Executive Order 24-214 Hurricane Milton
Dear Bradley Miller:
This letter is in response to a Development Order extension request received by the Planning and Zoning
Division regarding the Potter Townhomes project (2023.06.12894 & 2024.02.16905, approved on April 16,
2023), pursuant to the emergency declarations for Hurricane Milton.
Florida Statutes Section (FSS) 252.363 was amended on July 1, 2023 via Chapter No. 2023-304. Under this
amendment, FSS 252.363 allows an approved Development Order to be extended for 24 months plus the
tolling period per each emergency order. FSS 252.363 also states that, for extensions granted beyond
September 28, 2022, the extended period may not exceed a total of 48 months if multiple emergency orders
are issued.
Staff has reviewed the Executive Orders (EO) of Hurricane Milton (EO no. 24-214) in accordance with FSS
252.363. Based upon staff’s review, we have determined that the subject project is eligible for the following
administrative extension:
The emergency declaration for Hurricane Milton (EO no. 24-214) began on 10/05/2024, and
subsequently extended via EO no. 24- 215, 24-264, 25-026, 25-068, & 25-119. Therefore, the
request is entitled to an automatic 24-month extension with 296 tolling days.
Original expiration date of the Development Order for the subject project is October 16, 2025. As a result, the
referenced Development Order is hereby extended as follows:
October 16, 2025 + 296 days + 24 months = August 7, 2028
The new expiration date applicable to the referenced Development Order is August 7, 2028, and this letter shall
act as approval of the requested Development Order extension under the guidelines of FSS 252.363.
Please be advised that the subject project may not be eligible for additional extensions beyond the new
Development Order expiration date per FSS 252.363.
