your plans have indicated 156 or 162 seats and at times even
more, however, upon an actual seating count less than the

Re: Southern Entertainment Company of Florida,' Inc.
Dear Mr. Rea:
This letter is to confirm the objections you related
concerning zoning approval for the property located at 3675
South Federal Highway, Boynton Beach, Florida. You stated
..
that the only problems which ..exist now and which must be
cleared up before the City negates its recision of the zoning
for the sale of alcoholic beverages at the above property and
. issues a C.O. are as follows:
1. Plans will have to be submitted showing
the maximum permi tted one hundred sixty-two
(162) seats. [If you will note however, on
November 30, 1988 plans were . submi tted
reflecting one hundred fifty-six (156)
seats, six more than the one hundred fifty
(150) we agreed was' needed for the zoning.]
2. A new application for alcoholic beverage
license will have' to be. submitted for
considera tion by the City, Cpmmission at its
meeting on April 4. 1989.. ~':'TqEi:' .applica tion
must correctly show the present officers and
directors of the applicant as well as the
lessee1s investment. [Apparently, the
application which the Commission, had before
it on November 1, 1988 had,. .b.ee-n correc.ted'

Beverage to reflect .changes regarding these
two items that occurred during the interim.]
You told me that in your opinion a
corrected copy of the alcoholic beverage
license must be presented to the Commission
so that they can properly pass upon it. You
stated that this would be perfunctorily done
at the April 4th meeting.
On the other band, I informed. you that
in my opinion, the resolution adopted
November 1, 1988 was proper', even though the
alcoholic beverage license had been modified
after the commission considered it. The
reason is that the changes have nothing
whatsoever to do with zoning issues., I still
bel ieve that pos i tion is correc,t. However,
as you informed me that Mr. Howell would not
issue a letter cancelling his recision of the
zoning, and that only the City Commission
could do this by adopting another resolution,
we have no recourse, other than burdening the
Courts, than to comply with your wishes.
Please take notice, however, that by so doing
we do not waive our right to later contest
the denial of the validity of the
Commission's November 1, 1985 resolution.

3. The Florida Division of Housing and
