the land development permit, City Commiss ion approval s hall be required f or all w ork involving the movement of material one
thous and (1,000) c ubic yards or greater beyond the property lines in acc ordance with LD R Ch. 4. Art. XI. Sec. 2.A.2.b.
3. All Melaleuca, Brazilian Pepper and Aus tralian Pine w hich occ urs on the s ite s hall be removed in acc ordance with LD R Ch. 4. Art. XI.
S ec . 4.E. Provide T ree Survey and Mitigation Plan as required.
4. Littoral and upland plantings shall be provided in acc ordance with Chapter 4, Artic le II, Section 4.A.9. Provide Landsc aping Plans as
required.
5. Revise Engineering Plans to provide detailed grading plan and s ec tions illus trating s uf ficient propos ed topography and elevations for
the areas of propos ed work to demons trate how proposed grading/s lopes tie-in to exis ting grade abutting utilities/easements , and
minimum perimeter berm along property lines. Ref er to mark up of s heet LM-2.
6. Add note to Engineering Plans : Contrac tor is responsible for verif ying the exac t loc ation of all utilities and is responsible for any
damage to utilities c aused by their w ork . Call S unshine 811 at leas t 48 hours prior to c ommenc ement of exc avation. Add note to
Engineering Plans: A certif ied report shall be s ubmitted eac h month by the applic ant's Florida registered engineer f or the duration of
cons truc tion. Eac h report shall certif y that the work is (or is not) conf orming w ith the requirements of the permit. I f the work is not in
conf ormance, then the report mus t lis t eac h item of work not c onsistent w ith the stipulations of the permit and the remedial action
that the engineer has tak en c oncerning eac h item.
7. Add note to Engineering Plans : Construction mus t immediately c ease upon disc overy of arc heologic al artif ac ts, and c ertified
notif ic ation mus t be forw arded within tw enty-four (24) hours to the D ivis ion of Arc hives , History and Records Management, Florida
D epartment of State. Artifacts mus t be protec ted by the developer to the s atisf ac tion of the divis ion prior to rec ommenc ement of
cons truc tion in the immediate area of the dis covery.
8. Add note to Engineering Plans : T he c ontrac tor shall mak e every ef fort during c onstruction to c ontrol wind and water erosion of the
soil on site until s uc h time as permanent ground c over is installed. Contrac tor shall provide runof f and sediment protec tion around
existing drainage inlets . S hould the s ite bec ome exc es sively dry, and w ind and soil eros ion becomes prevalent and/or a nuisanc e,
the c ontrac tor shall w ater and/or s eed and mulc h the area, and provide erosion c ontrol f encing as necess ary. All disturbed portions
of the site shall be s eeded and mulc hed in acc ordance with LD R Ch. 4. Art. I. Sec. 4.E.
9. Add note to Engineering Plans : All projec ts one-acre or larger in s ize, shall submit a Notic e of Intent (NOI) to the FD EP for c overage
under the NPD ES Generic Permit.
10. Pleas e be advised that additional c omments may be f orthcoming upon rec eipt and subs equent review of the requested
information/documentation.
ADV ISORY C OMMENTS (no res pons e required at this time):
Prior to the is suance of a land dev elopment permit:
1. Obtain plat approval in ac cordanc e w ith LD R Ch. 4. Art. XI . S ec . 2.A.2.a. and LD R Ch. 2, Art. II., S ec . 2.
2. S ubmit f ull set of civil plans , including drainage calc ulations, in ac cordanc e w ith the 2010 LD R, Chapter 4, Article VI I I , S ec tion 3.G.
3. S ubmit Stormwater Pollution Prevention Plan (SW PPP) and/or Eros ion and S edimentation Control Plan.
4. S ubmit digitally s igned Engineer's Estimate of Cost.
5. Remit engineering review /permit fees in the amount of 2.3% of the Engineer's Estimate of Cost.
Prior to c ommenc ement of cons truction, submit the f ollow ing:
1. Copy of all permits required f rom other permitting agenc ies including, but not limited to; South Florida W ater Management D is tric t
(S FW MD ), Lak e W orth D rainage D istrict (LW D D ), Florida D epartment of Environmental Protec tion (FD EP), NPD ES NOI , and Palm
Beach County D epartment of Environmental Resourc e Management (PBCD ERM).
2. D etailed cons truc tion mitigation plans . All c onstruction activity regulated by the LD R shall be perf ormed in a manner so as not to
advers ely impac t the conditions of adjac ent properties , unless s uc h ac tivity is permitted to aff ec t s aid property purs uant to a
cons ent granted by the adjacent property ow ner, under terms or c onditions agreeable to the adjac ent property owner. This inc ludes,
but is not limited to, the control of dus t, nois e, water or drainage runof f, debris and the storage of c onstruction materials . (LD R Ch. 2.
Art. I I I . S ec . 3.D .3.) I mpac ts on bus ines ses, public inconvenience, disruption to multi-modal and vehicular/pedes trian travel on
roadways/sidew alk s in the vicinity of cons truc tion shall be minimized. Construction mitigation plans shall include the f ollow ing
information (as applicable):
Construction s chedule, phasing, staging, and storage
Construction f encing, ingress /egress and s ight triangles
Construction pers onnel park ing – if an off -site location is s ec ured for this purpos e, verif y that a tram or s huttle will be provided
betw een the c onstruction s ite and the park ing area(s) and provide a c opy of the agreement with the property owner.

How ever, City LD Rs Part I I I , Chapter 4, Artic le XIV, Section 2.1.f . provides an exemption only for remodeling, repair, rec onstruction, or
additions to amenities or common area elements that are loc ated w ithin an existing private res idential development. W hile the projec t is
desc ribed as a members -only club, it is not an amenity s erving an existing private res idential development as c ontemplated by the c ode.
Acc ordingly, the exemption does not apply to this project, and participation in the Art in Public Places program is required.
Public Art
A rt in Public Plac es and Public Beautif ic ation [Part III, C hapter 4. A rticle XIV . - Art in Public Places and Public Beautification]
In acc ordance with City Code, Part III, Chapter 4, Article XI V – Art in Public Plac es (AIPP) and Public Beautif ic ation, the total c onstruction
value for the as sociated project is equal to or exceeds $500,000.00 and requires participation w ithin the City’s AI PP program. T he AIPP
program requires that the Applicant provides a Public Art Projec t with a Public Art Budget w ith a value of one perc ent (1%) of the total
c onstruction c os t of the ass oc iated projec t, or one million dollars ($1,000,000.00), whic hever is les s.
Prior to approval of this applic ation, the Applic ant mus t s ubmit a c ompleted AI PP Form (available at https://w w w .boynton-
beach.org/D ocumentCenter/View/873/Art-in-Public-Plac es -Form?bidI d=). The completed AIPP Form must include the Public Art Budget
and indic ate whether the Applic ant will provide a Public Art Projec t on-s ite, w ith a value of s eventy percent (70%) of the Public Art Budget,
or if the Applic ant will provide a Payment-In-Lieu of a Public Art Project paid directly to the City's Public Art Fund with a cost of s ixty
perc ent (60%) of the Public Art Budget.
Prior to permit iss uanc e, the applic ant mus t pay an Administrative Fee of thirty perc ent (30%) of the Public Art Budget to the City's Public
Art Fund, regardless of w hether the Applicant chooses to provide a Payment-I n-Lieu or provide a Public Art Project on s ite. I f the
Applic ant c hoos es to provide a Public Art Projec t on site, the location and the type of public art must be inc luded on the site plan of the
ass oc iated projec t, and include a desc ription of the Public Art Project.
Prior to the iss uanc e of a Certif ic ate of Oc cupanc y or Completion, the applic ant mus t c omplete, install, and pass ins pection f or a Public
Art Projec t on-s ite or provide a Payment-in-Lieu of a Public Art Projec t to the City’s Public Art Fund. All Public Art Projects mus t c omply
with all of the applic able Public Art Projec t requirement’s criteria listed w ithin the City's Code Part III, Chapter 4, Article XI V, S ec . 2.C.2.
and mus t be approved by the Art Advis ory Board prior to the purc hase and ins tallation of any art. Prior to submitting an AI PP Applic ation to
s chedule an Art Advisory Board meeting, the Applicant must first hold a Public W ork s hop and submit these f indings w ith the AI PP
Applic ation, including the required documentation for review and approval by the Art Advisory Board. Pleas e contact staff f or additional
inf ormation regarding the submittal guidelines .
Early s ubmiss ion of the proposed artwork is STRONG LY encouraged to avoid projec t delays , holds on the permit iss uanc e, or delays of
the is suance of the Certif ic ate of Oc cupanc y or Completion. T he applicant may c hoos e at any time to provide a Payment-In-Lieu of a
Public Art Projec t; how ever, once a payment is made to the Public Art Fund, no ref unds are permitted purs uant to City Code Part I I I ,
Chapter 4, Article XI V. S ec . 2.C.5.

with John Stout.
However, City LD Rs Part III, Chapter 4, Article XI V, S ec tion 2.1.f. provides an exemption only f or remodeling, repair, recons truc tion, or
additions to amenities or c ommon area elements that are located within an exis ting private residential development. W hile the project is
des cribed as a members-only c lub, it is not an amenity serving an exis ting private residential development as contemplated by the code.
Ac cordingly, the exemption does not apply to this projec t, and partic ipation in the Art in Public Plac es program is required.
