Conditional Use (used car sales)
INTRODUCTION
~
Horace A. Williams, property owner, is requesting conditional use
approval for a used car sales lot to be located at 1099 North
Federal Highway. The proposed used car lot will consist of a
small sales office and a display area for the automobiles. No
service and/or repair of automobiles is proposed on the site.

The .21 acre parcel is occupied by a vacant office structure.
The parcel is is currently zoned C-4 (General commercial). Used
car sales are permitted in the C-4 zoning district, subject to
conditional use approval.
SURROUNDING LAND USES AND ZONING
Abutting the subject parcel to the north is a "take-out"
restaurant (Nuttin' But Ribs), zoned C-4. To the east across
North Federal Highway is a restaurant (The Chef's Touch Gourmet
Restaurant), zoned C-4. To the south is an automotive muffler
shop (Meineke Discount Muffler), zoned C-4. The F.E.C. Railroad
Track abuts the subject property to the west.
STANDARDS FOR EVALUATING CONDITIONAL USES
Section 11.2.D of Appendix A-Zoning, contains the following
standards to which conditional uses are required to conform.
Following each of these standards is the Planning Department's
evaluation of the application as to whether it would comply with
- the particular standard.
The planning and Zoning Board and City Commission shall consider
only such conditional uses as are authorized under the terms of
these zoning regulations, and, in connection therewith, may grant
conditional uses absolutely or conditioned upon the faithful
adherence to and of fulfillment of such restrictions and
conditions including, but not limited to, the dedication of
property for streets, alleys, and recreation space, and
sidewalks, as shall be necessary for the protection of the
surrounding area and the citizen's general welfare, or deny
conditional uses when not in harmony with the intent and purpose
of this section. In evaluating and application for conditional
use, the Board and Commission shall consider the effect of the
proposed use on the general health, safety, and welfare of the
community, and make written findings certifying that satisfactory
provision has been made concerning the following standards, where
applicable:
1. Ingress and egress to the subject property and proposed
structures thereon, with particular reference to automobile
and pedestrian safety and convenience, traffic flow and
control, and access in case of fire or catastrophe.
Two.driveways currently exist onto North Federal Highway from the
subject parcel. The southernmost driveway will be ~
eliminated, leaving the northernmost driveway as the only ingress ~
and egress to and from the site. This driveway will be marked

with pavement "in" and "out" arrows. This driveway is adequate
in providing access to and from the site. The location of the
proposed parking area is directly adjacent to the sales office;
thus, pedestrian access to the office is adequate. Vehicular
access from North Federal Highway to the parking area is also
adequate since traffic will enter and exit through a direct
access aisle from the roadway to the parking area, without
crossing through the display area. This is important in order to
maintain a reasonable distance between the flow of incoming and
outgoing traffic from the parked automobiles which are being
displayed. The way the site is presently designed, a customer
can drive into the site, park his automobile, and walk to the
sales office without having to meander around the automobiles
being displayed. Access to the site in case of fire is also
adequate.

2. Off-street parking and loading areas where required, with
particular attention to the items in subsection D.1 above,
and the economic, glare, noise and odor effects the
conditional use would have on adjacent and nearby properties,
and the city as a whole.
The site needs one (1) more parking space than what is presently
shown on the site plan, for a total of four (4). The reason for
this is that Appendix A - Zoning requires a minimum of four (4)
parking spaces for any non-residential use. There appears to be
sufficient space on the site to add one (1) more parking space.
Once this fourth parking space is added, parking will be adequate
to serve the proposed use. As mentioned in No.1. above,
pedestrian access is adequate.
The proposed use on this property will not create negative
effects on adjacent and nearby properties since general
commercial uses are already established in this vicinity. For
example, an automotive repair shop (Meineke Muffler Shop) is
existing directly south of the proposed used car sales lot. It
can be argued that an automotive repair shop is more intensive
than a used car sales lot, since the repair and/or service of
automobiles generates more noise and odor than a used car sales
lot. As previously mentioned, no repair and/or service of
automobiles is proposed on the subject property. There area no
significant noise and odor problems associated with the sale of
automobiles since the automobiles displayed remain idle for the
majority of the time.
With respect to glare, refer to item No. 6 below.
3. Refuse and service areas, with particular reference to the
items in Subsection D.1 and D.2 above.
Adequate refuse and service areas presently exist to serve the
proposed use.
4. utilities, with reference to location, availability, and
compatibility.
The existing utilities are adequate to serve the proposed use.
It should be pointed out, however, that a portion of the existing
structure encroaches on a dedicated alley which contains an
active underground sewer line (rear of property). The portion of
the structure that encroaches on the alley appears to have been
constructed by a previous owner without the required permits. As
indicated by the Building Department memorandum, (Memorandum No.
91-285, Comment No.1) all portions of the structure that were
erected without permits must be demolished. Once this portion
of the structure is demolished, there will not be a building
encroachment on the alley. In addition, the alley is being
abandoned concurrently with this conditional use application. As
indicated in the utilities Department memorandum, (Memorandum No.
91-408) a utility easement must be dedicated along the alley.

And as indicated by the Engineering Department memorandum,
(Memorandum No. 91-143CC, Comment No.8) an indemnification letter
should also be provided in order to ensure that the property
owner will assume all responsibility for any damage done to the
portion of the pavement area that is over the utility easement as
a result of any work performed on the utility line by the City of
Boynton Beach, The removal of the rear portion of the structure,
abandonment of the alley and the dedication of a utility easement
along the abandoned alley are conditions of approval of this
application. As a point of information, the applicant/owner has
agreed to comply with all of these conditions.
5. Screening, buffering and landscaping with reference to type,
dimensions and character.

The existing site does not have any significant landscaping at
this present time. The proposed site plan shows a significant
amount of new landscaping which, for the most part is being
provided voluntarily by the applicant. The site plan shows
approximately four new yellow tabs (10 feet in diameter), four
satin leafs (10 feet in diameter), and a twenty-four inch (24)
silver buttonwood hedge around the perimeter of the property. The
site plan also shows nine-hundred (900) square feet of new st.
Augustine grass that will be planted throughout the site. The
proposed landscaping will significantly improve the aesthetic
appearance of the entire site and would provide adequate
buffering from the adjacent properties.
6. Signs and proposed exterior lighting, with reference to
glare, traffic safety, economic effect and compatibility
and harmony with adjacent and nearby properties.
One free-standing site identifying the use is proposed on the
landscaped strip just south of the driveway. The proposed sign
will have to comply with all relevant provisions of the new sign
code. No signs are proposed on the building. As indicated in
the attached Engineering Department memorandum, (Memorandum
91-143CC, Comment No.6.) the lighting that is proposed on the
site contains luminaries that are too powerful (1,000 watts) and
may create a glare problem. Thus, the power of the lighting
needs to be decreased to the wattage recommended by the
Engineering Department (400 watts),

7. Required setbacks and other open spaces.
Once the portion of the structure that encroaches on the alley is
removed, all setback requirements will be complied with.
8. General compatibility with adjacent properties, and other
properties in the zoning district.
As previously discussed, the surrounding land uses include a
"take-out" restaurant to the north, and a muffler repair shop to
the south, both of which are zoned C-4 (General Commercial). The
subject property is also bounded by North Federal Highway to the
east and the F.E.C Tracks to the west. Since the subject
property lies within an established commercial corridor and is
surrounded by general commercial uses with direct access to a
major thoroughfare (North Federal Highway), it can be argued that
the proposed use is generally compatible with the surrounding
properties. It is not anticipated that the proposed used car
sales lot will exacerbate existing conditions on the site and
adjacent properties, nor have a significant negative effect on an
area which has been developed for commercial uses for an extended
period of time.
The C-4 (General Commercial) zoning district permits uses which
can be construed to be more intensive than a used car sales lot. ~
For example, the C-4 zoning district permits automotive repair
facilities and automobile paint and body shops. As previously
mentioned, automotive repair stations and paint and body shops

can be considered to generate more noise, odor, and negative
externalities than a used car lot which does not offer any repair
services. Thus, it can be argued that a used car lot is
generally compatible with and is within the scope of the C-4
zoning district.
9. Height of buildings and structures, with reference to
compatibility and harmony with adjacent and nearby properties,
and the City as a whole.
The building is one (1) story, which is compatible with the
surrounding buildings.
10. Economic effects on adjacent properties and the City as a
whole.

For reasons already stated, it is not anticipated that the
proposed used will have an adverse economic impact on
adjacent properties or the City as a whole. conversely,
due to the small size and scale of the proposed use, it is
not anticipated that the proposed used will generate
significant economic benefits for the city as a whole,
although occupancy and general maintenance of the subject
property may improve the appearance and vitality of the
general area.
Comprehensive Plan policies:
This request, subject to the attached staff comments, is
consistent with all relevant policies contained in the 1989
Comprehensive Plan.
Conclusion/Recommendation:
~
The Planning Department recommends that this request for
conditional use approval be approved, subject to the attached
staff comments. This recommendation is based in part, on the
arguments that have been presented in this memorandum and the
fact that the proposed used car lot will not create additional
negative impacts on the surrounding areas since this portion of
North Federal Highway is a well recognized and established
commercial corridor. In addition, the subject property is not
directly adjacent to any residential properties which could be
negatively affected. Access to and from the site will be
exclusively through North Federal Highway, which is major
arterial roadway. The proposed landscaping, sodding, irrigation,
and general building maintenance will also significantly improve
the appearance of the site and the surrounding properties.

Upon review of the above mentioned project, the following list of

parking spaces consistent with Appendix A-Zoning, Section

5. Submit a copy of the recorded survey of the property showing
the land acquired by the abandonment including the
dedication of the required utility easement.
In order to facilitate the permitting process, the following
information should be included within your documents submitted to
the Building Department for required permits:
1. Provide detail drawings specifying that the site lighting
poles are designed to meet the windload requirements of
Chapter 12, standard Building Code, 1988 Edition.

In accordance with the City of Boynton Beach, Florida, Code of Ordinances,
specifically Chapter 19, Section 19-17, "Plan Required", including Chapter 5,
Article X, "Boynton Beach Parking Lot Regulations", Section 5-142 inclusive,
the applicant for the above referenced project shall submit the following plan
revisions, information and technical data.
1. The applicant shall provide a photometric plan depicting the level of
illumination within the parking facility. Lighting systems shall be photo-
cell activated and plan submissions shall comply with the requirements as
set forth in Section 5-142(a) , "Required Lighting", including Section 5-142(g) ,
"Lighting Standards".
2. Provide handicap stall striping details which conform to the requirements set
forth in the Department of Community Affairs Accessibility Requirements Manual
(lastest edition). Section 5-142(k), "Handicap Requirements".
3. Provide raised continuous concrete curbing where parking stalls abut landscaped
areas in accordance with Section 5-142(e) , "Required Curbing". Curbing shall
be interrupted to facilitate stormwater drainage into grass~d areas.
4. Clearly depict upon the submitted plans, the proposed vehicle display area.
The display area shall not block the ingress/egress aisle .nor encroach upon
the 27 feet free backup area for the designated standard and handicap stalls
as specified within Section 5-142 appendix.

5. Federal Highway shall be posted with standard Department of Transportation
approved (No Parking) signage in accordance with the State of Florida,
Department of Transportation's "Roadway and Traffic Design Standards",
Index 1117358.
6. The specified lighting system contains luminaires with the equive1ent of
1,000 watts and in order to abate glare, the lighting system should be modified
in order to limit glare. Standards and luminaires types shall be modified to
utilize energy efficient fixtures with an approximate wattage of 400 watts.
Additionally, light poles should be located outside of the subject easement
area. Factors to be considered by committee in review.
7. The Engineering Department recommends that the applicant provide proof of a
Building Permit for the addition that is encroaching upon a public dedicated
rights-of-way. As the structure is constructed over a force main the Engineering
Department recommends demolition of the addition if proof of permits cannot be
provided to the City.
8. The pavement area, as depicted upon subject plans, encroaches upon a public
dedicated rights-of-way and a letter of indemification shall be provided to
the City of Boynton Beach to ensure that utility repairs, construction or
reconstruction, within the alley which may cause damage to the parking lot, will
result in the parking lot being repaired at the owners expense.
9. The drainage plans addresses water quality (2.5 inches) but has no positive
outfall, therefore a 3 year - 24 hour analysis is required.

RIDER TO SITE PLAN APPLICATION
The undersigned as applicant for Final Site Plan Approval does .
hereby acknowledge, represent and agree that all plans,
specifications, drawings~ engineering, and other data submitted with
this application for review by the City of Boynton Beach shall be
reviewed by the various boards, commission, staff personnel and other
parties designated, appointed or employed by the-City of Boynton
Beach, and any' such party reviewing the same shall rely upon the
accuracy thereof, and any change in any item. submitted shall be deemed
material and substantial.
The undersigned hereby agrees that all aspects of the proposed
project shall be constructed in strict compliance with the form in
which they are approved, and any change to the same shall be deemed
material and shall place the applicant in violation of this
application and all approvals and permits which may be granted.
The applicant acknowledges that the City of Boynton has all
rights and remedies as provided for by the applicable codes and
ordinances of the City of Boynton beach to bring any violation into
compliance, and that in the event of enforcement action by the City,
the applicant shall indemnify, reimburse and 'save the City of Boynton
Beach harmless from any costs, expense, claim, liability or any action
which may arise due to their enforcement of the same.

I. (a) Governmental police power.
(b) Any law, ordinance or governmental regulation relating to environmental protection.
(c) Any law, ordinance or governmental regulation (including but not limited to building and zoning ordinances)
restricting or regulating or prohibiting the occupancy, use or enjoyment of the land, or regulating the character,
dimensions or location of any improvement now or hereafter erected on the land, or prohibiting a separation in
ownership or a change in the dimensions or area of the land or any parcel of which the land is or was a part.
(d) The effect of any violation of the matters excluded under (a), (b) or (c) above, unless notice of a defect, lien or
encumbrance resulting from a violation has been recorded at Date of Policy in those records in which under state
statutes deeds. mortgages, lis pendens, liens or other title encumbrances must be recorded in order to impart constructive
notice to purchasers of the land for value and without knowledge; provided, however, that without limitation, such
records shall not be construed to include records in any of the offices of federal, state or local environmental protection,
zoning. building. heallh or public safety authorities.

Please be advised that the planning and Zoning Board met on
Tuesday, August 13, 1991, and took the following action:
1. Unanimously elected an Acting Chairman, Nathan Collins, in
the absence of Mr.Rosenstock and Mr. Lehnertz.
2. After conducting a public hearing, unanimously recommended
approval of the request submitted by Horace Williams for the
abandonment of a 20 foot wide alley at 1009 North Federal
Highway, subject to proviso. The motion was made by Mrs.
Greenhouse and seconded by Mr. Howard. (PM91-197)

3. After conducting a public hearing, unanimously recommended
denial of the conditional use request submitted by Horace
Williams to establish a used car lot to be known as IWilliams
Auto Sales at 1009 North Federal Highway. The motion was
made by Mrs. Huckle and seconded by Mrs. Greenhouse.

4. After conducting a public hearing, recommended denial of the
request submitted by the City, in connection with the
Boynton Beach Activity Center site plan, of a variance to
Section 5-138 "Scope"(a) of Article X-parking Lots~ The
motion was made by Mrs. Greenhouse and seconded by Mrs.
Huckle. The vote was 4-2 with Mr. Collins and 'Mr. Hinson
dissenting. The Board unanimously approved the request of
the variance to Section 5-142(h}(7) "Driveway" ,of Article X,
parking Lots. The motion was made by Mrs. Huckle and
seconded by Mrs. Greenhouse. (PM91-200)
5. Unanimously recommended approval of the site plan request
submitted by the City for the Boynton Beach Activity Center;
a 6,640 square foot recreation activity center and 89 space
parking lot to replace the existing Tennis Center, subject
to proviso. The motion was made by Mrs. Greenhouse and
seconded by Mr. Howard. (PM9l-201)
6. The Board approved in part and denied in part the master
plan modification submitted by Kilday and Associates for the
Shoppes of Woolbright P.C.D. as follows:
a) Denied the request for an additional driveway onto
Woolbright Road (item #1 of Planning Department
Memorandum No. 91-165). The motion was made by Mrs.
Huckle and seconded by Mrs. Stevens. The vote was 5-1
with Mr. Collins dissenting.
b) Unanimously approved the request to change the size,
number of stories and use designation of the outparcel
at the northeast corner of Woolbright Road and S.W. 8th
Street from a 4,300 square foot retail building to a
two story, 6,000 square foot bank (item #3 of Planning
Department Memorandum Mo. 91-165). The motion was made
by Mrs. Huckle and seconded by Mrs. Greenhouse.

c) Unanimously approved the request to add another
driveway onto S.W. 8th street from the shopping center
and outparcels and to relocate the approved driveway
southward, subject to eliminating one of the two access
aisle connections between the outparcels and Home Depot
and relocating the remaining access aisle connection to
behind (east) outparcel 2, (items #4 and #5 of Planning
Department No. 91-165). The motion was made by Mr.
Howard and seconded by Mrs. Huckle.

The Board accepted the Planning Department's recommendation
to require the amended plans within 3 weeks of the date of
approval rather than within the time period stated in
condition #1 of Planning Department Memorandum No. 91-183.
The request to change the size and use designation of the '
outparcel at the northeast corner of Woolbright Road and
s.w. 8th street (item #2 of Planning Department Memorandum
No. 91-165) was withdrawn at the applicant's request. In
addition, the applicant is requesting an appeal to the
Planning and Zoning Board's denial of the request for an
additional driveway onto Woolbright Road-(a} above.

7. Unanimously made a finding of consistency with the
Comprehensive plan for the amendment to Chapter 19 to
implement a new site plan review ordinance, subject to
proviso. Motion was made by Mrs. Greenhouse and seconded by
Mr. Howard. In addition, the Board requested that they
receive a copy of the revised ordinance prior to the
September 3, 1991 City Commission meeting. (PM91-202)
8. Deleted the consistency review determination of the proposed
Adminstrative Procedures Ordinance from the agenda since
this ordinance has not been completed by staff. This item
will be placed on a future planning and Zoning Board agenda.
9. The Board tabled action with respect to the consistency
review determination of the proposed amendment to Appendix
A-Zoning, Section 11.1 of the Code of Ordinances to allow
for expansion of nonconforming structures, until the
September 10, 1991, Planning and Zoning Board meeting to
allow staff sufficient time to incorporate the changes
recommended by the Board.
10. The Board accepted the planning Department's recommendation
to postpone the consistency review of the proposed
amendments to Appendix B-Planned Unit Developments of the
Code of Ordinances, Section 6.F - Planned Commercial
Development District and Section 7 - Planned Industrial
Development District of Appendix A-Zoning of the Code of
Ordinances to create time extensions for master plan
approvals, until the September 10, 1991 planning and Zoning
Board meeting.
11. Deleted the consistency review determination of the proposed
amendment to Appendix A-Zoning to allow towing companies in
the M-l, Light Industrial zoning district from the agenda.
12. Unanimously made a finding of consistency with the
Comprehensive Plan for the amendment to the Zoning Code to
allow wholesale/distribution of prepackaged and prepared
meat and poultry in the C-4, General Commercial, zoning
district, subject to proviso. Motion was made by Mrs.
Greenhouse and seconded by Mr. Howard. (PM91-199)

13. Unanimously approved the. Lawrence Lake PUD 12 month time
extension for exemption from concurrency, subject to posting
surety for the incomplete, required improvements. The
motion was made by Mrs. Stevens and seconded by Mr. Howard.
14. Unanimously recommended that the City Commission initiate a
change to the minimum frontage required by the Code of
Ordinances for service stations with or without major
repairs from 175 feet to 240 feet. The motion was made by

Nat Collins called the meeting to order at 7:05 p.m. ,Following
the Pledge of Allegiance to the Flag, the Recording Secretary
called the roll. In the absence of Chairman Rosenstock and Vice
Chairman Lehnertz, Murray Howard moved to elect Nathan Collins as
Chair. The motion was seconded by Marilyn Huckle and carried
unanimously.
AGENDA APPROVAL
Due to the fact that a representative for Lawrence Lakes was pre-
sent in the audience, Chris Cutro asked that Item B, Concurrency
Exemption Time Extension, be moved up on the Agenda just after
Item C, Master Plan Modifications.
Cynthia Greenhouse asked that 7-A(1) and 7-A(2) be switched since
the conditional use should be determined before the abandonment.
APPROVAL OF MINUTES
Cynthia Greenhouse asked that the minutes of the July 9th meeting
reflect the ~act that her absence was excused.
At this point, discussion ensued regarding the absence policy.
Marilyn Huckle questioned the policy and seemed to recall that
the pOlicy had been changed so that after three absences, a mem-
ber was removed from the Board. Chris Cutro will check the
policy and report back to the Board at the next meeting. Murray
Howard, Marilyn Huckle and Shirley Stevens asked that the record
reflect the fact that, when necessary, they called the City
Clerk's Office to advise of their absence.
Marilyn Huckle asked that the July 9th minutes be corrected on
Page 14 to read, "...that restaurants should never be approved as

conditional use in C-l zoning districts if they are not

Ms. Huckle also mentioned that there was a great deal of con-
fusion at the July 9th meeting and brought up the motions as pre-
sented on Page 11 of the minutes with regard to Application #26.
She mentioned that the motion was changed many times and believes
she voted against the final motion. She asked that the minutes
reflect the fact that she has misgivings about the vote on
Application #26.
Marilyn Huckle moved to accept the minutes of July 9, 1991 with
corrections which was seconded by Shirley Stevens. The motion
catried unanimously.
Chairman Collins recognized the presence in the audience of Vice
Mayor Ed Harmening.

posed used car sales lot consisting of a small sales office at
the rear of the property and a display area. No service or
repair of automobiles is proposed on this site. The parcel is
approximately 20/l00ths of an acre and currently zoned C-4

(General Commercial). Used car lots are permitted in the C-4
zoning district subject to conditional use approval. The
surrounding uses are Nuttin' But Ribs abutting the parcel to the
north, to the east, across Federal Highway is The Chef's Touch
gourmet restaurant, to the south is Meineke Muffler Auto Repair
Shop and FEC Railroad tracks abut the property to the west.
The Planning Department recommends approval of this conditional
use subject to staff comments. The recommendation was based on
the argument that the addition of a used car lot would not create
additional negative impact. In addition, the proposed new
landscaping and general building maintenance would improve the
overall appearance of the site and surrounding area.
The three staff comments include:
1. To demolish a portion of the existing building which
encroaches on the 20' alley:
2. To dedicate a utility easement on the alley since an
active sewer line runs to that alley in a north/south
direction: and
3. Provide a letter holding the City harmless for any work
done on that utility line.
All property owners within 400' were notified by mail.
Cynthia Greenhouse questioned Mr. Gonzalez at length about the
Planning Department's recommendation to approve this conditional
use. She pointed out that in order to get to all of the residen-
tial areas on the waterfront', North Federal Highway must be used.
She stated that N & D Auto approached the Board with many promi-
ses to be a clean operation. , They have been consistent viola-
tors. She could not understand how the Planning Department
argued that this would have no negative aesthetic impact on the
surrounding area. Mr. Gonzalez again explained that this
request is consistent with other uses in this C-4 zoning district
and felt there would be no negative aesthetic impact.

Murray Howard asked if the property owner could erect a used car
lot at this location without the approval of the Planning and
zoning Board. It was explained that conditional use approval is
necessary for the property owner to erect this lot.
Ms. Greenhouse further stated that used car lots must be approved
by the City Co~mission. They are generally considered
"eyesores". She further stated that at the last Commission

meeting, one of the Commissioners stated that he would like to
see C-4 zoning eliminated in the Federal Highway corridor.
Mr. Cutro explained this is an active application and even though
Mr. Aguila asked that C-4 zoning be reviewed by staff, that has
no effect on this particular application. Ms. Greenhouse pressed
Mr. Cutro as to his feelings about the addition of another auto
shop on Federal Highway. Mr. Cutro explained that he fully sup-
ports the recommendation made by his staff and believes this
would not have a negative impact on the area.
Shirley Stevens stated it is her feeling that a used car lot
would create a traffic problem. People will be test driving the
cars throughout the neighborhood. She pointed out how hard the
people in Delray Beach fought against the car dealerships. She
is against a used car dealership in this area. She wants to
improve this area and will vote against this application.

Mr. Howard wondered, if approval was given, could the Board order
that no repairs be performed at this site. Mr. Cutro explained
that the applicant has indicated no repairs will be done at the
site. Mr. Howard felt he could not support this because there
would be only a verbal agreement. Mr. Cutro pointed out that an
environmental permit would be required. Such a permit could ,put
a condition on the owner that no repairs be done. Mr. Howard
feels the applicant could return seeking approval in the future.
Marilyn Huckle feels the Board should be careful about precedent
setting. There is not a lot of C-4 zoning in the City, but what
exists serves a very good purpose. To approve this conditional
use might set a precedent and the Board would have no recourse
but to grant additional conditional uses such as this in the
future. She cannot support this application.

Andy Williams, 126 S.W. 10th Avenue, stated that he intends to
have a boutique-type retail car lot only. No repairs will be
done at this site. He plans a chain of these lots. He was
insulted to have been compared with N & D Auto. He has met and
agreed to all of the recommendations by the Planning Department.
He will upgrade the area from an "eyesore" and a crack den and
make it more beautiful. He promi$ed the Board his business will
be one of the cleanest, nicest and most attractive businesses.
In the time he has owned the property, he has cleaned up the
trash and debris he found on the property. His repair shop is
located in an industrial area in Boynton Beach.

With no further questions by the Board, Chairman Collins OPENED
THE PUBLIC HEARING.
Lloyd Powell, Officer of the Alpine Seven Co., Inc., owning pro-
perty at 1112 North Federal Highway, spoke against the approval
of this application. Mr. Powell questioned the location of this
business on North Federal Highway. He believes all conditional
uses should be removed along the North Federal Highway corridor.
THE PUBLIC, HEARING WAS CLOSED.
Shirley Stevens again underscored precedent setting. Once such a
conditional use is permitted, it will be extremely difficult to
deny such a use in the future.
Ms. Huckle believes the applicant is sincere. However, once the
conditional use is approved, if the applicant does not stay in
business, someone else could come in and mess up terribly.
Assistant City Attorney Yamile Trehy pointed out that Section
11.2(d) sets forth the standards for evaluating conditional use.
She read a list of items to be considered and stated that recom-
mendations should be based on these findings.
Motion
Marilyn Huckle moved to DENY the applicant, Williams Auto Sales,
conditional use to allow for establishment of a used car lot at
1009 North Federal Highway., Cynthia Greenhouse seconded the
motion which carried 6-0.

In response to a question by Cynthia Greenhouse, Mr. Cutro stated
that the abandonment of the alleyway would have no effect on the
conditional use. It was determined that the applicant still
wished to have the alley abandoned. Mr. Cutro recommended the
abandonment be conditioned on the owner demolishing the portion
of the building which encroaches it.
Ms. Huckle asked the applicant if he still wanted the abandonment
of the alleyway. Mr. Williams responded affirmatively since it
might aid in the sale of the land. It was pointed out to Mr.
Williams that the Planning and Zoning Board's recommendation will
go to the City Commission for a final vote. Mr. Williams was
familiar with all of the staff comments and was in.~greement with
them. '
THE PUBLIC HEARING WAS CLOSED.
Motion
Cynthia Greenhouse moved to APPROVE the request for the abandon-
ment of the 20' wide alleyway located at 1009 North Federal
Highway subject to all staff comments. The motion was seconded
by Murray Howard and carried 6-0.

Beach, introduced H. Andy Williams, property owner. Mr. Williams
resides at 126 SW 10th Avenue. Mr. Williams' plan is to beautify
this particular section of the Federal Highway corridor. The lot
will be used to sell and display quality, attractive used cars.
No service or repairs will be permitted on the property. All
work will be done off the premises in an industrial area in
Boynton Beach. There will be between twelve and fifteen cars
displayed. All landscaping will meet or exceed Code require-
ments. Mr. Williams wants his business to be the most attractive
business on Federal Highway. He would like to set an example for
all other business to follow. He asked that he not be compared
with any other used car dealer. He has invested his life savings
into this project. He will be owner and manager of the business.
He has lived here for over ten years and cares how businesses are
owned and operated in Boynton Beach.
Eleanor Shuman pointed out that every used car lot she has seen
generally has lettering allover the cars exhibiting price, etc.
Mr. Williams stated this would not be the case on his lot. He
explained that although his lot will be open to the public, it
will almost be tlby invitation onlytl. This business will be very
low profile.

the property. He stated he ,could put a wood fence, but feels the
chain link is better for security. Shrubs and hedges will be put
around the fence.
Chairman Armas ,pointed out the plans show the plants and hedges
on the inside of the chain link fence. 'He explained that hedges
are generally used for screening. Mr. Williams is willing to
move the fence behind the hedges. Mr. Williams welcomed
suggestions from the Board.
Chairman Armas pointed out that if the 61 chain link fence is
hidden by 61 hedges, the view of the merchandise will be
obstructed. However, a fence is necessary to secure the pro-
perty. Chairman Armas suggested, a~d Messrs. Davis and Williams
agreed, that the fence be moved back to the edge of the asphalt.
The hedge will be placed along the front and sides of the pro-
perty, inside the fence.
Jean Sheridan questioned Mr. Haag about the Code with regard to
the fence. Mr. Haag explained that the motion must include the
fact that the fence needs to be behind the hedge. There are no
Code requirements regarding this matter. It was pointed out that
during the TRB'review, there was no problem with the location of
the fence. Chairman Armas asked Mr. Williams if any thought had
been given to painting the fence. Mr. Williams stated he used .
the suggested coastal village motif for the area in order to keep
everything looking the same: however, he agreed to paint the
fence. ~r. Williams will use Sherwin-Williams BM9-23 (beige) to
paint the fence.
Eleanor Shuman raised questions about the signing. Mr. Haag
explained the sign will have to meet Code requirements, but it
came before this Board for aesthetic review. A drawing was
shown to the Board. The sign will be a simple plexiglass,
lighted sign. There will be no flashing lights.
Dale Mitchell suggested that a cold-tolerant plant, such as vari-

Coordinator, to explain the background of th1S s1t~a~1on. e
explained that a great deal of time goes towards,a1d1ng an~ com-
forting the citizens of Boynton Beach, but somet1mes, a maJor
difference is made.
On August 6th, an eight-month old infant was ,successfully
resuscitated from a drowning in a family pool. Sgt. Harris was
dispatched and found the child in,cardiac arrest, secondary to
drowning in the pool. He began CPR immediately. He continued
mouth-to-mouth resuscitation even though the child continued to
vomit. When Fire and Rescue units arrived, they took over the
resuscitation until a back-up Rescue unit arrived. Upon arrival
at the hospital, the child was breathing on her own. She was
discharged from the hospital the next day with no ill effects.
This life was saved through the combined efforts of three
separate departments. Sgt. Harris, ,the Fir~ and Rescue personnel
were commended.
City Manager Miller and Mayor Weiner presented a Certificate:of
commendation to Sgt. Marlon Harris for professionalism, dedica-
tion and heroism in saving the life of a child.
Sgt. Harris thanked Jim Ness for his back-up work.

Jeff Kenbaucher, Gill Rahrig, Ed Esteves, Bob Sears, Capt. Bob

Mr. Cutro stated staff recommended approval of the conditional
use to the Planning & Zoning Board; however, the PZB unanimously
recommends denial of the request.
Mr. Andy Williams, 126 SW 10th Ave~ue, Boynton ~each, spoke on
his own behalf. He has been working with staff for months in an
attempt to conform with every conditional use. He plans a small,
low-key 9~eration. He has spent a considerable amount of money.
He has watched the neighborhood decline and would like to stop
that from happening. He,has already cleaned up the area. His
business will be an attractive" low-profile used car lot. No
repairs will be done on the premises. Repairs will be done
locally at shops in Boynton Beach. He is interested in clean,
retail sales only. He expressed his concern that local residents
must go to Delray and Lake Worth to purchase an auto.
MAYOR WEINER OPENED THE PUBLIC HEARING.
Commissioner Matson asked Commissioner Artis to read a letter
into the record from Don Faron of 602 N.E. 20th Lane, Boynton
Beach, Florida. The letter expressed the opposition of the resi-
dents of the Watersedge Community to the used car lot at this
location. The Commission was urged to support the Watersedge
community-by voting ~ to approve the ,application. (The letter
is on file in the City Clerk's Office with the original copy of
the minutes.)

Commissioner Artis questioned whether there is any way to assure
that Code Enforcement could enforce not changing oil and making
repairs on this particular lot. Mr. cutro explained if the city
Commission chooses to appr~ve this application, a separate motion
is needed approving a license. Conditions can be attached to
that license.
Commissioner Artis wondered what would happen to the property if"
Mr. Williams chooses, in the future, not to continue. Mr. Miller
explained the conditional use will be lost. He further stated
this is a conditional use for a use only, not for ownership. Mr.
Williams could sell this lot to another individual and as long as

it is operated in the same mariner, there would be nO'problem.
However, if the operation ceases for a period of six months or
more, the conditional use will be lost. Mr. Cutro explained that
the conditional uses placed on the license would also transfer
with the license.
Commissioner Matson made mention of the fact that at the last
Commission meeting, Commissioner Aguila brought up the subject of
C-4 zoning along Federal Highway. She remembered staff being
directed to look into drawing up an Ordinance to eliminate this
type of use in C-4 zoning.
City Attorney Cherof explained that there having been a vote of
the Commission not to impose the zoning in progress Ordinance or
restriction, the Commission is obliged to consider Mr. Williams'
application.
Mr. Williams again approached the podium to explain that he
acquired the property approximately five months ago. He had no
idea it0/'6uld be so difficult to open his business. He has
agreed to meet every condition. He doesn't plan to do repairs at
the location, but that can be a condition placed on the use. He
doesn't intend to sell this business. He plans to grow ,and even-
tually retire. He is willing to meet every condition and spend
his life savings on this business. He has'gone through every
step personally. He has presented his case honestly. He is
meeting a conditional use. He bought a book and has read it over
and over again. The book says this can be done and he does not
understand why anyone would want to stop it. This will be a
lifetime investment for him. He questioned why he should have to
fight to go into business to make a living.. He stated that the
used car business is a tough business and has a bad reputation.
He wants a chance to operate this business. He explained \::hat it
has gotten'very expensive just to get the doors open.
Cynthia Greenhouse, 618 N.E. 20th Lane, spoke as a member of the
Planning & Zoning Board and a resident living in the immediate
area. She explained that in determining whether or not to
approve this conditional use, the Planning & Zoning Board con-
sidered all of the facts that the City Attorney pointed out in
rendering a decision. After careful consideration, they deter-
mined unanimously this is not the use they want to see continued
on Federal Highway. She stated that it is a conditional use
because the City thinks it may have a negative impact on the
surrounding residences. She claimed that if a business ceases to
operate for over six months at this location, it looses its sta-
tus of beiQg able to be a used car lot at that location. Any ,
purchaser would be aware of that. She claimed to have no quarrel
with Mr. Williams and believes he intends to have a beautiful
operation: however, there is nothing the Commission can do to
prevent him from selling the business to anyone in the future.~

She pointed out past experiences with car shops on ,Federal. She
feels many of the businesses are beginning to look quite attrac-
tive in the area and asked the Commission to support the resi-
dents i~ denying this application.
City Attorney Cherof corrected Ms. Greenhouse by stating that a
conditional use is not a use that.the City has designated as one
of the uses they want to phase out. A conditional use is one
which is permissible provided there are certain conditions
applied to it to control the situation.
Vice Mayor Harmening moved to APPROVE the conditional use.
Vice Mayor Harmening explained that many people cannot afford to
buy new cars. He feels business ~ou1d be quite good for a used,
car dealer. Mr. Williams has convinced him he will run a clean
operation and ,deserves a chance, He also feels U.S. 1 can stand,
and has in Lantana, Lake Wo~th and Delray Beach, many automobile
dealerships, both new and used.
Commissioner Artis seconded the motion which carried 2-2. The
motion FAILED. (Mayor Weiner and Commissioner Matson cast the
dissenting votes.)

Margaret Newton, 701 NW 4th Street, questioned the Commission
regarding the redistricting of Baynton Beach. Mayor Weiner
informed her the redistricting is being considered and explained
it is being done because of the 1990 census. The demographics
have changed. Mr. Cutro is drawing up two maps in each of the
four districts of the City. There will be approximately 11,000
people in each district so that each district will have the same
numbers of people. Since the Commissioners, regardless of
district, run City-wide, this will only have to do with where you

back burner. in order to perform other duties. The only input
given by the developers was the original idea. The Planning
Department expanded on that idea. Developers call weekly to
check on the status. Their questions are answered. Mr. Cutro
stated he and Mr. DeSanti have never had a conversation regarding
this issue.
vice Mayor Harmening stated that he was only referring to one
service station at 15th and Woolbright. He claims to have very
seldom gone on record to defend staff; however, it is seldom we
come up with "new" ideas. We generally consult history and what
is currently going on for ideas. He had no objection with staff
inquiring as to standards in the industry. We call many cities
for input and they call us in return. It is his feeling that the
City should be able to control its own destiny.
Ralph Marchese, 1901 SW Roma Way, stated that reviewing-ordinan-
ces is a daily job. The law is quite specific; a 1,000' separa-
tion. The law needs to be upheld. If a change is necessary,
then do it, but don't "dump" it down 'the drain.
Marty Perry, 400 Australian Avenue, West Palm Beach, suggested
the current ordinance of 1,000' allows for twenty gas stations
without any major concern at all. It is possible solutions can
be found if the ordinance is reviewed. It is good to put all
ideas together and come up with a reasonable response. He
requested the process be started.
Motion
Commissioner Aguila moved to have Mr. Cutro and the Planning
Department staff, with Attorney Cherof's assistance, come up with
a "white paper" which will include a series of ordinances
including what is presently in place. This will be presented to
the Planning & Zoning Board for their review and recommendation.
The "white" paper" and the Planning & Zoning Board's recommen-
dation will be presented at the second city Commission meeting in
October for Commission review and direction to Attorney Cherof to
write the Ordinance. Commissioner Matson seconded the motion
which carried 5-0.
B. Items for discussion requested by Commissioner Jose Aguila
1. New/Used Auto/Truck/Boat/RV dealerships in Boynton Beach

Commissioner Aguila questioned how the Commission feels about
these dealerships in Boynton Beach. In his opinion, done pro-
perly and enforced, he is in favor of all of these uses in
Boynton Beach.
Commissioner Matson would not like to see any of these uses in
Boynton Beach. Commissioner Artis feels if they can be main-
tained, she would agree to the uses in Boynton Beach.

Vice Mayor Harmening is in favor of all of these uses, but agrees
regulations are n~eded to maintain a reasonable appearance.
Mayor Weiner is not in favor of any of these uses.
In response to a question by Commissioner Artis, City Manager
Miller stated Code Enforcement will cite these businesses but
they cannot be closed down unless they are taken into court.~.
Commissioner Aguila pointed out that he had read the minutes:,of
prior meetings regarding Williams Auto Sales conditional use~ He
felt this was a person trying to do something nice in an area
which needs something nice, but our concern was with what will
happen when he sells. The City spends a lot of time claiming to
be pro-business and pro-development, but we do everything to pre-
v~nt someone from doing something nice. Commissioner Aguila
feels it is the Commission's responsibility to decide whether or
not we want these uses in Boynton Beach, and if not, thpy should
be removed from the conditional use category so as not to deal
with this in the future. If it is decided the uses are
appropriate, a decision should be made as to where the City wants
them. He ~sked the Commission for a consensus on appropriate
uses and where the uses are appropriate either by zoning classi-
fication or areas of town.
Vice Mayor Harmening pointed out that traditionally many of these
uses have been along U.S. l~ however, many stations along U.s. 1
are closing. He wasn't sure a dealership would want to open on
u.S. 1. Also, it was decided years ago that the C-4 zoning was
ideal for such uses.

Cynthia Greenhouse spoke with the homeowners' association at
Watersedge which is located east of Federal Highway. She also
spoke with Bill pike and Lloyd Powell who owns a business along
Federal Highway. She has received no favorable comments
regarding a used car lot along Federal Highway. A large block of
residents are affected in this corridor. Used car lots do not
beautify the City. The residents don't want them nor do the
surrounding businesses surrounding them want them. She suggested
the idea of eliminating C-4 zoning from Federal Highway be
addressed in an attempt to keep these uses out of that area.
Vice Mayor Harmening pointed out that Alpine Florist looked ten
times better when it was owned by La Montagne than it does today
owned by Mr. Powell~ however, Mr. Powell objects to these uses
around his business.

Andy Williams, 126 SW 10th Avenue, disagreed with some of the
comments made. He was denied a proposed boutique-type used car
lot. He continued to discuss the type of business he wished to
establish on Federal Highway. He pointed out that only three

businesses ,along Federal Highway conformed to the coastal-type
motif. He claimed to have conformed to every condition. He
spent a great deal of time and money to comply~
At this point, Mayor Weiner explained that this case was already
heard and decided on. Mr. Williams stated he would like the case
reheard and was informed by Mayor Weiner that was impossible
since there was no prevailing side. Under Robert's Rules of
Order, only someone on the prevailing side can bring it back for
reconsideration. The vote was 2-2. Attorney Cherof clarified
that someone who did not vote on the losing side can bring it up.
Commissioner Aguila was not prepared to do that.
In returning to the previous discussion, Commissioner Aguila
pointed out that he did not want these uses on Federal Highway,
Boynton Beach Boulevard or NW 22nd Avenue. Keeping this in mind,
then where s1:.ould they be allowed?
David Floerinq, 2616 NE 23rd Street, pointed out that with the
new I-95 exit at NW 22nd, dealerships may want to come into
Boynton Beach. Ford is currently studying whether o~ not the
area will warrant dealerships. Boynton Beach is prime for that.
Marina Haberman, 712 NE 20th Lane, spoke about'a petition she
worked with for the beautification of Boynton Beach Boulevard and
the north end of Federal Highway. 500 signatures were obtained.
At that time, she counted thirteen businesses from the C-16 Canal
to Boynton Beach Boulevard. They were all car lots or auto-
related businesses. The remaining business are not well main-
tained. She suggested care be taken in opening the door to more
of the same.
Commissioner Artis pointed out that many people starting a busi-
ness do not have $750 to put down the drain. If these uses will
not be allowed, it should be stated. Vice Mayor Harmening and
Commissioner Matson suggested eliminating C-4 zoning along
Fe~eral Highway. Commissioner Aguila suggested adjusting the
Code and taking used cars out of C-4.
Mayor Weiner clarified there was general consensus to eliminate
C-4 from Federal Highway.
Mr. cutro stated a change such as this will have to go back to
the Planning & Zoning Board.
Commissioner Matson moved to direct staff to look into phasing
out C-4 zoning along Federal Highway and eliminating used cars
from C-4 zoning. Vice,Mayor Harmening seconded the motion which
carried 5-0.
