First Development Order Extension by Executive Orders (SPTE 2025.06.3712)
Dear Jeffrey Burns:
This letter is in response to a Development Order extension request received by the Planning and Zoning
Department regarding “The Dune – South Parcel” (NWSP 2023.09.58961), pursuant to the emergency
declarations for Hurricane Milton.
Florida Statutes Section (FSS) 252.363 was amended on July 1, 2023 via Chapter No. 2023-304. Under
this amendment, FSS 252.363 allows an approved Development Order to be extended for 24 months plus
the tolling period per each emergency order. FSS 252.363 also states that, for extensions granted beyond
September 28, 2022, the extended period may not exceed a total of 48 months if multiple emergency
orders are issued.
Staff has reviewed the Executive Orders (E.O.) regarding Hurricane Milton (24-214) in accordance with
FSS 252.363. Based on the Executive Orders provided within your request letter, staff has determined that
the subject project is eligible for the following administrative extension:
• The emergency declaration for Hurricane Milton began on 10/05/2025 via E.O. 24-214, and
subsequently extended via E.O. 24-215, 24-264, 25-26, 25-68, and 25-119. The project was
approved on February 12, 2024, so it qualifies for the following subsequent extensions: E.O. No.
24-215, 24-264, 25-26, 25-68, and 25-119. Therefore, the request is reviewed under the preceding
amendment. The applicable tolling period is 298 days.
The current expiration date of the Development Order for the subject project is August 12, 2025. As a
result, the referenced Development Order is hereby extended as follows:
August 12, 2025 + 298 days + 24 months = June 6, 2028
The new expiration date applicable to the referenced Development Order is June 6, 2028, and this letter
shall act as approval of the requested Development Order extension under the guidelines of FSS 252.363.

WHEREAS, on October 5, 2024, I issued Executive Order 24-214, declaring a state of
emergency for thirty-five counties across the State of Florida due to the dangers presented by
Tropical Storm Milton; and
WHEREAS, on October 6, 2024, Tropical Storm Milton continues to strengthen, and is
forecast to undergo significant to rapid intensification over the next seventy two hours as it moves
eastward over the central and eastern Gulf of Mexico; and
WHEREAS, the forecast indicates that Tropical Storm Milton will be at or near a
catastrophic major hurricane upon landfall along the Florida West Coast, accompanied by life
threatening storm surge and severe wind gusts for the Florida Gulf Coast; and
WHEREAS, an amendment to Executive Order 24-214 is necessary because recovery
efforts and those affected by this disaster require the continued support of the State of Florida; and
WHEREAS, as Governor of Florida, I am responsible to meet the dangers presented to the
State of Florida and its people by this emergency.
NOW, THEREFORE, I, RON DESANTIS, as Governor of Florida, by virtue of the
authority vested in me by Article IV, Section 1 (a) of the Florida Constitution and by the Florida
Emergency Management Act; as amended, and all other applicable laws, promulgate the following
Executive Order, to take immediate effect:
Section 1. Section 1 of Executive Order 24-214 is amended to read as follows:
Because of the foregoing conditions , which are projected to constitute a major disaster , I
declare that a state of emergency exists in Alachua , Baker, Bradford , Brevard , Broward , Charlotte ,
Citrus , Clay , Collier, Columbia, DeSoto , Dixie , Duval , Flagler, Gilchrist , Glades , Hamilton ,
Hardee , Hendry , Hernando , Highlands , Hillsborough, Indian River , Lafayette , Lake , Lee , Levy ,
Madison , Manatee , Marion , Maiiin , Miami-Dade , Momoe , Nassau, Okeechobee , Orange ,
Osceola, Palm Beach, Pasco , Pinellas , Polk, Putnam , Sarasota, Seminole , St. Johns , St. Lucie ,
Sumter, Suwanee , Taylor, Union , and Volusia counties.
Section 2 . Except as amended herein , Executive Order 24-214 is ratified and reaffirmed.
Section 3 . This Executive Order is effective immediately and shall expire upon the
expiration of Executive Order 24-214.

WHEREAS, the tropical system surged from a tropical storm to a category 5 hurricane in less
than twenty four hours on its trajectory in the Gulf of Mexico; and
WHEREAS, on October 9, 2024, Hurricane Milton made landfall as a dangerous category 3
hurricane along Florida's Gulf Coast near Siesta Key, about five miles west of Sarasota; and
WHEREAS, the affected areas are still recovering from the damage caused by Hurricane
Milton; and
WHEREAS, Executive Order 24-214, as amended by Executive Orders 24-215 and 24-234,
expires on December 4, 2024, unless extended; and
WHEREAS, an extension of Executive Order 24-214 is necessary because recovery efforts
and those affected by this disaster require the continued support of the State of Florida.
NOW, THEREFORE, I, RON DESANTIS, as Governor of Florida, by virtue ofthe authority
vested in me by Article IV, Section l(a) of the Florida Constitution and by the Florida Emergency
Management Act, as amended, and all other applicable laws, promulgate the following Executive
Order to talce immediate effect:
Section 1. The state of emergency and all provisions of Executive Order 24-214 are
renewed for sixty (60) days following the date of this Executive Order.
Section 2. This Executive Order will not extend the amendments and accommodations
made by Executive Order 24-234 which are now moot.
Section 3. Except as amended herein, Executive Order 24-214, as amended by Executive
Order 24-215, is ratified and reaffirmed.
