The department's objections, recommendations and comments are attached to said letter, and the City has sixty (GO) days in whi.ch to adopt the proposed amendment, adopt the amendment with changes, or reject the amendment. I notice that you received a carbon copy of said letter. I am forwarding this letter and the department's report on these comprehen- sive plan amendments to you~ attention for review and appropriate handling before the City Commision in the near future. The reason for this is that bUilding permits were pulled for work on the site and some of the work was accomplished. It is my understanding that these permits have been allowed to lapse. We would ask that the permits be reapplied for and reactivated as soon as possible. It,should also be noted that the'extension of a building permit is not automatically guaranteed every six months. We would encourage you to meet with the Building Official on this matter. Finally, it is our understanding that you are contemplating some changes to the approved site plan. If this is true we would encourage you to submit these changes to us as soon as possible, so that your plan can be updated. I hope this letter is of some help to yOU. We also request that this matter be put on the agenda for a City commission meeting at the earliest possible opportunity. Since the approval of the current site plan in 1989, the owner of the property has actively pursued development of this site in accordance with the site plan by either a sale of the property to a develoment entity, a joint venture to develop the property with a development entity, or development of the property for its own account. However, a combination of factors including, but not limited to, the overbuilt commercial market in Palm Beach County, the depressed nature of the commercial real estate market in Palm Beach County and the rest of the united States and the "banking crisis" which has made traditional credit sources unwilling or unable to make development loans, has resulted in the owner of the property being able to move forward with development of this site. Since the site plan was approved and extended, the owner has expended considerable time and effort in attempting to keep this project viable. We have received word from Winn Dixie Stores, Inc. that they are still interested in constructing a 45,000 sq. ft. grocery store on the site and the owner has actively been pursuing other tenants to commit to having a store on this site. Because of the current state of the retail industry, it has been very challenging to convince retailers to commit to this site and, as a result of the continuing retail doldrums, it may be necessary to downsize the proposed shopping center in keeping with the owner's basic strategy to build only what is economically viable and capable of being leased within a relatively short period of time. We certainly appreciate the cooperation and consideration which has been demonstrated by the City of Boynton Beach in the past. The applicant has recently applied for a building permit. However, it is the intent of the applicant to apply for a site plan modification in the near future to change several aspects of the site. (This project was previously approved October 1986. Some infrastructure was constructed at which time the project was abandoned and approvals were no longer vested.) The shopping center will include an anchor store (Winn Dixie), a six-plex theater, small retail shops, and 3 leased outparcels. Two entrances will serve the center; a main entrance from Old Dixie Highway and a right turn in, right turn out and restricted left turn entrance from Federal Highway. As per the traffic study submitted the following off-site improvements will be constructed: an Old Dixie Highway left turn lane into the project's main entrance, an exclusive left turn lane from Old Dixie Highway to Federal Highway, a new right turn lane from Federal Highway to Old Dixie Highway, landscaping and reconstruction of the median at the intersection of Old Dixie Highway and Federal Highway and a new northbound, left turn lane from Federal Highway into the project's north entrance. Approval of a shared parking study with a 12.7% buffer is also being requested to allow sharing between the retail and cinema uses at the center's 2:00 p.m. Saturday peak hour parking demand.
