessary, but all changes should be reflected
, on the site plan submission. In contrast, when we met a few
weeks ago I thought you indicated that a variance was necessary.
To clarify this matter I contacted your office and talked to
Jim Golden todtY. He believed that a variance was required.
