BACKGROUND
The property which is the subject of this variance request consists of eight platted lots
located within the Quantum Corporate Park PID. Six (6) of these lots (34A, 34B, 35, 36, 37
and 38) are included within a proposed site plan application to construct a 160,033 square
foot perfume and cosmetic manufacturing facility. The size of the parcel is 18.35 acres. The
submitted site plan shows three access driveways to the proposed facility as follows:
. one from Gateway Boulevard (15 feet wide, one-way, ingress only, limited to delivery
vehicles),
. two from Quantum Boulevard.
The southern, 24 foot wide access driveway from Quantum Boulevard contains a median
island and is designed to serve primary clients and guests of the facility. The northern, 24
foot wide access driveway from Quantum Boulevard will serve mainly employees, as it is
located in close proximity to the main employee parking area (see Exhibit "A" - Location Map,
Exhibit "B" - Survey and Exhibit "C" - Site Plan). The zoning designation of the subject
parcels, as well as the entire Quantum Corporate Park, is PID (Planned Industrial
Development).

The following is a description of the zoning districts and land uses of the properties that
surround the subject request:
North -
undeveloped lots, zoned PID
South -
Gateway Boulevard right-of-way and farther south is a retention area for
Quantum Corporate Park
East -
undeveloped land, zoned R1-AAA.
West -
Quantum Boulevard right-of-way, and farther west are undeveloped lots
and Motorola, zoned PID.
ANAL YSIS
The City of Boynton Beach Land Development Regulations, Chapter 2 - Zoning, Section
7.H.3 - Accessways requires that:
"In the interest of public safety, no more than two (2) accessways shall be permitted
on to any single perimeter public right-of-way and interior accessways shall be
limited to no more than two (2) per developable parcel and interior accessways
shall be located no closer than one hundred and fifty (150) feet from center line to
center line ".
Chapter 23. Article II.H.7 - Number of Driveways, of the land development regulations
states:
"No more than two (2) driveways shall be permitted from any property. Where
properties abut more than one (1) public or private right-of-way, additional driveways
may be permitted depending upon traffic volumes, but in no instance shall the number
of driveways exceed two (2) on each street".
Proposed facility requires the assemblage of numerous lots totaling 18.35 acres. Also, due
to the operational requirements of the proposed manufacturing complex, such as the
separation of different types of vehicular traffic, three (3) access driveways are required to be
provided for safety and efficiency. All but one of these driveways is a "full" driveway (Le. -
allows full turn movements). By design, the third driveway (the one on Gateway Boulevard
where traffic speeds are greater than Quantum Boulevard) allows ingress only and only from
the east. A deceleration lane is also to be provided. Gateway Boulevard is a public street

while Quantum Boulevard is owned and maintained by the Quantum Corporate Park
Association (COD).
The code states that zoning code variances cannot be approved unless the board finds the
following:
a. That special conditions and circumstances exist which are peculiar to the land,
structure, or building involved and which are not applicable to other lands, structures
or buildings in the same zoning district.
b. That the special conditions and circumstances do not result from the actions of the
applicant.
c. That granting the variance requested will not confer on the applicant any special
privilege that is denied by this ordinance to other lands, buildings, or structures in the
same zoning district.
d. That literal interpretation of the provisions of this ordinance would deprive the
applicant of rights commonly enjoyed by other properties in the same zoning district
under the terms of the ordinance and would work unnecessary and undue hardship on
the applicant.
e. That the variance granted is the minimum variance that will make possible the
reasonable use of the land, building, or structure.
f. That the grant of the variance will be in harmony with the general intent and purpose
of this chapter [ordinance] and that such variance will not be injurious to the area
involved or otherwise detrimental to the public welfare.
Exhibit "E" contains the applicant's response to the above criteria. Note: Unlike other
development applications, the code does not require staff to make a recommendation
regarding whether an applicant should be permitted to violate the city's ordinance.
Since zoning variances run with the land in perpetuity, it is recommended that, if the Board
warrants granting the variance, it should be limited to lots 34A, 34B, 35, 36, 37 and 38 only,
which is the site proposed for development at this time (see Exhibit "F" - Conditions of
Approval).

The following are the responses to Section SA-F of the
Variance Application.
A. T~e property consists of originally six platted lots, which
were combined during the acquisition. Would the lots have
been sold separately, the maximum number of entrances/exits
for the combined property could have been 12. The reduction
of entrances/exits by 9 to actually only 3 should be a benefit
to the City and the Park.
B. Because of the nature of the business to be conducted, a
parcel of approximately 18 acres was required; therefore, six
separate lots were combined. Due to the size and
configuration of the property it is necessary to have one
additional ,access point for proper internal circulation within
the site and for proper ingress and egress from Gateway and
Quantum Boulevards.
C. Since each lot has the right to two entrances/exits, every
other lot has the same right as well. Presently, the street
medians are laid out to accommodate the original number of
entrances/exits (12). The applicant is prepared to close-off
one median opening to improve the traffic circulation.
D. It would be a hardship to develop approximately 18 acres with
only two entrances/exits; such development would not permit
sufficient traffic flow within the site, nor would it meet
appropriate traffic circulation standards.
E. The property needs only one additional entrance/exit, which is
the minimum variance, which makes the use of the land
practicaL
F. By allowing the extra exit/entrance, the traffic flow inside
and outside the property will be greatly improved. The
applicant wants to keep the truck traffic separate from the
employee/visitor traffic for logistic and safety reasons. The
separate truck entrance will also provide (i) deceleration
space, (ii) stacking space, and (iii) additional
screening/landscaping space.
