Dear Lee:
This is to inform you that at this time there is no need to
further extend the site plan for the Grove Shopping Center
located at the Northwest corner of U.S.l and Old Dixie Highway.
The reason for this is that bUilding permits were pulled for work
on the site and some of the work was accomplished. It is my
understanding that these permits have been allowed to lapse. We
would ask that the permits be reapplied for and reactivated as
soon as possible.
It,should also be noted that the'extension of a building permit
is not automatically guaranteed every six months. We would
encourage you to meet with the Building Official on this matter.
Finally, it is our understanding that you are contemplating some
changes to the approved site plan. If this is true we would
encourage you to submit these changes to us as soon as possible,
so that your plan can be updated.
I hope this letter is of some help to yOU. If you should have
any questions, please feel free to call me.
Yours truly,

Re: The Grove Shopping Center Site
Northwest Corner u.S. 1 and Old Dixie Highway
Dear Mr. Miller:
AUG 29 1991
CITY MANAGER'S OFFICI
As general partner of Grove Partners Ltd., the owner of the above
referenced shopping center site, we hereby respectfully request
that the site plan approval for this development which was approved
by the Boynton Beach city Council on August 15, 1989 and extended
by the City Council for a period of one year on August 15, 1990,
be further extended by the city Council to August 15, 1992. We
also request that this matter be put on the agenda for a City
commission meeting at the earliest possible opportunity.
Since the approval of the current site plan in 1989, the owner of
the property has actively pursued development of this site in
accordance with the site plan by either a sale of the property to
a develoment entity, a joint venture to develop the property with
a development entity, or development of the property for its own
account. However, a combination of factors including, but not
limited to, the overbuilt commercial market in Palm Beach County,
the depressed nature of the commercial real estate market in Palm
Beach County and the rest of the united States and the "banking
crisis" which has made traditional credit sources unwilling or
unable to make development loans, has resulted in the owner of the
property being able to move forward with development of this site.
Since the site plan was approved and extended, the owner has
expended considerable time and effort in attempting to keep this
project viable. We have received word from Winn Dixie Stores, Inc.
that they are still interested in constructing a 45,000 sq. ft.
grocery store on the site and the owner has actively been pursuing
other tenants to commit to having a store on this site. Because
of the current state of the retail industry, it has been very
challenging to convince retailers to commit to this site and, as
a result of the continuing retail doldrums, it may be necessary to
downsize the proposed shopping center in keeping with the owner's
basic strategy to build only what is economically viable and
capable of being leased within a relatively short period of time.
We certainly appreciate the cooperation and consideration which has
been demonstrated by the City of Boynton Beach in the past. We ask
that our request be given due consideration by the City and be
acted upon at the earliest possible meeting.
Very truly yours,

HAND DELIVERY
PLANNING DEPT. MEMORANDUM NO. 90-255
(AGENDA MEMORANDUM)
TO: J. Scott Miller, City Manager
FROM: James J. Golden, Interim Planning Director
DATE: August 6, 1990
SUBJECT: The Grove Shopping Center - Request for Approval of
Extended Site Plan - File No. 245
Lee C. Summers, attorney for the Grove Partners Limited, property
owner, is requesting that the City Commission grant a one year
extension of the above-referenced Development Order to August
15, 1991, as outlined in the attached correspondence dated August
I, 1990. The applicant has recently applied for a building
permit. However, it is the intent of the applicant to apply for
a site plan modification in the near future to change several
aspects of the site.
As outlined in the attached memorandum from Assistant Planner
Jorge Gonzalez dated August 3, 1990, this project is exempt from
meeting all of the level of service requirements in the City's
Concurrency Management Ordinance for as long as the site plan
remains valid. Therefore, the Planning Department has no
objection to the one year extension requested by the applicant.

On behalf of our client, Grove Partners Limited, the owner
of the 15.69 acre parcel referenced above, we hereby request that
the site plan approved by the City commission in August of 1989
