A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
ABANDONING, AN TWENTY ( 20 ) FOOT WIDE
UTILITY EASEMENT (QUAIL LAKE WEST); SAID

DESCRIBED HEREIN; AUTHORIZING THE MAYOR
AND CITY CLERK TO EXECUTE A DISCLAIMER
. FOR SAID EASEMENT; PROVIDING THAT THE
ATTACHED DISCLAIMER BE RECORDED IN THE
PUBLIC RECORDS OF PALM BEACH COUNTY ,
FLORIDA; PROVIDING AN EFFECTIVE DATE;
AND FOR OTHER PURPOSES.

WHEREAS, Frank E. Wyatt, Project Coordinator, as agent
for owner of said property, has requested the abandonment of
the hereinafter described twenty foot wide utility

easement; and
WHEREAS, conunents have been solici ted from the
appropriate City Departments; and
WHEREAS, public hearings have been held before the
City's Planning and Zoning Board and the City conunission on
the proposed abandonment; and
WHEREAS, based on the foregoing information, the said
road no longer serves any useful purpose.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1:
The City of Boynton Beach, Florida, by
and through its City Conunission, does hereby abandon a
certain twenty foot (20') wide utility easement, located in
the City of Boynton Beach, Florida and attached hereto as
(\
Exhibit "A".
Section 2:
The Mayor and City Clerk are hereby

! authorized and directed to execute and deliver the attached
Disclaimer and cause the same to be filed in the Public
Records of Palm Beach County, Florida.

Copies of letters from Utility Companies are forwarded as listed:
1. Southern Bell letter dated September 5, 1989
2. Florida Public Utilities letter dated September 6, 1989
3. Florida Power and Light Company letter dated September 27, 1989
4. National Cable letter dated September 29, 1989
Southern Bell has advised the City that in 1986 they were granted, by Quail
Lake, exclusive use of the northern most 50 feet of the proposed 800 feet
and will only agree to the abandonment under the condition that the legal
description be amended to exclude their easement.
Based on the above, if the legal description is amended to exclude the
Southern Bell easement, I recommend that the requested utility abandonment
be granted.

We offer the following comments on the petition to abandon a 20'
x 750' utility easement on the subject parcel:
1. The inlet from the sewer system must be sealed with a
masonry plug where it enters the City's system.
2. All portions of the abandoned sewer main which will fall
under building pads must be removed or filled by a method
acceptable to the project engineer or architect.
3. Manholes to be abandoned shall have the top sections removed
and the remainder filled, or the manhole removed in its
entirety.
In that we have no anticipated use for this easement as part of
the new site plan, we have no objection to its abandonment,
subject to the above conditions.
