Please place the above-referenced item on the May 21, 1996 City Commission agenda under
Development Plans.
DESCRIPTION: Cormac C. Conahan, Esq., with Hodgson, Russ, Andrews, Woods &
Goodyear, agent for DeBartolo Properties Management, Inc., property owner is requesting
to amend the previously approved site plan to construct a 162,502 square foot department
store with parking structure at 801 North Congress Avenue. The attached Planning and
Zoning Department Memorandum No. 96-252 further details this request.
RECOMMENDATION: The Planning and Development Bo~rd, with a 7-0 vote,
recommended approval of this request subject to the comments in the attached Exhibit C,
with the exception of Comment #10, regarding the requirement for wheelstops to be
provided. The applicant contends that a variance granted by the Planning and Zoning
Board on November 9, 1982 to not require wheelstops for the mall parking that currently
exists is applicable to the parking area expansion proposed with this request. Parking lot
variances are site plan specific, therefore, technically a new variance is required. However,
this department would support an interpretation to allow the original variance to be applied
to this site plan, since the original site plan was conceptual.
Comment 37, regarding building height in excess of the allowable 45 feet, was raised by the
applicant as well. A height exception was granted in 1982 by the Commission for one of
the department stores at the mall. At that time, the store name was not known; it ended
up becoming a Macy's store. This height exception for Macy's allowed the following
structures to exceed 45 feet by 20 feet: parapet, cooling tower screen and skylight peak
(dome). Macy's never completed the third floor of their store, but these structures exist.
The code specifies which types of structures are allowed to qualify for application for a
height exception. Specific citations are included, but generally they are types of mechanical
appurtenances. The applicant contends that the semi-circular, design entry feature is
similar to a mechanical appurtenance if it will screen mechanical equipment behind it and
therefore he should be allowed to apply for a height exception. No mechanical equipment
is currently shown on the plan. Since the Board meeting, the applicant meet with the
Forester to discuss comments 17, 19, 19A, 21, 24 and 26. The Forester recommends the
following revisions to these comments:
17. Add the following sentence - This topic will be included within the Tree Management
document.

19. Replace the second sentence with the following sentence - Dead Slash Pine trees shall
be included within the tree management document to cover replacement with equal
tree value. Replace the third sentence with . Tbe following tree species Is
recommended for use in selecting tree substitutions for areas outside the preserve
area and subsequent amendments to the site landscape plan, accordingly.
21. Add to the end of the first sentence - ... to select appropriate native species of
plants/trees in the preserve area. Any appropriate changes shall be made on the site
landscape plans.
24. Add the following sentence - The trees are clearly shown inside the preserve area,
however, they have not been counted and shown on the sheet.
26. Replace the second sentence only with the following three sentences - The 235 trees
shown on the plan will not all be relocated in the field, but the specific relocation
site shall be indicated. The specific healthy, desirable trees for relocation will be
flagged with ribbon. Some of the trees will be mitigated in accordance with the tree
management plan.

I recently received a letter from Mac Conahan, Esquire, who is
the attorney representing the DeBartolo Corporation/Boynton Beach
Mall. In the letter, I was informed that you will not delete the
condition re~iring parking stops unless the variance of 1982
applies to the entire Boynton Beach Mall.
Based on the minutes from the November 9, 1982, Planning &
Zoning Board Meeting in which Boynton Beach Mall requested a
parking lot variance, it is my opinion that the parking lot
variance deleting the requirement that concrete curb stops be
installed is for the entire Boynton Beach Mall. Therefore, no
further variance should be required to delete parking stops from
the existing mall site.

The Boynton Beach Mall is a development of regional impact (DRI).
A recent resolution (R96-26), approved by the City Commission on
February 20, 1996, amended the development order for the mall. In
addition to the standard codes, the mall must comply with the
additional conditions of this development order. This major site plan
modification request includes adding a 162,502 gross leasable square
foot department store, identified as Department Store F, to the
existing mall structure. A two level, above grade, detached parking
structure and revised parking and landscape improvements are
proposed with the request. Department Store F and the parking
structure are to be located on the west side of the mall.
a.
Traffic -
Traffic review for the proposed mall addition
was previously reviewed and approved as most
recent amendment to the D RI.
b. Drainage-
Insufficient drainage information has been
submitted for the Engineering Division to certify
compliance with the DRI drainage regulations.
The Engineering Division is recommending that
this be postponed to the time of permit review.
The mall has two (2) existing, two-way driveways located on Old
Boynton Road that allow access to a two-way peripheral access aisle
that circles the outside of the mall site. There are three (3) existing
ingresslegress access easements located on Congress Avenue which
lead directly to the mall peripheral access aisle. The peripheral
access aisle allows traffic to circle the mall before entering the
parking facility. The proposed site changes will slightly modify the
access aisle, however, the peripheral access aisle concept will remain.
No changes are proposed to the access system.
The parking facility at the west side of the mall will be the only
vehicle use area affected by this site plan modification. A detached
two level above grade parking structure housing 640 parking spaces
is proposed for the center of the west side of the mall. Additional
parking will be provided on the LWDD canal right-of-way that is
located in the northwest corner of the mall site. This will be
accomplished by culverting the canal and constructed parking on the
surface. A parking agreement is being fine-tuned between the mall
the LWDD. Based on the gross leasable area identified on the site
data found on sheet SP-1, a total of 6,165 parking spaces are
required. However, due to conflict between the spaces shown on the
site plan sheet SP-1 and the count of spaces at the site the number of
spaces provided cannot be confirmed. It is anticipated that the
number of spaces provided at the site will meet the city's regulations.
Approval of a variance to the zoning code to reduce the number of
required spaces will be required if the number of spaces provided is
not meet city regulations.

RECOMMENDATION:
Following compliance with staff comments the on-site landscaping
will comply with city regulations. Compliance with staff comments
will also ensure that the preserve area is in compliance with DRI
standards and regulations.
The proposed addition is in compliance with all C-3 building and site
regulations with the exception of the overall height. The applicant
is requesting an overall height of 54 feet 6 inches whereas the city
height limitation is 45 feet. The structure exceeding the height is not
eligible for a variance or height exception to increase the height.
Therefore, the structure must be reduced in height. The DRI allows
a maximum of 1,244,449 square feet of gross leasable floor area for
the mall site following compliance with the development regulations
and standards identified in Resolution R96-26. The submitted plans
indicate a total of 1,070,315 square feet of leasable area currently
exists at the site. A total of 1,232,817 square feet of leasable area
will be achieved by adding the 162,502 square feet of leasable area
of the proposed department store F.
The proposed color scheme, tan walls and a reddish brown accent
trim, is compatible with the remainder of the mall. The arched entry
feature with polished granite side styles and transom located on the
north, west and south elevations feature a unique design to the mall
design. However, it does not detract from the overall design of the
mall and helps to break up the mass of the building.
Wall signage has not been submitted.
The Planning and Zoning Department recommends approval of this site plan request,
subject to the comments included in Exhibit D - Conditions of Approval. The TRC
recommends that the deficiencies identified in this exhibit be corrected on the set of plans
submitted for building permit.

November 16, 1982 and December 19,
19989. These dead trees will have to
be replaced with equal tree value as
part of the Tree Management Plan.
Selection of plant materials (plant

Queen palm (AR) is not native species
nor wildlife benefit, therefore,
recommend native palm trees.
Black Olive (BB) is not a native
species nor a wildlife benefit,
therefore, recommend live oak or sand
live oak.
Laurel Oak (QL) is not proper for this
soil type, therefore, recommend live
oak or sand live oak.
pongam (PP) is not a native species
and is listed as a nuisance tree (Palm
Beach County Ord.), therefore
recommend either live oak or sand live
oak, dahoon holly, red bay.
Yellow Tabebuia (TA) is not a native
species, therefore recommend either
yellow elder geiger tree, or sweet
acacia.
Viburnum suspensum (VS) is not a

shown should be installed adjacent to
the preserve area in a manner not to
interfere with the flora/fauna. The
adjacent residential community has
expressed a concern about being
shielded from the glare of the
proposed lighting structures.
24. Sheet # 5 of 17, the total quantities
of existing trees on the tree survey
should be indicated on this sheet or
the landscape plan for the preserve
area. The eventual tree count for the
preserve area should be equal to or
more than this quantity of existing
(desirable) trees.
25. Sheet # 6 of 17, the page should
indicate clearly that the entire tree
preserve area perimeter will contain a
permanent chain link fence. The page
is not clear as to when the temporary
fence will be replaced with the
permanent fence. The adjacent
residential neighborhood is concerned
about people walking through the

should keep all debris and dumping out
of the preserve area.

ornamental trees shown for relocation

preservation as a native habitat
preserve in perpetuity of the pine
area in the northwest quadrant of the
site by recording appropriate
Restrictive Covenants which, prior to
recording, shall be approved by the
Treasure Coast Regional Planning
Council and the City of Boynton Beach.

29. Prior to commencing construction
activity within the parcel containing
the area to be preserved, the preserve
area shall be temporarily fenced or
otherwise delineated to prevent
construction equipment from entering

30. All Brazilian pepper, Australian pine,
and Melaleuca on the site (including
within the limits of the pine area)
shall be removed prior to issuance of
a certificate of occupancy for any new
square footage. These species shall

regular and handicapped parking spaces
to the location shown on sheets SP-1,
SP-4, 1 and 1-A of the submitted plans
it was determined that changes have
been made to the parking layout which
results in the total number of
provided spaces being less than what
is specified on the parking data. The
above-listed plan view drawings will
be required to be updated to show and
identify the accurate number of
regular and handicapped parking spaces
provided at the site to enable staff
to determine whether the provided
number of spaces meets the minimum
requirements. An accurate count and
listing of the existing and proposed
new parking space layout is required
to determine whether the appropriate
number of handicapped parking spaces
are being provided at the site.
Modify the plans and parking data to
show the correct total number of
provided spaces. Provide a separate
listing identifying the number of
required and provided handicapped
spaces. Also show on sheet SP-1 the
location of no less than the minimum
number of handicapped parking spaces
as required by code. The total number
of required parking spaces is
incorrectly identified on sheet SP-1.
Correct the count and data by dividing
the total gross leasable floor area by
two hundred (200). Also, correct the
inconsistency between the total number
of parking spaces that will be
provided in the two (2) levels above
grade of the parking structure. The
number of spaces identified in the
parking data on sheet SP-1 is 640 and
the detail drawing found on the same
sheet indicates 680 spaces. The
number of parking spaces provided
shall be no less than the total number
of parking spaces required. Approval
of a variance to the zoning code to
reduce the number of required spaces
will be required if the number of
spaces provided is not consistent with
city regulations.
37. Modify the building elevations found
on sheet titled "Design Elevations" to
show a maximum building height not
exceeding the city's forty-five (45)

DESCRIPTION: Request submitted by Randolph Stauffer, for approval
of an amended site plan to allow for the addition of a 222,624
square foot department store at the northeast corner of the
Boynton Beach Mall which is located on the West side of North
Congress Avenue between Old Boynton Road and the Boynton (C-16)
canal.
RECOMMENDATION: The Planning and Zoning Board unanimously
recommended approval of this request, subject to staff comments,
copies of which are attached. In connection with the City's
Forester/Horticulturist's memo, the Board has requested that the
Community Appearance Board review and act on the comment
regarding "native" vs. "non-native" vegetation.
EXPLANATION: The motion to recommend approval of this request

In Phase II, Mr. Annunziato informed everyone that the leasable
area increases to 1,107,719 square feet with a total buildable
area of 1,249,428 square feet~ now consisting, of six department
stores plus a parking garage located on the western side of the
proposed mall.' ~
Utilitywise,Mr. 'Annunziato said this site will be served by
municipal sewer and water facilities with water on Congress and
a proposed water line on Old Boynton Road. The sewer lines will
be a gravity sewer, system, which will collect all outside sewage
for this parcel and possibly the out parcels, depending on some
internal agreements directed to a pump station located at the
central driveway, which will then pump directly into the 16 inch
force main which is in place. . .
As .he mentioned previously, Mr. Annunziato stated that access
is from three driveways. He 'said these are. four lane divided
roads, off of Congress Avenue, but the fourth road will
connect Boynton Beach Boulevard with Old Boynton Road to tie
in at the eastern most driveway on Old Boynton Road (He
indicated it on the.overlay.)
Concerning road impacts which were addressed by the applicant,
Mr. Annunziato said that in December of 1981, the applicant
signed an agreement with Palm Beach County' which transferred
1.7 Million Dollars, which the County used, as a match against
State economic development funds to place the improvements in
Congress which you currently see. Again, still to be constructed
is a four lane divided roadway from New Boynton Road to Old
Boynton Road and turn lanes on Old Boynton Road, Mr. Annunziato
added. .

Mr. Annunziato continued by telling the Council there were
several variances and exceptions which,were related to this
application. Initially, there was a request for a variance to
the requirement for a wall along Javert Road, separating the
residential from the proposed commercial property. The Board
of Adjustment addressed this application and denied it. Mr.
Annunziato further informed the Council that the Planning and
Zoning Board addressed two requests for variances to the Park-
ing Lot Ordinance. One concerned double striping, which was
eventually withdrawn by the applicant, and the second concerned
the requirement for curb stops at each parking stall. Mr.
Annunziato said that WaS subsequently approved by the Planning
and Zoning Board.

involved the request for a height exception by the City Council.

approve the site development plans submitted by David Pressly,
, Esq., which was item"C" under "VII, DEVELOPMENT PLANS" on the
Agenda. Assistant City Attorney Wolf wished to speak to Carmen
'Annunziato, City Planner, before the Council took a vote on the
motion. He believed the motion would have to be amended. City
Attorney Wolf also advised the Council that they would have to
have a hearing on this.

Councilman de Long withdrew his motion and Councilmember Woolley
,withdrew her second. The public hearing continued.
Carmen Annunziato, City Planner, wished to reiterate some of the.,
comments he made approximately two weeks ago when he presented
the site plan to the Council in preliminary form. He thought
, the Council was familiar with the overlay and informed them it
was Phase I of the proposed Boynton Beach Regional Mall located
just to'the west of Congress Avenue on Old Boynton Road.

Historically, Mr. Annunziato told the Council this was proposed
to be developed in Palm Beach County in the early 70s. It was
reviewed as a development of regional impact at that time with the
South Florida Regional Planning Council., In 1974, Palm Beach
County adopted Resolution 74-343, which approved a similar mall
to what was displayed. Mr. Annunziato informed everyone that the
mall itself is to be built on a 108 acre parcel, and in Phase I
the leasable area will be 992,719 square feet with a total
building area of 1,134,428 feet consisting of five department
stores and approximately 100 retail outlets inside.

SUBJECT: Macy's Department Store - Site Plan
This memorandum is in reference to the foundation
landscape plan for the above department store at the
Boynton Beach Mall.
1. The landscape plan does not reflect the use of 50%
native tree species. However, the original Boynton
Beach Mall was constructed prior to the
comprehensive plan requirements of 50% native trees
used on all landscape plans. Secondly, the
landscape plan as shown is consistent with the
surrounding mall landscaping and blends in with
other department store landscaping plans. The
requirement decision should be reviewed and
approved by all appropriate boards and the City
conunissioners.

We can approve this project, subject to the following conditions:
1. Both fire lines will require post indicator valves and
Siamese connections. Please indicate their location.
2. The fire line on the south side of the building is within
the generator enclosure. Maximum separation from the
generator itself should be maintained so as to avoid pipe
failure due to vibration. Please specify this distance on
the plans.
3. Tapping sleeves and valves must be specified for connecting
new fire lines and service into existing main.
4. The City maintains main line sewer only on this site.
Details must, however, still be provided on sanitary servi-
ces so as to allow inspection. We recommend the service
under the loading docks should be of an extra-strength
material due to its shallowness in the loading area.
5. Details must be provided on the meter, meter pit, vault,
valving, etc. All meters larger than 2" must be provided
by developer.

height of 65 feet. Mr. Annunziato continued by saying the ceiling
and floor dimepsions for the three story building 'are, only 39
feet, and the remaining 26 feet needed is conposed of, mechanical
and ancillary eauipmen~ which may be exempted trom tne overalT
disErict type regulation consistent with the finding of fact by
the Council based on addressing several criteria which exist in
the Zoning 'Code. Mr. Annunziato believed the applicant would
address those for the Council in time to come.

Mr. Annunziato told" the Council this request 'went from the staff
to the Planning and Zoning Board with a recommendation for
approval, based on two memorandums which were prepared by Mr.
Annunziato (one initially responding to the materials which were
submi tted which consisted of the'- d:velopnent plan package; a pack-
age of site design specifications; and thirdly, a development
agreement which was something Mr. Annunziato said they had not
,seen previously). Owing to the size of this development, Mr.
Annunziato said there were several items which' had to be under-
stood on both parts.

Following the initial memorandum that: MY.". Annunziato prepared,
the deyeloper responded to it, and Mro Annunziato prepared an
additional memorandum which w~nt to the Planning and Zoning
Board. The Planning and Zoning Board predicated their approval
upon compliance and the understandings associated with those
two memorandums.
This application went before the Community Appearance Board
last night, and Mr. Annunziato informed the Council it was
subsequently approved by that Board. It now comes to the City
Council with a positive recommendation from the staff and the
Planning and Zoning Board and a positive action from the Community
Appearance Board with respect to landscaping and aesthetic criteria.
Mr. Dick Greco, Vice President, Edward J. deBartolo Corporation,
wanted to address the heiaht qg~~~ he 'was sure the Council was
familiar with, as they have gone over it. Considering the
application for exemption to the district height regulation, Mr.
Greco said the City Council must make findings indicating that the
proposed exception has been ied a d considered in relation to
the standards set forth in Section 4F(3) of the Boynton Beach Zoning
Code. 'He stated as follows: '

"a. It will be no negative impact on existing and proposed land
uses due to the location of the subject building. The
subject building is rrore than 800 feet from any property line.
All the existing proposed land uses are toose of the appli-
cant.

Mr. Greco explained that there is four feet of mechanical space
between floors: and an additional 14 feet for paraquet walls,
mechanical penthouse, elevator, and that'type of thing on top.
The basic building itself, without the exclusions, that,the City
made provisions for, is below the standards the City set, Mr_
Greco advised. He said the provisions the City made are good
because they would apply to buildings like this one in particu-
lar, the hospital, or things of that-nature that require a little
more, between each floor. '

Mr. Greco complimented the City by saying he thought the ,
Ordinance is an excellent one;, he knows what:the City is trying
to get away from and said we are doing a good job of that_ -

adjacent areas due to too physical location of the

As they could see, Mr. Greco pointed out that it is basically in
the middle of 108 acres of land. He continued:

The height exception will not be a deterrent to the
developrrent of adjacent property due to the fact tha.t
the property to tre east contains a'coI'T'lTercial build-

line of this particular building.

will increase the developer I s taxes for the mall, and the
building in particular will be used by the public.
Mr. Greco thought all of that had been addressed and everyone
was very familiar with it. Tonight, Mr. Greco said they hoped
basically to take the building off of ' the drawing boards and
start putting it in the ground in the next week or so. Mr.
Greco expressed their appreciation of the City's indulgence C
these many months. He passed out a picture of what it is going
to look like in about 18 months.

Councilman Wright was concerned. When Mr. Greco came before the
Council, initially,he said he' would some quality stores over there.
He wanted to find out from Mr. Greco at this point and time what
their plans were for some of these larger stores. Mr_ Greco
asked, "Do you' mean what they are and who they are?" Council-
man Wright answered, "Yes."
Mr. Greco stated he would like to be able to tell Councilman
Wright. Basically, he said they have a problem in every mall
they build. Everyone wants to know what the stores they are. He
reexplained that in each instance where they see the five stores,
soon to become six, the store itself buys that piece of the
property and the parking around it. Sometimes they will announce
when the mall breaks ground, and sometimes they do not, Mr.
Greco told the Council~ for reasons of their own.
One of the stores (the one they just read the height requirement
on) is obviously a little different than has been around here, so
M~. Greco said they might guess at that, but he was not at liberty
to say for them. About all that Mr. Greco could say was that
the City will have some excellent stores in this mall. Basically,
they are their customers, Mr. Greco pointed out. Councilman.
Wright said they want it to supersede those in this County. Mr.
Greco assured Mayor Trauger he would have a cafeteria. Members
of the Council commented they thought it was very nice.

Mayor Trauger asked if anyone in the audience wished to speak in
favor of the site plan development that was just presented.
There, was no response. He asked if anyone who wished to speak
in opposition to the site plan. There was no response.
THE PUBLIC HEARING ON THE SITE DEVELOPMENT PLAN WAS CLOSED.
Attorney Wolf did not wish to preempt anyone but as this would be
a complicated legal motion and it would be coming from the
Councii. He thought it might be best if he would say what the
motion would have to include. Mayor Trauger told Attorney Wolf,
"You may, and then someone will accept it (the motion) from your
words."
Assistant City Attorney Wolf recommended to the Council that a
motion be made to approve the site plan subject to the
appropriate ordinances passing for annexation, adopting a proper
zoning and proper land use for the subject property, and that the
specific findings are made that the height limitation exception
requested that the standards set out in Section 4 of Appendix A,
Zoning, Section F, have in fact been met by the evidence presented
by Mr. Greco, and that said height exception is in fact granted.

Councilman de Long predicated his motion as recommended by
Assistant City Attorney Wolf. He also included in his motion to
approve the unanimous recommendation of the Planning and Zoning
Board that the proposed Site Development Plans include the
Development Agreement and the Project Specifications be approved,

Planning and Zoning Board a coordinated Technical Review (TRB)
recommendation on the proposed Boynton 'Beach Mall site de-

The purposes of this memorandum are twofold as follows:
1. to address the items raised in the November 3rd,1982 memo-
randum from the City Planner to the Planning and Zoning Board; and,
2. to offer additions, deletions and/or modifications to
the November 3rd, 1982 memorandum and to the site development
~lan submission.
Each of the issues raised in the memorandum was answered by Boynton
Beach, Inc. and with the exception of the Public Works Department and
the City Forester,agreement-was reached with staff consistent with
the changes that will follow. The reason that the Public Works
Director and the City Forester have not responded to the changes
is that they were not available to review the proposed modifications;
however, if 'they are in disagreement with the answers provided, tney r
may offer their comments prior to Council review. As in the pre-
vious rnemorand~m, the City Manager's comments are included in this
review.
To that end, please be advised of additional comments as

This memo is in reference to the proposed plant palette
(species list of vegetation) for'the DeBartolo Mall. I would
like to make a few recommendations based on the list of materials
the landscape architect has selected.
1. No one species of any "tree" comprise more than
10-15% of the total quantity used. (This is to
prevent the entire landscape area comprised dE Black
Olive and Mahogany, ie.
2. Recommend using native trees and vegetation in
selection of materials.
3. Removal of "Senegal Date Palm" (Pheonix Reclinata)
from list of Palm trees as it is susceptible to ~
lethal yellowing dis.ease. r
4. Recommend replacement of "Tamarind" (Tamarindus indica)
\'li th "Tamarind II (Lysiloma la tisiliquum), a na ti ve tree
species.
5. Recommend use of "cocoplum" (Chrysobalanus icaco) and
"Silver buttonwood" (Conocarpus erecta) as hedge
material. These species are also native and will
require less maintenance.

Please be advised that on drawing M-3A of this project #678,job XXX,
the following details need to be corrected to the city's satisfaction
before the utility Department can sign off.
1. On the detail of the sampling point, they should show a
minimum cover of 30".
2. On the valve box detail, they should show a 24" square
by 8" thick concrete pad around the collar at the top
of the valve box.
3. Their typical water service detail is incorrect and I
have attached a copy of our standard detail which should
be used for the meter installation.
4. There are 8 fire lines going into the buildings. In
each case, they show the typical detail as going inside
the 'building and then capped.

In our original discussions, it was agreed that the post indicator
valve would be used and that these valves would be outside the
building.
There are two reasons for this. One, being that with the valve box
outside the building, our responsibility would end at this point
arid we would have no responsibility if there was any water damage
done inside of the building.
Secondly, the way it is laid out, when they went to connect their
sprinkler system, they would have contaminated an open system which
serves domestic water and therefore, would have to re-chlorinate and

re-sample.

Councilmember Woolley moved to accept proposed Ordinance No.
82-46 on second and final reading, seconded by Councilman
deLong.

Councilman deLong felt very gratified that he was a member of
the Council when this particular project was coming into the
City because he happened to be on the Council in 1973, when this
was being put together. Councilman deLong wanted to say that the
people the City was doing business with are "tops" and they are
"high class." Councilman Wright thought that was great. Council-
man de Long told Mayor Trauger he could say that Dick Greco is
"tops". Councilman Wright was going to wait to make his comments.
Councilman deLong was only making a comment because he has been
watching this thing for nine years and he felt as though, being
a member of the Council in 1973 when it broke and being
fortunate enough to be here when it actually became culminated,
that he should have something to say. He repeated that he felt

Nayor Trauger declared the Public Hearing closed.
