We have reviewed your July 23 memo and have no comment. With respect to the July 16
Conahan letter we have no substantive comment because we cannot detect anything relating to
the City or its interests in the attachment. Exception: At one point the agreement acknowledges
that the City may enforce its code, but I don't see how that changes anything, I believe we can
enforce our code with or without the agreement,
So long as the City is not a party to the agreement, and more particularly to paragraph lion page
4 and paragraph 13 on page 5 I think it is swell that copies of notices will be sent to our City
Manager.

The statement presented to you by Mr, Conahan did not accurately state my opinion about car
stops and 14 year old variances, My opinion is that the Land Development Regulations ofthe
City are crystal clear in saying "These regulations (Chapter 23) shall be applicable to all
permanent parking lots constructed or reconstructed in the City." Furthermore, "Compliance is
required under any of the following conditions;
A. When a parking lot serves an existing building(s) where said building(s) is
proposed to be enlarged or when an additional building is proposed to be
constructed;"
See LDR Chapter 23, Article I, Section 2, page 23-1.
His statement that I will not delete the code requirement unless the variance of 1982 applies to the
entire Boynton Beach Mall is just that: his statement. My statement was that unless the variance
stated in so many words that it was valid in perpetuity regardless of future code changes, it would
not exempt him many years in advance of all possible changes,
Therefore, I do not agree with you that no further variance is required, because in my opinion it
quite clearly is required.

2. Following a site visit to the property to compare the location
of the regular and handicapped parking spaces at the site to
the location proposed and shown on sheets SPl, SP4, 1 and I-A
of the submitted plans it is evident that changes are proposed
to the layout of a majority of the parking spaces within and
outside of the area marked on sheet 1 as "Work Limit Line",
These proposed changes will require the following corrections
to be made to sheets SPl, SP4, I, and 1-A of the submitted
plans:
i. Change the detail drawing of the handicapped parking
spaces found on sheet SPl to be consistent with the
configuration of the parking spaces depicted on city
standard drawing B-90012 (find attached B-90012).
ii. Change the configuration of all handicapped parking
spaces depicted on sheets SPl, SP4, 1 and I-A to show the
appropriate five (5) foot wide access aisle required
adjacent to the spaces.
iii. On sheets SP1, 1 and I-A, use a symbol to delineate all
areas of the parking lot where the regular and
handicapped parking spaces are being restriped and state
that the restriping will be consistent with city detail
drawing B-90012.
iv, Where applicable, change the tabular count of spaces
identified on the plan view drawings SPl, 1 and I-A so
that the number of spaces regular and/or handicapped
match the horizontal control dimension between landscape
islands, access aisles and other appurtenances such as
site lighting pole bases and/or sidewalks. When
establishing the number of regular and/or handicapped

parking spaces that will fit between two fixed points use
the dimension identified on city standard drawings
B-90012 and B-90013.
v. Where applicable, adjust the site data to identify the
total number of parking spaces provided (Note: The number
of parking spaces provided shall be no less than the
total number of parking spaces required).
vi. Add to the site data found on sheet SPl the total number
of handicapped parking spaces that is required and
provided (Note: The number of handicapped spaces
provided shall be no less than the number required by the
Handicapped Accessibility Code).
3. Modify the building section sketch found on sheet SPl to show
a maximum of forty-five (45) feet building height. [Chapter 2
- Zoning, Section 6.C.3]
4. On sheet SP1 identify with notes and/or symbols the buildings
that are existing on site and the proposed new structures.
5. On sheet SP1, along the west perimeter of the building
identify with a symbol the location of the area where the new
building (Department Store F) will connect to the existing
building. Also delineate the areas along the perimeter of
the building, outside of the area where the new building will
connect, that will be changed as a result of the new
construction,
6. On sheet SP1 add or modify the following site data:
i. Omit the ultimate construction text.
ii, Identify what percentage the total impervious area is of
the entire site.
iii. Identify what percentage the pervious area is of the
entire site. Separately delineate the total square feet
area of the preservation site.
iv. Identify 1,244,449 as the maximum gross leasable square
footage allowed for the development.
7. On sheet SPl remove from the plan view drawing and building
floor area computQ~ions the square footage of the third floor
of Department Store B to match the square foot area of the
building identified on the plans of record located in the
Building Division, Adjust the site data and total number of
required parking spaces accordingly.
8, On sheet SP1 change the square footage of the auto service
center building from 21,696 to 20,511 to match the square foot
area of the building identified on the plans of record in the
Building Division. Adjust the site data and total number of
required parking spaces accordingly,
9. Modify the site plan review application to be consistent with
the data required above.
10. Submit a signed site plan rider that was missing from the site
plan review application,
11. Submit a current survey to include all areas that are to be
affected by this application.

1. Prior to issuance of a Building Permit, the applicant shall cause the preservation as
a native habitat preserve in perpetuity of the pine area in the northwest quadrant
of the site by recording appropriate Restrictive Covenants which, prior to recording,
shall be approved by the Treasure Coast Regional Planning Council and the City of
Boynton Beach. (Per Resolution R96-26)
2. Prior to commencing construction activity within the parcel containing the area to
be preserved, the preserve area shall be temporarily fenced or otherwise delineated
to prevent construction equipment from entering the area. (Per Resolution R96-26)
3. All Brazilian pepper, Australian pine, and Melaleuca on the site (including within
the limits of the pine area) shall be removed prior to issuance of a certificate of
occupancy for any new square footage. These species shall not be used in
landscaping. (Per Resolution R96-26).
4. A landscaped buffer along the west boundary of the Pine Area and adjacent to
Javert Street shall be provided in accordance with the plan attached to the
Resolution 96-26 and identified as Exhibit "1" to the resolution.
5. Utilizing native woody species prior to construction and planting of littoral zones
around the existing detention ponds, the applicant shall prepare a management plan
for the littoral zone to be reviewed and approved by the Treasure Coast Regional
Planning Council in consultation with the City of Boynton Beach and the South
Florida Water Management District. The Plan shall include a description of the
monitoring and maintenance procedures to be followed in order to assure the
continued viability and health of the littoral zones. No Certificate of Occupancy
shall be issued for any additional square footage constructed until the Plan is
determined to be consistent with the Regional Plan. The littoral zone shall be in
place prior to the issuance of a Certificate of Occupancy for any additional square
footage to be constructed. (Per Resolution R96-26)
6. Drainage plans to be submitted shall be designed so that under no circumstances
shall post development runoff volumes exceed predevelopment runoff volumes for
a storm event of three-day duration and 25-year frequency, (Per Resolution R96-26)
7. No building permits for gross leasable space in excess of 1,108,000 square feet within
the Boynton Beach Mall shall be issued until all right-of-way within the project
boundaries have been dedicated, free and clear of all liens and encumbrances, to the
City of Boynton Beach or Palm Beach County as necessary and consistent with the
Palm Beach County Thoroughfare Right-of-way Protection Plan. (Per Resolution
R96-26)

8. Prior to, or upon issuance of a building permit for the additional square footage, the
applicant shall pay a fair share contribution consistent with the Fair Share Impact
Fee Ordinance applicable to the Boynton Beach Mall proposed change. (Per
Resolution R96-26)
9. Upon a site visit to the property to compare the count and location of the regular
and handicapped parking spaces to the location shown on sheets SP-l, SP-4, 1 and
1- A of the submitted plans it was determined that changes have been made to the
parking layout which results in the total number of provided spaces being less than
what is specified on the parking data. The above-listed plan view drawings will be
required to be updated to show and identify the accurate number of regular and
handicapped parking spaces provided at the site to enable staff to determine whether
the provided number of spaces meets the minimum requirements. An accurate
count and listing of the existing and proposed new parking space layout is required
to determine whether the appropriate number of handicapped parking spaces are
being provided at the site. Modify the plans and parking data to show the correct
total number of provided spaces. Provide a separate listing identifying the number
of required and provided handicapped spaces. Also show on sheet SP-l the location
of no less than the minimum number of handicapped parking spaces as required by
code. The total number of required parking spaces is incorrectly identified on sheet
SP-l. Correct the count and data by dividing the total gross leasable floor area by
two hundred (200). Also, correct the inconsistency between the total number of
parking spaces that will be provided in the two (2) levels above grade of the parking
structure. The number of spaces identified in the parking data on sheet SP-l is 640
and the detail drawing found on the same sheet indicates 680 spaces. The number
of parking spaces provided shall be no less than the total number of parking spaces
required. Approval of a variance to the zoning code to reduce the number of
required spaces will be required if the number of spaces provided is not consistent
with city regulations.
10. Modify the building elevations found on sheet titled "Design Elevations" to show a
maximum building height not exceeding the city's forty-five (45) feet height
limitation. [Chapter 2 - Zoning, Section 6.C.3]
11. On sheet SP-l, show and label the work limit line.
12. On sheet SP-l modify the site data to include the following information:
Separately delineate the total square feet area of the preservation site. This
area shall match the area that is identified on the city zoning map as REC as
well as the area identified on the corrected survey prepared by O'Brien,
Sutter & O'Brien, Inc.
13. Correct the inconsistency between the configuration of the parking structure
drawing found on sheet SP-l and the parking structure shown on the sheet titled
"Design Elevations". Adjust the site data and total number of parking spaces
provided accordingly,
14. Submit drawings that show the layout and dimensions of the columns, stairs, walls,
elevators (where applicable) and pedestrian access for each of the two above grade
levels of the parking structure as well as the parking layout at grade level. Modify
the provided parking calculations accordingly.

15. Submit elevation view drawings of the North, South and East sides of the parking
structure including identifying the dimension of the overall height of the structure.
Also identify all exterior materials and their color by name, color designation and
manufacturer.
16. Show on the elevation view drawings the location and elevation of the highest point
of the roof top mounted equipment. All roof top equipment shall not be visible from
a distance of six hundred feet. Show the required screening and identify the
material and color by name, color designation and manufacturer. Screening shall
not exceed forty-five (45) feet.
17. Submit for review conceptual floor plan drawings of Department Store F. Identify
the principal use and ancillary uses on the floor plan.
18. On the sheet titled, Tree Locations Boynton Beach Mall - Preserve, prepared by
O'Brien, Sutter & O'Brien, Inc., identify the legal description of the land area and
the total acres. The total acreage/area shall not be below the area of the land
identified and zoned REC (Recreation). Where applicable, modify the proposed
vehicle use area and adjacent landscape strip to not encroach into the preserve.
19. On the sheet titled Planting Plan (L-2), change the spacing of the coco plum hedge
from three (3) feet to two (2) feet, center to center. Also place a note on the plan
indicating that the spacing of landscape material identified on the landscape plan
supersedes the quantities listed.

~he Boynton Beach Mall is located approximately 900 feet west of
the intersection of Congress' Avenue and Old' Boynton Road (aee
attached location map ,in exhibit: "A" which also illustrates zoning
districts in the area). The majority of the mall property is zoned
C-3, Community Commercial, however the northwest portion is zoned
REC to overlay a required preservation area. Thomas Marsicano,
agent for DeBartolo Properties Managemnt, Inc. - the mall property
owner, has submitted a notice of proposed change to the previously
approved development order (Resolution No. 91-37) for the Boynton
Beach Mall DRI (Development of Regional Impact). The proposed
amendments are listed below:
1. Extend the date of buildout from December 31, 1991 (which
has been exceeded) to February 20, 1998.
2. Revise the following traffic mitigation conditions:
a) Hypoluxo Road/Congress Avenue - northbound and
southbound left turn lanes;
b) N.W. 22nd Avenue/Congress Avenue - southbound
right turn lane;
c) Old Boynton West Road/Congress Avenue
eastbound left turn lane;
d) Boynton Beach Boulevard/I-95 West - westbound
through lanes and left turn lanes and
e) Boynton Beach Boulevard/I-95 East - eastbound
through lanes and left turn lanes.
BACKGROUND
This amendment request is governed by Chapter 380.06(19), Florida
Statutes, fo~ a determination of substantial deviation. A public
hearing must be conducted by the City Commission to determine
whether further development of regional impact review is required.
If no further review is required, the City Commission shall issue
an amended development order which, in this instance, requires the
passage of a resolution to amend the previously approved
development order, If a determination is made that the proposed
changes require further development of regional impact review, the
review shall be conducted only on those aspects of the development
order required to be changed.
The required public hearing shall receive a fifteen day public
notice. This has been advertised in the Palm Beach Post for a
public hearing to be conducted on February 20, 1996, In addition,
the public hearing notice has been faxed to the Treasure Coast
Regional Planning Council, who has a contract with the Department
of Community Affairs (DCA) to review such requests in this area.

Therefore, it is necessary for the mall to request an extension of
their build-out date.

Florida Statutes states that;
"An extension of the date of buildout, or any phase thereof,
of 5 years or more, but less than 7 years shall be presumed
not to create a substantial deviation"
Pursuant to this section of state law, the mall's request for an
extended buildout date of February 20, 1998 is less than the 7 year
threshold for a substantial deviation. Hence, this alone does not
constitute a substantial deviation,
In conjuction with the buildout dat,e extension, the applicant was
required to update his traffic analysis, Revisions to the
transporation mitigation conditions are appropriate due to the
completion of some of the previously required improvements,
completion of additional improvements not addressed in the 1989
substantial deviation traffic analysis and changes in state DR!
law. The list of remaining traffic conditions within the attached
resolution have been approved by Palm Beach County, the FDOT ~nd
the Treasure Coast Regional Planning Council's traffic consultant.
RECOMMENDATION
Based on the approvals that have been received by the city from
other agencies responsible for reviewing DR! amendments, it is
recommended that the Commission make a determination that the
changes requested do not constitute a substantial deviation and
that they approve the attached resolution which modifies the
previously approved Boynton Beach Mall DRI development order,

Dear Mr. Conahan:
The City of Boynton Beach has completed its first review of the
documents submitted for the above-referenced project. Attached are
comments made by the reviewing departments during their initial
review of your project.
In order to complete the review process I the site plan and
documents must be amended to comply with these comments within 90
days of the date of this letter. (If amended plans are not
submi tted in 90 days I a new application fee will be required.)
When there are comments made by the reviewers that you feel are not
applicable to the approval of the project or will be addressed
separately and you have not amended the plans to comply with the
comment(s), you must prepare written explanation for each comment
stating why the comment is not applicable and return the
explanation with the amended plans and documents.
After amending the plans and documents, please submit twelve (12)
complete sets (including surveys) of the plans to the Planning and
Zoning Department. When the amended plans and documents have been
submi t ted to the Planning and Zoning Department, they will be
distributed to the reviewing departments for second review and
recommendation to the appropriate boards for approval or denial
(see attached meeting schedule), A recommendation for denial will
be made if there are major comments that have not been addressed on
the resubmitted plans.

CHECKLIST
The following list and information is provided as a checklist to ensure that
the submittal of amended plans and documents is substantially complete for
review. Turning in this list and the appropriate plans and documents will
enable the submittal to be efficiently checked prior to being accepted by the
Planning and Zoning Department.
Project Name: Boynton Beach Mall Department Store F (File No.MSPM 96-001)
Submit an amended Site Plan Review/Conditional Use application form that
reflects the changes that were made as a result of amending the plans
and documents to comply with the Code of Ordinances and the Technical
Review Committee comments. A copy of the original form with a
distinguishable symbol identifying the change(s) may be submitted or a
completed new form with the changes identified. If there are no changes
required to be documented on the application form, a letter from the
applicant stating same must be turned in with the amended submittal.
2.
Submit twelve (12) assembled and complete sets of plans and documents,
including surveys that show compliance with the Code of Ordinances and
comments made by the Technical Review Committee. Two (2) of the sets
shall have the appropriate legible raised seal and signature of the
designer responsible for the drawing(s). Plans and documents shall be
assembled in twelve (12) individual complete packages with the title of
the project on all pages and/or sheets and each page or sheet
numerically numbered such as the following example: 1 of 3, 2 of 3, 3 of
3.
Submit color photographs of the buildings on the site that are to remain
in their existing condition and photos of existing buildings that are
located on the sites that abut the perimeter of the subject property.
The minimum size is 4" by 6". Each photograph shall be labeled to
identify the location of the existing structures with respect to the
location of the proposed project.
Submit colored elevation view drawings - a colored duplicate copy of all
drawings of the elevation views of each side of all buildings and
signage associated with the project. The colored elevation views shall
match the elevations shown in the documents that were submitted for site
plan review. The applicable exterior surfaces as identified above shall
be colored with the color name and associated color reference number
identified. The type of exterior surface material shall be identified
next to the associated color. The colored elevation drawings shall have
compass direction or title of the side of the building identified. The
title block of the original drawing shall be shown. The maximum size is
24" by 36". Do not submit on board of any kind.
5.
Submit color samples as an example of the proposed colors. Each sample
shall have attached a label that identifies the color by name and
numerical/letter code from an established color chart.
6 .
Submit a 8 1/2" x II" transparency of the landscape site plan drawing to
be used on an overhead projector at board meetings.

The following is a list of 1st review comments regarding the site
plan review of the plans for the above-referenced project. It
should be noted that the comments are divided into two (2)
categories. The first category is a list of comments that identify
deficiencies from the City's Land Development Regulations (L.D.R.)
that are required to be corrected and shown in compliance on the
plans and/or documents submitted for second (2nd) review in order
for the project to continue through the site plan review process.
The second set of comment(s) lists recommendations that the
Planning and Zoning Department staff believe will enhance the
proposed development. The applicant shall understand that all
documents and plans submitted for site plan are subject to
additional comments. I recommend that the applicant/agent contact
me regarding questions related to the comments. If the applicant
is not intending to correct code deficiencies and they request that
the proj ect remain on the review schedule identified in the
attached letter they should contact me regarding the procedures,
application forms, fees and submittal deadline dates for seeking
relief from the code requirement.
I. SITE PLAN REVIEW COMMENTS:
1. Proposed expansion should comply with all conditions of
the resolution No. 91-37 amending prior development
orders adopted November 16, 1982, and December 19, 1989
(see Exhibit A - - Current Development Order). Modify the
plans and documents to show compliance as follows:
Conditions of Development Order as amended;
#2. Submit for review 3 copies of the appropriate
restrictive covenants for the perpetual protection
of the native preserve.
#4. Removal of all referenced exotic material from the
limits of the pine area should commence immediately
so as not to delay a certificate of occupancy.
#5. Buffer along Javert Street
number 22.

structures located in pavement areas which in turn
leads to the detention ponds rather than showing
runoff being pretreated in grassy swales before
being conveyed to the detention pond.

#6B. Submit littoral zone planting plans for the "T"
shaped detention pond. As allowed an alternate
design may be necessary to retrofit this pond.
#7. Submit drainage computations to verify compliance.
#9. Provide an opinion of title prepared by the
project's attorney verifying compliance.
#10 & #11. Construct all roadway improvements required as part
of the "Notice of Proposed Change" resolution to be
adopted February 20, 1996.
2. After having visited the property to compare the location
of the regular and handicapped parking spaces at the site
to the location proposed and shown on sheets SPl, SP4, 1
and I-A of the submitted plans, it is evident that
changes are proposed to the layout of a majority of the
parking spaces within and outside of the area marked on
sheet 1 as "Work Limit Line". These proposed changes
will require the following corrections to be made to
sheets SPl, SP4, 1, and I-A of the submitted plans:
i. Change the detail drawing of the handicapped
parking spaces found on sheet SPl to be consistent
with the configuration of the parking spaces
depicted on city standard drawing B-90012 (find
attached B-90012) .
ii. Change the configuration of all handicapped parking
spaces depicted on sheets SPl, SP4, 1 and I-A to
show the appropriate five (5) foot wide access
aisle required adjacent to the spaces.
iii. On sheets SPl, 1 and I-A, use a symbol to delineate
all areas of the parking lot where the regular and
handicapped parking spaces are being restriped and
state that the restriping will be consistent with
city detail drawing B-90012.
iv. Where applicable, change the tabular count of
spaces identified on the plan view drawings SPl, 1
and I-A so that the number of spaces regular and/or
handicapped match the horizontal control dimension
between landscape islands, access aisles and other
appurtenances such as site lighting pole bases
and/or sidewalks. When establishing the number of
regular and/or handicapped parking spaces that will
fit between two fixed points use the dimension
identified on city standard drawings B-90012 and
B-90013.
v. Where applicable, adjust the site data to identify
the total number of parking spaces provided (Note:
The number of parking spaces provided shall be no
less than the total number of parking spaces
required) .
vi. Add to the site data found on sheet SPl the total
number of handicapped parking spaces that is
required and provided (Note: The number of
handicapped spaces provided shall be no less than
the number required by the Handicapped
Accessibility Code) .

3. Modify the building section sketch found on sheet SPl to
show a maximum of forty-five (45) feet building height.
[Chapter 2 - Zoning, Section 6.C.3J
4. On sheet SPl identify with notes and/or symbols the
buildings that are existing on site and the proposed new
structures.
5. On sheet SPl, along the west perimeter of the building
identify with a symbol the location of the area where the
new building (Department Store F) will connect to the
existing building. Also delineate the areas along the
perimeter of the building, outside of the area where the
new building will connect, that will be changed as a
result of the new construction.
6. On sheet SPl add or modify the following site data:
i. Omit the ultimate construction text.
ii. Identify what percentage the total impervious area
is of the entire site.
iii. Identify what percentage the pervious area is of
the entire site. Separately delineate the total
square feet area of the preservation site.
iv. Identify 1,244,449 as the maximum gross leasable
square footage allowed for the development.
7. On sheet SPl remove from the plan view drawing and
building floor area computations the square footage of
the third floor of Department Store B to match the square
foot area of the building identified on the plans of
record located in the Building Division. Adj ust the site
data and total number of required parking spaces
accordingly.
8. On sheet SPl change the square footage of the auto

9. After reviewing the Palm Beach County Tax Map for the
relocated canal, the following is requested:
Submit a copy of a completed City of Boynton Beach "Unity
of Title Form" that has been recorded in Palm Beach
County which identifies the relocated L-23 Lake Worth
Drainage District canal as tied to the mall property.

Omit from the provided parking space count the parking
spaces that are partially or completely located on the
relocated canal property (this assumes the Lake Worth

16. Show on the elevation view drawings the location and
elevation of the highest point of the roof top mounted
equipment. Note all roof top equipment shall not be
visible from a distance of six hundred feet. Show the
required screening and identify the material and color by
name, color designation and manufacturer.
17. Submit for review conceptual floor plan drawings of
Department Store F. Also, within the floor plan identify
the principal use and ancillary uses.
18. On sheet SP1 and SP4 identify the location of the new
site lighting poles and the location of the site lighting
poles that are to be relocated. Omit sheets E-1, E-4 and
E-5.
19. On sheet 2 of 2 prepared by O'Brien, Sutter & O'Brien,
Inc., identify what the property is and how it relates to
the overall site, add the legal description of the land
and identify total acres. Also, show and identify the
west border of the 85 foot wide canal right -of -way.
Include a symbol that represents the west side of the
curbing of the proposed parking lot expansion and
identify the square foot area that is between the east
side of said line and the east edge of the land shown on
the survey.
20. Add to the littoral zone planting plan computations to
show compliance with Section 6B of the Current
Development Order regarding ten (10) square feet of
planting per linear foot of shoreline so that at least
sixty (60) percent of the shoreline has a vegetated
littoral zone.
21. Attach revised littoral zone planting plans to the
resubmittal.

from north and west, change the buffer planting and fence
specifications as follows:
i. change the overall height of the shrubs after
planting from 18 inches to 24 inches,
ii. change the spacing of the shrubs from 30 inches on
center to 24 inches on center and
iii. change the height of the chainlink fence from four
(4) feet to six (6) feet along the Javert Street
frontage of this preserve and the north side of the
preserve area.

Slash Pine trees is required. A continuous Wax Myrtle hedge along the proposed
chain link fence to provide additional screening and habitat enhancement of the
undeveloped area.
All dead Pine trees shown on the sheet should also be replaced with newly installed
Slash Pine trees (13 trees in total).
Sheet 6 of 18 The plant list indicates eight (8) species of trees/shrubs/groundcover plants which are
not native. The Annexation A~eement (November 16, 1982, Ordinance No. 82-38)
#4, paragraph 5, pg. 9, indicates the "owner will use native trees and vegetation on
selection of materials.
The tree shown on the plant list as "Taramindus indica" must also be chanted to the
~ species, per the same Annexation Aweement pg. 9.
The 4' wide sod strip between fence and curb as shown on the plans should be seeded
with native grasses in lieu of the sod. This management technique would prevent
exotic grasses from creeping into the preserve area.

Your letter dated January 11, 1996 to the applicants' agent requesting that they provide the items
missing from the submittal by January 18, 1996 has not been complied with, therefore, my
Memorandum No. 96-019 dated January 18, 1996 still stands.
Until such time as architectural plans are presented and an up-to-date survey is received,
technical questions with regards to ingress and egress and easement encroachment cannot be
determined. Plans must show that placement ofthe anchor store and multi-story garage does not
encroach upon easements, etc.
It is our understanding that this project is anticipated to continue with or without technical staff
comments being adhered to. It is our hope that it does not proceed to the next level until
appropriate plans have been submitted and approved.
Attached is a copy of the maximum plan size that we would like the building plans to follow so
we may comply with State Statute 119 for records.

1. Sufficient information to complete review.

3. All plans submitted for specific permits shall meet the City's code requirements at time of
application. These permits include, but are not limited to the following; site lighting,

We have reviewed subject project, much of which was prepared in the 1980's. No parking
structure or building details were provided so we cannot comment on either of them. Because of

comments because there is not enough information provided. It seems counter-productive to
review all these 18 Sheets of plans, when your January 11 th letter to the Agent for the project
already outlines major deficiencies.
We suggest that in the future the applicant be informed at the pre-application conference, that
incomplete submittals will be returned or held until such time as the Submission Requirement are
met. This would alleviate review of huge sets of plans by the Building Division and others,
when information has no value on the work requested.
In order for us to continue our review, we need the architectural plans as requested in Item "D"
Submittal Requirement.
A standard for Plan size needs to be approved that would comply with the departments' record
keeping and microfilm program.

Find attached for your review the plan9 and exhibits for the
above-referenced project. Site Plan Review approval for this
project will be granted by the City Commission. To ensure that
the project stays on line with the review time frame, I request
that the plans and exhibits be reviewed and for.mal written
comments transmitted to the Director of the Planning and Zoning
Department no later than 5:00 P.M. on Januarv 30, 1996. Do not
return plans and exhibits. Retain same for the review of the
amended plans (second review) .
Adhering to the following review guidelines will promote a
comprehensive review and enable the applicant to efficiently
obtain Technical Review Committee approval:
1. Use the review standards specified in Part III, Land
Development Regulations, Chapter 4, Site Plan Review,
Section 8 of the Code of Ordinances to review and formulate
comments.
2. The documents submitted for the project were determined to
be substantially complete based on the submittal
requirements identified in Section 7 of the Site Plan Review
Ordinance. However, if the data provided to meet the
submittal requirements is insufficient to properly evaluate
and process the project based on the review standards or the
documents show code deficiencies, additional data and/or
corrections should be requested by the reviewer through the
Planning and Zoning Department.
3. Each comment shall reference the section of the code that is
incorrectly depicted on the documents.
4. Technical Review Committee member(s) shall identify in their
comments when the plans depict or when the location and
installation of their departmental required improvements may
conflict with other departmental improvements.

5. When a TRC Member finds a code deficiency that is outside of
his/her review responsibility, the comment and the specific
code section may be included in their review comments with the

6. If a TRC member finds the plans acceptable, he/she shall
forward a memo, within the time frame stated above, to the
Planning and Zoning Director stating that the plans are
approved and they do not have any comments on the plans
submitted for review and recommend the project be forwarded
through the approval process.
All comments shall be typed, addressed and transmitted to the
Director of the Planning and Zoning Department for distribution to
the applicant. Please include the name and phone number of the
reviewer on this memo. Michael E. Haag will be the Planning and
Zoning Department staff member coordinating the 1st review of the
project.
The Planning and Zoning Department will send the applicant a cover
letter which includes the comment(s) and directions to amend the
plans to comply with the comments and the procedures for
resubmission. When the Planning and Zoning Department receives the
amended plans, they will distribute the plans with a cover memo to
all TRC Members for review and approval.

part due to an overqrowth of vines ana some exotic pl~nts
that have invaded the pineland. Management of the preserved
area to control the vines and remOVe exotic specie9 would
improve the habitat value of -r.ne pineland and help a8::!!1Ure
the continued survival of this small tract. Such action
*might also, however, decrease the utility of the area as a
visual buffer unless other action is taken to enhance t:he
effectiveness of the area as a buffer.
The developer is proposing to add a Sears to the mall which
will lie within the currently developed areas. Rowever, in
order to accommodate additional parkinq, the developer is.
propos ing to remove 2.42 +1- acres of the existinq pin@
area. To minimize the amount of pineland removed. the
developer is propcsinq to relocate and culvert lateral
danal-23 (L-23) so that it lies beneath the ring road of the
n!all. Once this canal is culverted, it will create an
~da1t1onal .14 +/- acres of land along Javert street where
~ines can be planted. The developer is proposing to remove
tne f5razi11an pepper from the remaining pineland. replace
~t with ~~a$h pine, and to plant pines in the existinq
1parselY veqeta~ed areas as ~ell.

Council policy requires that 25 percent of any native
~abitat present on a site prior to development be preserved.
This policy is to help prevent any native species in me
Region from becoming a species of special concern (1.e., to
provide nab1tat even for common species). prior to
development, the site supported l~.J acres or pine savannah.

to be zone~ as recreational land, is consistent with Council
policy. This p~e5erved a~ea should De ~naged to increase
it~ habitat value and ensure it5 viability.
When the ori9inal Oev~opment Order was issued in 1974 by
Palm Beach. Coun~y, it included -t:he eondi tion that the
developer was to "preserve the area of pine on thQ su.bjQQt
property." The prsGGrvaticn of ~t fraction of the

Recommendations
In an effort to maintain habitat for all native species in
the Region and prevent this site fro~ actinq as a source of
.seed of exotic pest species, the following conditions should
be incorporated into the Development Order:
1.. The developer shall preserve no less than 5.S3 acres of '
pineland in the northwest:. quadrant of the site whose
approximate location is shown i.n Exhibit HVW-l.
Preservation in perpetuity as a native nabitat preserve
area shall be assured by deed restriction ror a minimum
of 5.SJ cont1guous acres within that quaarant.

Dear Mr. Conahan:
On January 9, 1996, your submittal documents for Site Plan
Modification of the above-referenced proj ect was reviewed for
completeness. Staff's initial review has determined the following
major deficiencies with this submittal:
1. No current survey (12 copies required) was provided as
required per Section Chapter 4, Zoning, Section 7.A.
(The 1989 survey can be updated.)
2. No architectural plans (12 copies required) were provided
as per Chapter 4, Section 7. D. These plans should
include also colored building elevations and building
material samples. As discussed with Rod Vosper, this
shall be required at time of resubmittal.
3. The height of any building in the C-3 zoning district
(Community Commercial) cannot exceed 45 feet; see Chapter
2, Section 6.C.3 of the city's land development
regulations. The submitted building section indicates
the height in excess of 51 feet. Chapter 2, Section 4.F
of the city's land development regulations delineates the
process for obtaining relief from this requirement, and
lists types of structures and parts of buildings for this
relief. Please note that the parapet wall is not listed.
Since no architectural plans were submitted, from what
was submitted, it appears doubtful that a height

exception is possible. However, if you have design
information that proves otherwise, a height exception
application should be submitted immediately for approval
by the Commission.
4. Verify that the size of the proposed expansion is within
that allowed by the 1991 approval of the Amended
Development of Reqional Impact Application for
Development Approval for Chanqes to a Previous I v Approved
Development of Reqional Impact. dated August, 1988.
Items 1 and 4 should be submitted in 12 copies by January 18, 1996
to avoid interruption in processing this application. Michael Haag
of my office has been assigned to coordinate the review of this
submittal. I would recommend he be contacted immediately regarding
these issues.

SUBJECT: Macy's Department Store - Site Plan
.
This memorandum is in reference to the foundation
landscape plan for the above department store at the
Boynton Beach Mall.
1. The landscape plan does not reflect the use of 50\
native tree species. However, the original Boynton
Beach Mall was constructed prior to the
comprehensive plan requirements of 50% native trees
used on all landscape plans. Secondly, the
landscape plan as shown is consistent with the
surrounding mall landscaping and blends in with
other department store landscaping plans. The
requirement decision should be reviewed and
approved by all appropriate boards and the City
Commissioners.

Boynton Beach Mall Addition of Macy's
We can app~ove this p~oject, subject to the following conditions:
1. Both fi~e lines will requi~e post indicato~ valves and
Siamese connections. Please indicate thei~ location.
2. The fi~e line on the- south side of the building is within
the gene~ator enclosure. Maximum sepa~atlon from the
generato~ itself should be maintained so as to avoid pipe
failu~e due to vibration. Please specify this distance on
the plans.
3. Tapping sleeves and valves must be specified fo~ connecting
new fi~e lines and se~vice into existing main.
4. The City maintains main line sewe~ only on this site.
Details must, howeve~, still be p~ovided on sanitary servi-
ces so as to allow inspection. We recommend the service
under the loading docks should be of an ext~a-st~ength
material due to its shallowness in the loading area.
5. Details must be provided on the meter, meter pit, vault,
valving, etc. All meters larger than 2" must be provided
by developer.
