The following is an update on the B.G.I. at Quantum Park approval process. The date for the formal
pre-application approval process for B.G.I.'s application (required prior to submitting a new site
plan) is Tuesday, March 25 at 2:00 P. M. in the Conference Room on the 2nd floor in the West
Wing.
In addition to the usual Planning and Zoning Department staff in attendance, I have invited key
Technical Review Committee members to air early any potential concerns connected with the
project. As you know, B.G.I. wishes to locate a cosmetic and jewelry manufacturing facility at the
northeast comer of Quantum Boulevard and Gateway Boulevard within Quantum Park.
If I can supply any other information, please let me know.

DESCRIPTION: James G. Willard, agent for Quantum Associates, is requesting approval
to amend the list of permitted uses for the Quantum Corporate Park PID to allow cosmetic,
perfume and jewelry manufacturing on lots within the PID, designated as industrial on the
master plan. Quantum Park is located on the west side of the intersection of Interstate 95
and Gateway Boulevard. For further details pertaining to this request, please see attached

RECOMMENDATION: The Planning and Development Board, with a 6-0 vote,
recommended approval subject to all staff comments in Exhibit "C " - Conditions of
Approval.

Use Approval (cosmetic, perfume and jewelry manufacturing)
NATURE OF REQUEST
Jim Willard of Shutts and Bowen, Attorneys at Law, agent for Quantum Corporate Park
PID, is requesting approval to amend the list of permitted uses for the Quantum PID (see
attached location map - Exhibit "A") to include cosmetic, perfume and jewelry
manufacturing on industrially designated lots within the PID. This request is submitted in
connection with an anticipated site plan submittal to construct a manufacturing complex
on the following lots of the Quantum Corporate Park: 32, 33, 34A, 34B, 35, 36, 37 and 38
(see Master Plan - Exhibit "B"). This new complex will consist of office, production facility
and research and development uses and associated parking. Chapter 2 - Zoning, Section
7(E) of the Land Development Regulations requires that any use proposed within a
Planned Industrial Development (PID) district has to be approved by the Planning and
Development Board (and City Commission).
BACKGROUND
Currently, the PID master plan designation of the lots proposed for the referenced
manufacturing complex is office. Concurrently, a master plan modification/DRI amendment
is being processed to redesignate these lots as office/industriallresearch and development.
The city's Planned Industrial Development (PID) district guidelines, were designed to
provide a zoning classification for light industrial development that would better satisfy
current demands for light industrial zoned lands by encouraging development that will
reflect changes in technology, to relate the development of land to a specific site and to
conserve natural amenities. In addition, it is intended "to accomplish a more desirable
environment for industrial development in relation to existing and/or future city
development, permit economies in providing public services, allow for economies of scale
in industrial development and to promote the public health, safety, convenience and
welfare of the City of Boynton Beach." For comparison purposes it should be noted that
manufacturing of "household goods and other small items such as ... personal articles..."
is a permitted use in the M-1 (Light Industrial) district.
Pursuant to Chapter 2 - Zoning, Section 7.E., in a PID, a building and its customary
ancillary structures and land uses may be erected, altered and occupied for any office,
professional, business (wholesale and retail), educational institution, adult entertainment
in accordance with Section 11.M. of the zoning code or industrial uses provided that such
use or uses is/are approved by the Planning and Development Board. To approve such
a use, the Planning and Development Board must make findings that the proposed use will
not be in conflict with the performance standards listed in Section 4.N. of the zoning
regulations, and that the use proposed is consistent with the intent and purposes of the
planned industrial development district.

The following is a description of the zoning districts and land uses of the properties that
surround the subject request (see Exhibit "A" - Location Map).
North
Sand pine preserve and water management tract "J", zoned
Planned Industrial Development (PID).
East
Undeveloped property, zoned Single Family Residential,
R1AAA.
South
Gateway Boulevard right-of-way and farther south is a
retention area (lake), zoned PID.
West
Right-of-way of Quantum Boulevard and farther west are
undeveloped lots, zoned Planned Industrial Development
(PID).
ANAL YSIS
The purpose of the City's performance standards is to ensure that uses will not be a
nuisance or hazard to persons, animals, vegetation or property located on adjacent or
nearby properties or right-of-way; or to interfere with the reasonable use or enjoyment of
adjacent or nearby property by reason of noise, vibration, smoke, dust, or other particulate
matter; toxic or noxious matter; odor, glare, heat or humidity; radiation, electromagnetic
interference, fire or explosive hazard, liquid waste discharge, or solid waste accumulation.
The applicant has been asked to provide a response to the Chapter 2, Section 4 N.
Performance Standards of the Land Development Regulations to evaluate the impact and
appropriateness of this use within the PID district. These responses are paraphrased
below together with staff remarks:
1) Noise: The applicant states that no sound will be created, which is in
violation of Section 15-8 of the City of Boynton Beach Code of Ordinances,
as the manufacturing operation is conducted using pneumatic and hydraulic
equipment.
2) Vibrations: As stated by the applicant, no excessive vibrations will be
generated by the proposed use.
3) Smoke, dust, dirt, or other particulate matter: As stated by the applicant,
the level of emission of smoke, dust, dirt or other particular matter will comply
with the city's standards. The proposed use will not allow the emission of
any substances in violation of any federal, state, county or city laws or
permits governing the emission of such substances. Due to the type of
product being manufactured, cleanliness is of utmost importance. As shown
in photographs submitted by the applicant of an existing facility of this type,
special operational measures are employed for sanitation and prevention of
product contamination.
4) Odors and fumes: The applicant states that no objectionable or offensive
odors resulting from the manufacturing of cosmetic and fragrance products
will be readily perceptible at any point beyond the industrial district. Oils and
chemicals used to add fragrance to products and manufacture perfume are

stored and used in such a way to minimize exposure to the air and
evaporation.
5) Toxic or noxious matter: The applicant has not indicated that any toxic or
noxious matter will be generated.
6) Fire and Explosion: Large quantities of alcohol (which is flammable) is
used for manufacturing cosmetics and fragrances. The method of storage
and handling this chemical will require further review by staff during the
development and permit review processes, to ensure compliance with city
codes.
7) Heat, Humidity or Glare: The applicant states that the proposed use will
not produce heat, humidity or glare which is readily perceptible past the
property boundary. Heat is used as a sterilization method.
8) Liquid Waste: As stated by the applicant, any disposition of liquid waste will
be in conformance with the provisions of Chapter 26 of the City of Boynton
Beach Code of Ordinances or any applicable federal, state or county laws or
permits. The use generates a large demand for potable water. Further
review of waste water discharge will be conducted by staff during the
development and permit review processes.
9) Solid Waste: The applicant indicates that any accumulation or disposal of
solid waste will be in conformance with Chapter 10 of the City of Boynton
Beach Code of Ordinances and will be disposed of appropriately. Most raw
materials are transported in reusable containers.
10) Electromagnetic Interference: No electromagnetic radiation or interference
is to be created by this use.
11) Hazardous Materials and Hazardous Waste: The hazardous materials
identified with this use are alcohol and possibly dyes and oils. However,
since some chemicals are not classified as hazardous unless they are used
or stored in large quantities and since quantities have not been provided,
further staff review to ensure proper containment in the event of a spill will
need to be conducted during the development and permit review processes.
RECOMMENDATION
Due to the projected use and storage of hazardous and flammable materials associated
with this use, environmental review is recommended (depending on the quantities it may
be required). Based on the above analysis of this use, staff recommends that the list of
permitted uses for the Quantum Corporate Park PID be amended to include cosmetic,
perfume and jewelry manufacturing on industrially designated lots, subject to the staff
conditions of approval contained in Exhibit "C".
