THIS EASEMENT, made this day of ,

R. WINCHESTER and ELSIE A. WINCHESTER, AS TRUSTEE for the BILL
RAY WINCHESTER II, TRUST. NO.1, dated December 31, 1975, and
under the SHERI MELODEE WINCHESTER TRUST NO.1, da ted
December 31, 1975, and under the KATHRYN JOY WINCHESTER TRUST NO.
1, dated December 31, 1975, and under the SUSAN PATRICIA
WINCHESTER Trust No.1, dated December 31, 1975, as parties of
the first part, and the CITY OF BOYNTON BEACH, FLORIDA, in the
State of Florida, as party of the second part.

That the said parties of the first part, in cons ider-
ation of the sum of One Dollar ($1.00) and for other good and
valuable consideration, the receipt of which 1.S hereby
acknowledged, hereby grant unto the second party, its successors
and assigns, a perpetual easement for the installation, operation
and maintenance of a sanitary sewer manhole within the easement
ar~a, as more particularly described under the heading "Easement
Description" below:
EASEMENT DESCRIPTION
From the current point of intersection of
Boynton Beach Boulevard (S. R. 804) with the
east line of that portion of Tract 9, as shown
on PALM BEACH FARMS COMPANY Plat Number 8,
Plat Boo~ 5, Page 73, Public Records of Palm
Beach County, Florida, lying south of Boynton
Beach Boulevard (S. R. 804), run south 700
feet to a point, thence run west 15 feet to
the Point of Beginning thence run west a
distance of 6 feet, thence run south a
distance of 12 feet, thence run east a
distance of 6 feet, thence run north a
distance of 12 feet'to the Point of Beginning.

It being understood, however, that parties of the first part,
their successors and assigns, and those holding by, through and
under them, reserve the right to, and may, construct, use and
maintain upon the easement as described herein any such improve-
ments as are permitted by applicable codes, ordinances, and
Statutes, and to use same for any lawful purpose. Party of the
second part agrees that the manhole will be installed so as to
make such lawful use of the surface by parties of the first part
reasonably practical. Should party of the second part perform
any excavation or other work in the easement area, it shall, at
its own expense, restore the easement area to its condition imme-
diately prior to such excavation or work.
