Plans will have to be submitted showing one hundred fifty (150) seats for purposes of necessary approval. Let me reiterate that of all the plans that you have submitted to date, not a single plan actually has the specific minimum of seats required for zoning approval. We do need plans which show at the minimum, 150 seat capacity' for your establishment to obtain zoning approval. Some of your plans have indicated 156 or 162 seats and at times even more, however, upon an actual seating count less than the 150 seat minimum was actually available. Therefore, to reiterate, we do need plans which indicate a minimum seating capacity (actual count) of 150 seats for zoning approval. However, as you informed me that Mr. Howell would not issue a letter cancelling his recision of the zoning, and that only the City Commission could do this by adopting another resolution, we have no recourse, other than burdening the Courts, than to comply with your wishes. Please take notice, however, that by so doing we do not waive our right to later contest the denial of the validity of the Commission's November 1, 1985 resolution.
