Please be advised that on Tuesday, January 15, 1991, the City
Commission approved the referenced conditional use, subject to
staff comments, copies of which ~re attached.
These plans were approved subj ect to your compliance with the
attached stipulations and must now be modified to incorporate
same. To initiate your sign-off procedure, please submit two (2)
sets of modified plans to the Office of the Site Development
Division of the Building Department, which will record the
required identification markings on each set of the modified
plans.
After both sets of modified plans have the appropriate ~arkings,
you should proceed with your sign-off on both sets of plans from
each Technical Review Board member. The sign-off procedure
requires that the Engineering Department sign-off first, followed
by all other departments with the exception that the Planning
Department sign off next-to-last and the Building Department
sign-off last. The Zoning & Site Development Administrator will
provide the Building Department sign-off. One (1) set of final
signed-off plans will remain with the Building Department and the
other set of plans will be returned to you to be retained at the
job site.

To help facilitate the sign-off process, appointments should be
made to meet with each Technical Review Board member to allow
them sufficient time to review and sign-off the modified plans.
After securing all the required Technical Review Board member
signatures and completing processing by the Site Development
Division, you may apply for building permits by submitting the
appropriate documents and fee to the Plan Review and Permitting
Division of the Building Department. The Building Department
will advise you as to any additional permits which may be
required, such as Palm Beach Health Department (water and sewer),
clearing/grubbing, excavation/fill, drainage, paving, si te
lighting, landscaping and irrigation.
The approval of the City entitles you to construct only the
improvements shown on the site plan. The site plan will be
viewed procedurally as an as-built or record drawing. If you
have any questions concerning this matter, please do not hesitate
to contact me.

Based upon the nominal impact of this small hairdresser's shop, the Technical

Conditional Use (beauty salon)
Introduction: Helene C. Harrington, property owner, is
requesting conditional use approval to lease 450 square feet of
an existing office/retail bUilding to establish a beauty salon.
The parcel, zoned C-l, Office Professional Commercial, is located
at 1100 South Federal Highway, the northeast corner of South
Federal Highway and castilla Lane. Last month the City
Commission approved an amendment to the zoning code which
permitted beauty salons in the C-1 zoning district, subject to
conditional use approval.
surroundina Land Uses and Zonina (see attached map): Abutting
the subject parcel to the north is a small office building, zoned
C-1. To the east across S.E. 6th Street, are single family homes
zoned R1AA. To the south, zoned C-1, is a bank. To the west
across Federal Highway, zoned C-3, Community commercial, are a
restaurant, a vacant lot and a gasoline service station.

standards for Evaluatina Conditional Uses: section 11.2.D of
the zoning Code contains the following standards to which
conditional uses are required to conform. Following each of
these standards is the Planning Department's evaluation of the
application as to whether it would comply with the particular
standard.
The Planning and zoning Board and city Commission shall consider
only such conditional uses as are authorized under the terms of
these zoning regulations, and, in connection therewith, may grant
conditional uses absolutely or conditioned upon the faithful
adherence to and of fulfillment of such restrictions and
conditions including, but not limited to, the dedication of
property for streets, alleys, and recreation space, and
sidewalks, as shall be necessary for the protection of the
surrounding area and the citizens' general welfare, or deny
conditional uses when not in harmony with the intent and purpose
of this section. In evaluating an application for conditional
use, the Board and Commission shall consider the effect of the
proposed use on the general health, safety, and welfare of the
community, and make written findings certifying that satisfactory
provision has been made concerning the following standards, where
applicable:
1. Ingress and egress to the subject property and proposed
structures thereon, with particular reference to automobile
and pedestrian safety and convenience, traffic flow and
control, and access in case of fire or catastrophe.
One driveway exists onto Federal Highway which provides the main
ingress to the site. Another driveway exists to the rear of the
building and connects the front parking area to a rear parking
area. This driveway, which functions as an egress drive, exits
onto S.E. 6th street, a local street running along the rear or
east property boundary of the site. It is recommended that this
driveway be marked with signs and pavement arrows to discourage
use of the driveway as an ingress point to the front of the

continued safe and convenient flow of vehicles, pedestrians and
emergency vehicles within the site. Adequate pedestrian
connections also exist which link the front and rear parking
areas to the building entrances via an arcade.
2. Off-street parking and loading areas where required, with
particular attention to the items in subsection D.1 above,
and the economic, glare, noise and odor effects the
conditional use would have on adjacent and nearby
properties, and the City as a whole.

within the building which currently is leased to two architects,
a travel agency and a realtor. The front parking area is
comprised of parallel and angles parking spaces and the rear
parking area is comprised of 90 parking which backs out into
S.E. 6th street. The Engineering Department is recommending that
both parking areas be restriped since parking space delineations
have faded.

Based on the determination from the BUilding Department that the
beauty salon use is not an intensified use of the existing
building, the parking and landscaping are not required to meet
current standards. However, despite the fact that the main
driveway off of Federal Highway and front parking area which it
serves, would only allow one-way flow by today's standards, the
Police Department records indicate that the two-way flow
exhibited by this driveway and parking area has functioned
without any significant problems since 1960. This is most likely
attributable to the low traffic volumes which are generated by
the eXisting uses previously mentioned. Therefore, due to the
small area proposed for the beauty salon, it is anticipated that
the current traffic volumes exhibited at this site will not be
impacted by this use. Also, this use will not have any negative
effects on adjacent and nearby properties or the City, since '
commercial uses are already established in this vicinity.

3. Refuse and service areas, with particular reference to the
items in subsection D.1 and D.2 above.
Adequate refuse and service areas presently exist to serve the
proposed use.
4. utilities, with reference to location, availability, and
compatibility.
The existing utilities are adequate to serve the proposed use.
5. Screening, buffering and landscaping with reference to type,
dimensions and character.
As previously mentioned, the eXisting landscaping is not required
to meet current standards. However, the landscaping which exists
substantially complies with the landscape code. Therefore, no
additional screening or buffering is recommended.
6. Signs and proposed exterior lighting, with reference to
glare, traffic safety, economic effect and compatibility and
harmony with adjacent and nearby properties.
No changes are proposed to the existing signage and lighting
since they do not jeopardize traffic safety or negatively affect
the adjacent and nearby properties which have a similar land use.
7. Required setbacks and other open spaces.
No exterior changes or additions are proposed which require
compliance with current setback requirements despite the fact
that the existing setbacks are substandard.

8. General compatibility with adjacent properties, and other
properties in the zoning district.
As previously discussed, the surrounding land uses include more
intensive commercial uses to the west than the proposed beauty
salon, and similar commercial uses to the north and south. Since
the proposed use will occupy a very small (450 square feet)
portion of an existing office/retail building and is not new
construction, it is not considered to be incompatible with the
residential uses to the east.
9. Height of buildings and structures, with reference to
compatibility and harmony with adjacent and nearby
properties, and the city as a whole.
The building height is one story which is compatible with the
surrounding buildings.
10. Economic effects on adjacent properties and the City as a
whole.
For reasons already stated, it is not anticipated that the
proposed beauty salon will have an adverse impact on property
values in the vicinity, or the city as a whole.
Comprehensive Plan Policies: This request, subject to the
attached staff comments, is consistent with all relevant policies
contained within the 1989 Comprehensive Plan.

Conclusion/Recommendation:
= The planning Department recommends that this request for
conditional use approval be approved, subject to the attached
staff comments. This recommendation is based on the fact that
the proposed beauty salon will not exacerbate existing conditions
on the site or adjacent properties, nor create any additional
negative impacts on an area which is stable and has been
developed for low intensity commercial uses for an extensive
period of time.

paving, existing elevations on site, rights-of-way and
easements on or adjacent to the site, utilities on or
adjacent to the site, legal description, acreage to the
nearest one-hundredth (1/100) of an acre, location
sketch, and surveyor's certification. Also, sizes and
locations of existing trees and shrubs, including
common and botanical names, and indication as to which
are to be retained, removed, relocated, or replaced.
20. Location of existing utility lines on or adjacent to
the property to be indicated on the site plan, in
addition to being shown on the survey. Also, location
of existing fire hydrants on or adjacent to the site.
21. Location of additional fire hydrants, to meet standards
set forth in Article X, Section 16 of the Subdivision
and Plattinq Regulations.
22. Fire flow calculations justifying line size for both
on/off site water lines.
23. Sealed engineering drawings for proposed utilities, as
per City specifications.

Information regarding form of ownership (condominium,
fee simple, lease, etc.).
25. Location and orientation of garbage cans or dumpster
facilities: All garbage dumpsters must be so located
to provide direct access for the City front-end
loaders, and the dumpster area must be provided with
adequate width and height clearance. The site must be
so designed to eliminate the necessity for the
front-end loader to back into any street. If any use
requires the disposal of wet garbage, a ten foot by ten
foot (10' x 10') concrete slab shall be provided. All
dumpsters must be screened and landscaped in accordance
with the City Landscape Code. (See Sec. 7.5-35 (i)).
A minimum 10 foot wide opening is required for dumpster
enclosures.
26. A parking lot design and construction plan showing
conformance to the City Parking Lot Regulations, and
including the following information. Any exceptions to
the Parkrng Lot regulations that are proposed or that
are to continue will require an application for
Variance to the Parking Lot Regulations.
a. Location of all parking and loading facilities.
b. A parking lot layout plan, including curbs, car
stops, and double striping.
c. A cross-section of materials to be used in the
construction of the parking lot.
d. A lighting plan for the building exterior and site,
including exterior security lighting, and lighting
for driveways and parking lots; to include the
location of lighting standards, direction of
lighting, fixture types, lamp types and sizes, and
average illumination levels(s) in footcandles.

e. Information showing conformance with the City
Street and Sidewalk ordinance, including
construction of sidewalks along adjacent public
streets.
f. Location of existing and proposed public and
private streets, including ultimate rights-of-way.
g. On-site traffic plan, including arrows and other
pavement markings, traffic signs, and stop signs at
exits.
h. Location of handicap parking spaces, plus signs and
access ramps, consistent with the State Handicap
Code.
i. A drainage plan for the entire site, including
parking areas; to include finish grade and pavement
elevations, drainage calculations, and details of
the drainage system. If the total impervious area
on site exceeds twenty-five thousand (25,000)
square feet, then drainage plans and calculations
must be prepared by an engineer registered in the
State of Florida, and must be sealed. percolation
tests must be provided with drainage calculations.
j. Existing elevations on adjacent properties, and on
adjacent rights-of-way.

27.
Where conformance with the County's Environmentally
Sensitive Lands Ordinance is required, an Application
for Alteration of Environmentally Sensitive Lands
(Environmental Impact Study) must be submitted to the
Palm Beach County Department of Environmental Resources
Management (copy to city) prior to or concurrent with
the submittal of the site plan to the city.
28. For projects that generate more than five hundred (500)
net trips per day, a traffic impact analysis must be
submitted which complies with the Municipal
Implementation Ordinance of the Palm Beach County
Traffic Performance Standards Ordinance.
a. For projects that generate two thousand (2,000)
or more net trips per day, the traffic impact
analysis must be submitted to the city at least 60
days prior to the deadline for site plan approval,
in order to allow for timely processing of the
site"plan application and review by the city's
traffic consultant and Palm Beach County. The
applicant shall be billed for the cost of review
by the city's traffic consultant.
b. For projects that generate between five hundred
(500) and two thousand (2,000) net trips per day,
the traffic impact analysis must be submitted at
least 30 days prior to the 'deadline for site plan
approval, in order to allow for timely processing
of the site plan application and review by Palm
Beach Co~nty. However, if it is the desire of the
applicant to 'utilize the city's traffic consultant
for review of the traffic impact analysis prior to
review by Palm Beach County, then the procedure
and requirements outlined under item "a" above
shall be followed.
NOTE :
Failure to submit traffic impact analysis in the manner
prescribed above may delay approval of the site plan
application.

29. In addition to the above requirements, the following
items shall be submitted to the Planning Department no
later than the site plan deadline: --
a. One copy of colored elevations for all buildings
and signage to be constructed on site. These
elevations must be of all sides of each type of
building and signage proposed and the colors
proposed must be accompanied by a numerical code

transparencies will not be presented to the
Planning and Zoning Board or City Commission.
