Furthermore, "Compliance is required under any of the following conditions; A. When a parking lot serves an existing building(s) where said building(s) is proposed to be enlarged or when an additional building is proposed to be constructed;" See LDR Chapter 23, Article I, Section 2, page 23-1. His statement that I will not delete the code requirement unless the variance of 1982 applies to the entire Boynton Beach Mall is just that: his statement. My statement was that unless the variance stated in so many words that it was valid in perpetuity regardless of future code changes, it would not exempt him many years in advance of all possible changes, Therefore, I do not agree with you that no further variance is required, because in my opinion it quite clearly is required. Change the configuration of all handicapped parking spaces depicted on sheets SPl, SP4, 1 and I-A to show the appropriate five (5) foot wide access aisle required adjacent to the spaces. iii. Prior to issuance of a Building Permit, the applicant shall cause the preservation as a native habitat preserve in perpetuity of the pine area in the northwest quadrant of the site by recording appropriate Restrictive Covenants which, prior to recording, shall be approved by the Treasure Coast Regional Planning Council and the City of Boynton Beach. (Per Resolution R96-26) 2. Prior to commencing construction activity within the parcel containing the area to be preserved, the preserve area shall be temporarily fenced or otherwise delineated to prevent construction equipment from entering the area. (Per Resolution R96-26) 3. All Brazilian pepper, Australian pine, and Melaleuca on the site (including within the limits of the pine area) shall be removed prior to issuance of a certificate of occupancy for any new square footage. These species shall not be used in landscaping. (Per Resolution R96-26). 4. A landscaped buffer along the west boundary of the Pine Area and adjacent to Javert Street shall be provided in accordance with the plan attached to the Resolution 96-26 and identified as Exhibit "1" to the resolution. 5. Utilizing native woody species prior to construction and planting of littoral zones around the existing detention ponds, the applicant shall prepare a management plan for the littoral zone to be reviewed and approved by the Treasure Coast Regional Planning Council in consultation with the City of Boynton Beach and the South Florida Water Management District. The Plan shall include a description of the monitoring and maintenance procedures to be followed in order to assure the continued viability and health of the littoral zones. No Certificate of Occupancy shall be issued for any additional square footage constructed until the Plan is determined to be consistent with the Regional Plan. The littoral zone shall be in place prior to the issuance of a Certificate of Occupancy for any additional square footage to be constructed. (Per Resolution R96-26) 6. Drainage plans to be submitted shall be designed so that under no circumstances shall post development runoff volumes exceed predevelopment runoff volumes for a storm event of three-day duration and 25-year frequency, (Per Resolution R96-26) 7. No building permits for gross leasable space in excess of 1,108,000 square feet within the Boynton Beach Mall shall be issued until all right-of-way within the project boundaries have been dedicated, free and clear of all liens and encumbrances, to the City of Boynton Beach or Palm Beach County as necessary and consistent with the Palm Beach County Thoroughfare Right-of-way Protection Plan. Prior to, or upon issuance of a building permit for the additional square footage, the applicant shall pay a fair share contribution consistent with the Fair Share Impact Fee Ordinance applicable to the Boynton Beach Mall proposed change. (Per Resolution R96-26) 9. Upon a site visit to the property to compare the count and location of the regular and handicapped parking spaces to the location shown on sheets SP-l, SP-4, 1 and 1- A of the submitted plans it was determined that changes have been made to the parking layout which results in the total number of provided spaces being less than what is specified on the parking data. The above-listed plan view drawings will be required to be updated to show and identify the accurate number of regular and handicapped parking spaces provided at the site to enable staff to determine whether the provided number of spaces meets the minimum requirements. An accurate count and listing of the existing and proposed new parking space layout is required to determine whether the appropriate number of handicapped parking spaces are being provided at the site. Modify the plans and parking data to show the correct total number of provided spaces. Provide a separate listing identifying the number of required and provided handicapped spaces. Also show on sheet SP-l the location of no less than the minimum number of handicapped parking spaces as required by code. The total number of required parking spaces is incorrectly identified on sheet SP-l. Correct the count and data by dividing the total gross leasable floor area by two hundred (200). Also, correct the inconsistency between the total number of parking spaces that will be provided in the two (2) levels above grade of the parking structure. The number of spaces identified in the parking data on sheet SP-l is 640 and the detail drawing found on the same sheet indicates 680 spaces. The number of parking spaces provided shall be no less than the total number of parking spaces required. Approval of a variance to the zoning code to reduce the number of required spaces will be required if the number of spaces provided is not consistent with city regulations. 10. Modify the building elevations found on sheet titled "Design Elevations" to show a maximum building height not exceeding the city's forty-five (45) feet height limitation. [Chapter 2 - Zoning, Section 6.C.3] 11. On sheet SP-l, show and label the work limit line. 12. On sheet SP-l modify the site data to include the following information: Separately delineate the total square feet area of the preservation site. This area shall match the area that is identified on the city zoning map as REC as well as the area identified on the corrected survey prepared by O'Brien, Sutter & O'Brien, Inc. 13. Correct the inconsistency between the configuration of the parking structure drawing found on sheet SP-l and the parking structure shown on the sheet titled "Design Elevations". Adjust the site data and total number of parking spaces provided accordingly, 14. Submit drawings that show the layout and dimensions of the columns, stairs, walls, elevators (where applicable) and pedestrian access for each of the two above grade levels of the parking structure as well as the parking layout at grade level. Submit elevation view drawings of the North, South and East sides of the parking structure including identifying the dimension of the overall height of the structure. Also identify all exterior materials and their color by name, color designation and manufacturer. 16. Show on the elevation view drawings the location and elevation of the highest point of the roof top mounted equipment. All roof top equipment shall not be visible from a distance of six hundred feet. Show the required screening and identify the material and color by name, color designation and manufacturer. Screening shall not exceed forty-five (45) feet. 17. Submit for review conceptual floor plan drawings of Department Store F. Identify the principal use and ancillary uses on the floor plan. 18. On the sheet titled, Tree Locations Boynton Beach Mall - Preserve, prepared by O'Brien, Sutter & O'Brien, Inc., identify the legal description of the land area and the total acres. The total acreage/area shall not be below the area of the land identified and zoned REC (Recreation). Where applicable, modify the proposed vehicle use area and adjacent landscape strip to not encroach into the preserve. 19. On the sheet titled Planting Plan (L-2), change the spacing of the coco plum hedge from three (3) feet to two (2) feet, center to center. Also place a note on the plan indicating that the spacing of landscape material identified on the landscape plan supersedes the quantities listed. 20. On the sheet titled, Construction Sequencing Plan, indicate the preserve area plantings and maintenance completion times required by resolution R96-26. Also add this note to the pine preserve notes found on the sheet titled Landscape Demolition/ Relocation/Protection Plan. 21. On the symbol legend found on sheet titled Site Plan & Details, change the height of the chain-link fence from four (4) feet to six (6) feet to match the detail drawing on the same sheet. Also indicate that the six (6) foot high fence is permanent, 22. Submit a city approved and executed agreement between the subject property owner and the Lake Worth Drainage District (LWDD) regarding placing parking spaces within the LWDD right-of-way located in the northwest corner of the mall site. 23, Amend the plans to show compliance with the results of the parking lot variance (PKL V 96-001) regarding the reduction in width of back-up space (27 feet to 25 feet) and length of parking space (18 feet to 17.25 feet) for the two above grade levels of the parking structure. Also, if the variance is approved reference on sheet SP-l the above-listed file number and city commission approval date. 24. It is recommended that the proposed wall signage, that was not included with the submittal, for the new store be processed as a minor site plan modification. 25. Submit color photographs of the buildings on the site that are to remain in their existing condition and photos of existing buildings that are located on the sites that abut the perimeter of the subject property. The minimum size is 4" by 6". Each photograph shall be labeled to identify the location of the existing structures with respect to the location of the proposed project. Submit colored elevation view drawings - a colored duplicate copy of all drawings of the elevation views of each side of all buildings and signage associated with the project. The colored elevation views shall match the elevations shown in the documents that were submitted for site plan review. The applicable exterior surfaces as identified above shall be colored with the color name and associated color reference number identified. The type of exterior surface material shall be identified next to the associated color. The colored elevation drawings shall have compass direction or title of the side of the building identified. The title block of the original drawing shall be shown. The maximum size is 24" by 36". Do not submit on board of any kind. 5. Submit color samples as an example of the proposed colors. Each sample shall have attached a label that identifies the color by name and numerical/letter code from an established color chart. 6 . It should be noted that the comments are divided into two (2) categories. The first category is a list of comments that identify deficiencies from the City's Land Development Regulations (L.D.R.) that are required to be corrected and shown in compliance on the plans and/or documents submitted for second (2nd) review in order for the project to continue through the site plan review process. The second set of comment(s) lists recommendations that the Planning and Zoning Department staff believe will enhance the proposed development. The applicant shall understand that all documents and plans submitted for site plan are subject to additional comments. I recommend that the applicant/agent contact me regarding questions related to the comments. If the applicant is not intending to correct code deficiencies and they request that the proj ect remain on the review schedule identified in the attached letter they should contact me regarding the procedures, application forms, fees and submittal deadline dates for seeking relief from the code requirement. I. SITE PLAN REVIEW COMMENTS: 1. Proposed expansion should comply with all conditions of the resolution No. 91-37 amending prior development orders adopted November 16, 1982, and December 19, 1989 (see Exhibit A - - Current Development Order). Submit for review 3 copies of the appropriate restrictive covenants for the perpetual protection of the native preserve. #4. Removal of all referenced exotic material from the limits of the pine area should commence immediately so as not to delay a certificate of occupancy. #5. Buffer along Javert Street number 22. see staff comment #6A. Plans show runoff being directed to drainage structures located in pavement areas which in turn leads to the detention ponds rather than showing runoff being pretreated in grassy swales before being conveyed to the detention pond. Submit littoral zone planting plans for the "T" shaped detention pond. As allowed an alternate design may be necessary to retrofit this pond. #7. Submit drainage computations to verify compliance. #9. Provide an opinion of title prepared by the project's attorney verifying compliance. #10 & #11. Construct all roadway improvements required as part of the "Notice of Proposed Change" resolution to be adopted February 20, 1996. 2. After having visited the property to compare the location of the regular and handicapped parking spaces at the site to the location proposed and shown on sheets SPl, SP4, 1 and I-A of the submitted plans, it is evident that changes are proposed to the layout of a majority of the parking spaces within and outside of the area marked on sheet 1 as "Work Limit Line". These proposed changes will require the following corrections to be made to sheets SPl, SP4, 1, and I-A of the submitted plans: i. Change the detail drawing of the handicapped parking spaces found on sheet SPl to be consistent with the configuration of the parking spaces depicted on city standard drawing B-90012 (find attached B-90012) . ii. Change the configuration of all handicapped parking spaces depicted on sheets SPl, SP4, 1 and I-A to show the appropriate five (5) foot wide access aisle required adjacent to the spaces. iii. On sheets SPl, 1 and I-A, use a symbol to delineate all areas of the parking lot where the regular and handicapped parking spaces are being restriped and state that the restriping will be consistent with city detail drawing B-90012. iv. Where applicable, change the tabular count of spaces identified on the plan view drawings SPl, 1 and I-A so that the number of spaces regular and/or handicapped match the horizontal control dimension between landscape islands, access aisles and other appurtenances such as site lighting pole bases and/or sidewalks. When establishing the number of regular and/or handicapped parking spaces that will fit between two fixed points use the dimension identified on city standard drawings B-90012 and B-90013. v. Where applicable, adjust the site data to identify the total number of parking spaces provided (Note: The number of parking spaces provided shall be no less than the total number of parking spaces required) . vi. Add to the site data found on sheet SPl the total number of handicapped parking spaces that is required and provided (Note: The number of handicapped spaces provided shall be no less than the number required by the Handicapped Accessibility Code) . On sheet SPl identify with notes and/or symbols the buildings that are existing on site and the proposed new structures. 5. On sheet SPl, along the west perimeter of the building identify with a symbol the location of the area where the new building (Department Store F) will connect to the existing building. Also delineate the areas along the perimeter of the building, outside of the area where the new building will connect, that will be changed as a result of the new construction. 6. On sheet SPl add or modify the following site data: i. Omit the ultimate construction text. ii. Identify what percentage the total impervious area is of the entire site. iii. Identify what percentage the pervious area is of the entire site. Separately delineate the total square feet area of the preservation site. iv. Identify 1,244,449 as the maximum gross leasable square footage allowed for the development. 7. On sheet SPl remove from the plan view drawing and building floor area computations the square footage of the third floor of Department Store B to match the square foot area of the building identified on the plans of record located in the Building Division. Adj ust the site data and total number of required parking spaces accordingly. 8. On sheet SPl change the square footage of the auto service center building from 21,696 to 20,511 to match the square foot area of the building identified on the plans of record in the Building Division. Adjust the site data and total number of required parking spaces accordingly. 9. After reviewing the Palm Beach County Tax Map for the relocated canal, the following is requested: Submit a copy of a completed City of Boynton Beach "Unity of Title Form" that has been recorded in Palm Beach County which identifies the relocated L-23 Lake Worth Drainage District canal as tied to the mall property. or Omit from the provided parking space count the parking spaces that are partially or completely located on the relocated canal property (this assumes the Lake Worth Drainage District owns this property). Submit for review a cross access easement agreement allowing access to the subject property. A landscape appeal will be needed to omit the vehicle use area screening along both sides of the L-23 Lake Worth Drainage District. Also, show and identify the west border of the 85 foot wide canal right -of -way. To minimize the amount of pineland removed. the developer is propcsinq to relocate and culvert lateral danal-23 (L-23) so that it lies beneath the ring road of the n!all. Once this canal is culverted, it will create an ~da1t1onal .14 +/- acres of land along Javert street where ~ines can be planted. Both fi~e lines will requi~e post indicato~ valves and Siamese connections. Please indicate thei~ location. 2. The fi~e line on the- south side of the building is within the gene~ator enclosure. Maximum sepa~atlon from the generato~ itself should be maintained so as to avoid pipe failu~e due to vibration. Please specify this distance on the plans. 3. Tapping sleeves and valves must be specified fo~ connecting new fi~e lines and se~vice into existing main. 4. The City maintains main line sewe~ only on this site. Details must, howeve~, still be p~ovided on sanitary servi- ces so as to allow inspection. We recommend the service under the loading docks should be of an ext~a-st~ength material due to its shallowness in the loading area. 5.
