L !i II ORDINANCE NO. 094- I L 11 tI 'I I, I I II II AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, PROVIDING FOR A DETERMINATION THAT CHANGES TO THE COMPREHENSIVE DEVELOPMENT OF REGIONAL IMPACT APPROVED IN ORDINANCE NO. 84-51, AND AMENDED IN ORDINANCES NOS. 86-11, 86-37, 88- 3 AND 94-10, DO NOT CONSTITUTE A SUBSTANTIAL DEVIATION UNDER CHAPTER 380.06, FLORIDA STATUTES, 1994, DETERMINING THAT NO FURTHER DEVELOPMENT 'OF REGIONAL IMPACT REVIEW IS NECESSARY REGARDING SUCH CHANGES, APPROVING SUCH CHANGES, AMENDING THE DEVELOPMENT ORDER (ORDINANCE NOS. 84-51, 86-11, 86-37, 88- 3 AND 94-10) FOR PURPOSES OF INCORPORATING THE APPROVED CHANGES; AND PROVIDING FOR AN EFFECTIVE DATE. i , I' I I I II i I WHEREAS, Quantum Associates, a Florida general partnership ("Developer") I is the current owner and developer of the remaining vacant land within the project i commonly known as Quantum Corporate Park at Boynton Beach Development of !! Regional Impact (sometimes hereinafter called the "Quantum Park DRI"); and I' II WHEREAS, the original Development Order for the Quan1um Park DRI was II approved by the City of Boynton Beach (the "City") by Ordinance No. 84-51 and amended by Ordinance Nos. 86-11,86-37,88-3 and 94-10 (hereinafter collectively I I called the "Development Order"); and II WHEREAS, the land subject to the Development Order is described therein II as the "Property" and is incorporated herein by reference; and I' WHEREAS, Developer has submitted to the City a NolificationofProposed 'I' Change to a Previously Approved Development of Regional Impact requesting a further amendment to the Development Order for the purpose of revising the Master I. Site Development Plan to reflect the use of a portion of the Property previously Ii designated for office use to be redesignated for office/research and development ,I use; and II WHEREAS, the City Commission of Boynton Beach, as the governing body II having jurisdiction, is authorized and empowered to consider applications for I amendments to development orders approving developments of regional impact . pursuant to Chapter 380.06, Florida Statutes (1994); and I WHEREAS, said City Commission has considered the testimony, reports and I other documentary evidence submitted at said public hearing by Developer, the City '1'\ staff and the public, and the City Planning and Development Board's I recommendations of the 15th day of November, 1994; and I WHEREAS, said City Commission has considered all of the foregoing. II ! I NOW THEREFORE, be it ordained by the City Commission of Boynton Beach, !, that said City Commission makes the following findings of fact: :1 !i Section 1. A notice of public hearing in the proceedings was duly published il on the 4th day of November, 1994, in The News. a newspaper of general circulation Ii in Boynton Beach, Florida, pursuant to Chapter 380.06, Florida Statutes, and proof :, of said publication has been duly filed in these proceedings. I I Section 2. Developer has requested that the Development Order be amended ,I by revising the land use designation of Lots 12, 13, and 14 from "office" to ') "office/research and development" as reflected on the amended Master Site Development Plans, attached hereto as Exhibit "A" and made a part hereof. Section 3. Upon consideration of all matters described in Section 380.06, Florida Statutes (1994), it is hereby determined that: A. The amendment proposed by Developer does not unreasonably interfere with the achievement of the objectives of the adopted state land development plan applicable to this area. B. The amendment proposed by Developer is consistent with the local comprehensive plan and local land development regulations. C. The amendment proposed by Developer is consistent with the recommendations of the Treasure Coast Regional Planning Council on file in these proceedings. D. The amendment proposed by Developer does not constitute a substantial deviation under Chapter 380.06. Florida Statutes (1994). Section 4. The City Commission has concluded as a matter of law that these proceedings have been duly conducted pursuant to the provisions of Chapter 380.06, Florida Statutes (1994). that Developer is entitled to the relief prayed and applied for, and that the Development Order is hereby amended incorporating the amendments proposed by Developer as set forth in Section 2 above. Section 5. Except as otherwise amended herein, the Development Order shall remain in full force and effect. FIRST READING this day of November, 1994. Part of this package was the requirement that the City meet a certain timetable for plans review, as an alternative site under consideration for the Motorola expansion was the vacant IBM property in Boca Raton, which was already constructed. The current regulations of the Planning and Development Board provide for two meetings per month if required. I am requesting that the Planning and Development Board hold a special meeting on Tuesday, November 15, 1994 at 5:30 P.M. to consider the Motorola proposal, and then it will be placed on the City Commission meeting also on the 15th beginning at 6:30 P.M. Staff has been reviewing the proposal since its submittal on November 3rd and will provide you with review comments as soon as possible. I appreciate the Board's consideration of this request to establish this meeting. Effective November 14, 1990 and pursuant to 9J -2.0252 (6) , Florida Administrative Code, a $2,500 review fee deposit must accompany the copy of the proposed change form submi tted to Council. One-hundred percent of the review costs will be charged against the deposit. If the costs exceed the deposit, additional deposit will be required. If the costs total less than the deposit, the remainder will be refunded within sixty days of the close of the month in which review is completed. The review will be considered complete when Council has reviewed the development order amendment adopted by the local government pursuant to the NOPC, or received notification that the NOPC has been withdrawn. Please provide a $2,500 review fee deposit payable to Treasure Coast Regional Planning Council to complete the NOPC submittal and initiate the thirty day review period referenced in Chapter 380.06(19) (f)3, Florida Statutes.
